EVALUATION OF PROPOSALS AND AWARD OF CONTRACT. One award will be made to the Offeror (a) whose proposal is technically acceptable and (b) whose technical/price relationship is the most advantageous to the Government. All technical evaluation factors including those listed in section 2a(i)-(iii) of these instructions and any additional factors listed in the prospectus when combined, are significantly less important than cost or price. The critical factor in making any technical/price trade-off is not the spread between the technical ratings, but rather the significance of that difference. The significance of the spread in ratings will be determined on the basis of what that difference might mean in terms of performance and what it would cost the Government to take advantage of it. Where technical proposals are determined to be substantially equal, any cost/price advantage to the Government may control award. Proposals must be submitted initially on the most favorable terms from a technical and price standpoint which the Offeror can submit to the Government. Therefore, the Government reserves the right to award without discussions with the Offerors. However, after receipt of initial offers, written or oral discussions may be conducted with all responsible Offerors whose offers are determined to be in the competitive range. Discussions conducted after receipt of an offer do not constitute a rejection or counteroffer by the Government. Firms lacking a past performance record (new firms or those with no relevant experience within their organization) will be treated as an unknown performance risk, and will receive a neutral rating in this criteria. A neutral rating will be established as the average of all other competing Offerors. The selection official will base the award decision on a tradeoff between price and non-price factors, comparing the relative risk to the government of poor or non-performance posed by each of the offerors, and making a judgement as to whether or not reduced risk of performance is worth additional cost. In some cases this will result in award to a lower ranked but lower priced offer, in other cases award may be to a higher ranked but higher priced offer. The Government may, when in its interest, reject any or all offers or waive any informality in offers received. A written award mailed (or otherwise furnished) to the successful Offeror shall be deemed to result in a binding contract without further action by either party. EVALUATION OF PROPOSALS AND AWARD OF CONTRACT. Santa Xxxx County Staff will review all bids and will provide the recommendation to award to the Procurement Office, the County Administrator and the Board of County Commissioners. The County will award the bid to the responsive and responsible vendor(s) with the lowest responsive bid(s). The County reserves the right to award the bid to the respondent submitting a responsive bid with a resulting negotiated agreement which is most advantageous and in the best interest of the County, and to reject any and all bids or to waive any irregularity or technicality in bids received. Santa Xxxx County shall be the sole judge of the bid and the resulting negotiated agreement that is in its best interest and its decision shall be final. Santa Xxxx County reserves its right to reject any or all Responses, including without limitation nonconforming, nonresponsive, unbalanced or conditional Bids. The County further reserves the right to reject the Response of any Responder whom it finds after reasonable inquiry and evaluation to not be responsible. In evaluating Responses, the County may consider the qualifications of Responders and may consider the qualifications and experience of Subcontractors, Suppliers, and other individuals or entities proposed for those portions of the Work for which the identity of Subcontractors, Suppliers, and other individuals or entities must be submitted with the Response. Santa Xxxx County reserves the right to waive any informalities or reject any and all Responses, in whole or part, to utilize any applicable state contracts in lieu of or in addition to this Response and to accept the Response that in its judgment will best serve the interest of the County.
EVALUATION OF PROPOSALS AND AWARD OF CONTRACT. The Technical Proposals will be evaluated by the NPS School Committee’s Evaluation Committee which will rate the proposals. All Proposers meeting the Minimum Criteria who are responsive to this RFP will be finalists to be interviewed. The interviews will be conducted by the Evaluation Committee. Upon the final review and approval of the evaluations, the Price Proposals will then be opened and evaluated by the Chief Procurement Officer. The contract will be awarded to the responsive and responsible proposer offering the most advantageous proposal, taking into consideration all evaluation criteria as well as price. Any proposers who submit a price that is abnormally low or high, as determined by the City, may be rejected as unrealistic. All proposals shall remain firm for 90 days after the deadline for submission of proposals. In evaluating Proposals, NPS will consider the qualifications of only those Proposers whose proposals are in compliance with the prescribed requirements. NPS reserves the right to reject any proposal if the evidence submitted by, or the subsequent investigation of such Proposer fails to satisfy the City that the Proposer is properly qualified to carry out the obligations of the contract.

  • Award of Contract PLACE MENT OF ORDER (a) The Institute shall consider placement of orders for jobs on those bidders whose offers have been found technical, commercially and financially acceptable.   • BID EVALUATION AND AWARD 13.1 The electronic signature shall be considered an offer on the part of the Bidder. Failure to provide the information requested to make this determination may be grounds for a declaration of non-responsive with respect to the Bidder. 13.7 The Owners reserves the right to reject irregular bids that contain unauthorized additions, conditions, alternate bids, or irregularities that make the Bid Proposal incomplete, indefinite or ambiguous. 13.8 Any governmental agency may piggyback on any contract entered into from this bid.

  • METHOD OF AWARD AND PROCEDURE FOR AWARDING A SOW AGREEMENT 5.1. Contractor selection, or the determination to terminate the SOW-RFP without award, shall be done in the best interest of the State.
