Extended Facility Receiving Hours. (i) Unusual Circumstances Upon request of the Authority no less than one (1) Working Day in advance or in event of emergencies, as soon as possible, Contractor shall use Reasonable Business Efforts to secure appropriate approvals from regulatory agencies and Accept Residue and ADC at times other than Facility Receiving Hours. Contractor may charge Authority for extended Facility Receiving Hours in accordance with Section 8.09. This provision is intended to address a temporary extension of Facility Receiving Hours that may be needed from time to time to accommodate special or unusual circumstances. Extended Facility Receiving Hours are not intended to be utilized by Transport Contractor or the Authority as an outlet for adverse traffic conditions and are intended to be utilized on an infrequent basis for out of the ordinary circumstances.

Extended Facility Receiving Hours. In the event Authority or its Transport Contractor(s) request Contractor to extend Facility Receiving Hours on a temporary basis, Contractor will be compensated by Authority or its Transport Contractor(s) for the amount of time the Facility Receiving Hours are extended on a per-hour basis at the rate provided in Exhibit 1 in addition to the Disposal Fee it will receive for Waste Accepted during the extended Facility Receiving Hours. The additional compensation for extended Facility Receiving Hours shall be the per-hour fee for extended Facility Receiving Hour for any hour or portion thereof that the Facility Receiving Hours are extended. The cost per hour fee provided in Exhibit 1 shall be adjusted on the same schedule as the Disposal Fee, commencing with changes effective January 1st. The cost per hour fee shall be adjusted to reflect changes in CPI, the adjustment shall be rounded to the nearest dollar, and shall be adjusted on an annual basis at the same time the Disposal Fee is adjusted. The first annual increase will be effective January 1, 2009. The per-hour fee will be adjusted annually to reflect one hundred (100) percent of the change in CPI using the method presented below:

Contractor may charge Authority, or Authority Member's Collection Contractor(s) if directed by Authority, for extended Facility Receiving Hours in accordance with Section 8.07. This provision is intended to address a temporary extension of Facility Receiving Hours that may be needed from time to time to accommodate special circumstances.
Extended Facility Receiving Hours. In the event Authority requests Contractor to extend Facility Receiving Hours on a temporary basis, Contractor shall be compensated by the Authority or its Collection Contractor the per-hour fee specified in Exhibit 1 in addition to the compensation it will receive for Permitted Materials Accepted during the extended Facility Receiving Hours.
Extended Facility Receiving Hours. Upon request of City, no less than one (1) Business Day in advance or any other mutually agreed time period, or in event of emergencies such as truck breakdown, poor weather or road conditions, Contractor shall Accept Acceptable Materials at times other than the Facility hours listed in Sections 6.2.A and 6.2.B. Contractor may charge the Franchised Collector $270 per hour (in 15 minute increments), if directed by City. This provision is intended to address temporary extension of Facility hours that may be needed from time to time to accommodate special circumstances.

  • Credit Hours Any hours worked under a Flexi-Tour or Gliding Schedule which are in excess of an employee’s basic work requirement which, upon management approval (e.g., that sufficient work to be performed exists), are worked at the request of the employee. Credit hours may be earned and used in quarter-hour increments. Credit hour use must be requested by the employee and approved by management in advance. A request to use credit hours will be granted, workload permitting.

  • Unused Facility Fee A quarterly Unused Facility Fee equal to one quarter of one percent (0.25%) per annum of the difference between the Revolving Line and the average outstanding principal balance of Advances during the applicable quarter, which fee shall be payable within five (5) days of the last day of each such quarter and shall be nonrefundable; and

  • Building Hours The specific hours at any individual building may vary according to the needs of the educational program of the School District. The specific hours for each building will be designated by the School District.

  • Access to Facility 13.1 Each Party shall ensure that its facilities are secured at all times. 13.2 The Customer shall permit and, if the land on which the Facility is located is not owned by Customer, cause such landowner to permit, the Distributor's employees and agents to enter the property on which the Facility is located at any reasonable time. Such access shall be provided for the purposes of inspecting and/or testing the Facility as and when permitted by this Agreement, the Code or the Distributor’s Conditions of Service or as required to ensure the continued safe and satisfactory operation of the Facility, to ensure the accuracy of the Distributor's meters, to establish work protection, or to perform work. 13.3 Any inspecting and/or testing referred to in section 13.2 shall not relieve the Customer from its obligation to operate and maintain the Facility and any related equipment in a safe and satisfactory operating condition and in accordance with this Agreement. 13.4 The Distributor shall have the right to witness any testing done by the Customer of the Facility and, to that end, the Customer shall provide the Distributor with at least fifteen working days advance notice of the testing. 13.5 Notwithstanding section 10.1, where the Distributor causes damage to the Customer's property as part of this access, the Distributor shall pay to the Customer the Customer's reasonable costs of repairing such property or, if such property cannot be repaired, replacing such property. 13.6 Notwithstanding section 10.1, if the Customer has been given access to the Distributor’s property, and if the Customer causes damage to the Distributor’s property as part of that access, the Customer shall pay to the Distributor the Distributor’s reasonable costs of repairing such property or, if such property cannot be repaired, replacing such property.

  • Facility Use The Employer shall allow individuals the use of gender- segregated facilities, such as restrooms, locker rooms, and dressing rooms that are consistent with that individual's gender expression or gender identity. In such facilities where undressing in the presence of others occurs, the Employer shall allow access to and use of a facility consistent with that individual's gender expression or gender identity.

  • Operating Hours Subject to Building Rules and Regulations and such security standards as Landlord may from time to time adopt, the Building shall be open to the public during the Building Operating Hours and the Premises shall be open to Tenant during hours other than Building Operating Hours.

  • Building Access The authorized representatives of the Union shall upon request have access to the District’s premises at any reasonable time for the purpose of adjusting grievances, investigating working conditions, or ascertaining that provisions of this Agreement are being adhered to; provided the representatives check in with the front office, following school protocol to receive a visitor’s badge, they do not interfere with employees in the performance of their duties. The Union shall furnish the District with the names of its authorized representatives.

  • Availability Period The line of credit is available between the date of this Agreement and April 30, 2012, or such earlier date as the availability may terminate as provided in this Agreement (the “Facility No. 1 Expiration Date”).

  • Verizon OSS Facilities Any gateways, interfaces, databases, facilities, equipment, software, or systems, used by Verizon to provide Verizon OSS Services to ICG.

  • Unused Revolving Line Facility Fee A fee (the “Unused Revolving Line Facility Fee”), payable quarterly, in arrears, on a calendar year basis, in an amount equal to one quarter of one percent (0.25%) per annum of the average unused portion of the Revolving Line, as determined by Bank. Borrower shall not be entitled to any credit, rebate or repayment of any Unused Revolving Line Facility Fee previously earned by Bank pursuant to this Section notwithstanding any termination of the Agreement or the suspension or termination of Bank’s obligation to make loans and advances hereunder; and
