Facilities Construction. Any improvements or transportation facilities, including sawmills, buildings, bridges, roads, etc., constructed by the PURCHASER in connection with this sale and within the sale area or on other State land leased for the purpose, must be done in accordance with standard or special plans approved by the STATE. Bonding may be required on each improvement. The STATE neither expressly nor implicitly warrants its improvement estimates. Estimates will be made for the sole purpose of establishing the minimum bid, and are not to be used for other purposes.
Facilities Construction. The Facilities shall be constructed by the Landowner in accordance with the plans and specifications for the development as contained in the attached site plan. The Landowner understands and agrees that modifications may be needed to make the system work properly after the facilities are installed, and agrees to make modifications and adjustments as may be required by Lindon City.

Licensee shall design and construct Licensee's Facilities, at its own expense, pursuant to the general specifications set forth in Exhibit "B" attached hereto; provided, however, that Licensee shall provide Licensor with detailed construction plans prior to the commencement of construction, which shall be subject to the approval of Licensor, which approval shall not be unreasonably withheld, conditioned, or delayed. Emergency power for the operation of the communication facility shall be provided by a generator.

Nothing herein shall be construed to grant Purchaser or Purchaser’s contractors or subcontractors the right to construct any facilities such as barge ramps, camps, buildings, sawmills, shake xxxxx, fuel storage facilities, or to locate trailers on the Timber Sale Area unless such facilities have been included as part of an approved Operating Plan.
Facilities Construction. Owner agrees to construct the improvements and facilities described in the letter from Owner’s engineering firm, MKN & Associates, dated July 8, 2022, entitled Perricone Interim Agreement Extension in a good and xxxxxxx-like manner according to the Implementation Schedule therein. The Owner shall provide for the design, engineering, and construction of the Facilities at its sole cost and expense as provided hereinafter.

Pursuant to the Utility Service Rate Schedule and Riders, WPL shall construct or cause to be constructed, and shall own, operate, and maintain the Gas Delivery Facilities to render the natural gas transportation service contemplated by this Agreement. The Gas Delivery Facilities include Town Border Station pipeline upgrades, pipeline facilities, measurement and telemetry equipment, heating, regulation, and other gas conditioning facilities.
