Facility and Equipment Maintenance. Each Party shall maintain, at its own expense, the roadways, property, equipment, and facilities and access to said facilities that it owns that are subject to this Agreement and the Operating Easement pursuant to Good Utility Practices. Unless otherwise specified herein, or unless the Parties mutually agree to a different arrangement, neither Party shall be responsible for the maintenance of the other Party's Primary Equipment or Secondary Systems, as set forth in Schedule A hereto or the Separation Document, regardless of the location of the Primary Equipment or Secondary Systems.

Facility and Equipment Maintenance. 3.4.1 Pepco shall provide Interconnection Service at the Point of Interconnection in a safe and efficient manner and pursuant to PJM Requirements and Good Utility Practice. Generator shall be responsible for all reasonable Costs incurred by Pepco to provide Interconnection Service and to Maintain the Interconnection Facilities pursuant to the Agreement.
3.4.2 Generator shall Maintain the Generating Facilities (including coordination of its relay protection equipment) in a safe and efficient manner and as required by and in accordance with PJM Requirements and Good Utility Practice, provided, however, that Generator shall not be obligated to modernize, expand or upgrade the Generating Facilities unless the failure to modernize, expand or upgrade is reasonably likely to have a material adverse affect on the operation of the Interconnection Facilities or the Transmission System.
3.4.3 Unless otherwise specified herein, or unless the Parties mutually agree to a different arrangement, neither Party shall be responsible for the maintenance of the other Party's equipment or property regardless of its location.
3.4.4 In addition to the requirements set forth elsewhere in this Agreement, each Party shall Maintain its equipment and facilities and perform its maintenance obligations that could reasonably be expected to affect the operations of the other Party in a safe and efficient manner and pursuant to PJM Requirements and Good Utility Practice.

The Producer shall Maintain its own property, equipment, facilities and appurtenances at the Station that might reasonably be expected to have an impact on the operation of the Transmission System or the Company Interconnection Facilities in a safe and efficient manner, as required by and in accordance with Good Utility Practice.
3.3.2 At their sole expense, the Producer shall maintain in full force and effect all permits, licenses, rights-of-way,and other authorizations as may be required to Maintain the Producer's Generating Facilities. At the Company's reasonable request, the Producer shall furnish to the Company copies of each permit, license, right of way and authorization promptly following receipt thereof.

The Producer shall Maintain its own property, equipment, facilities and appurtenances at the Station that might reasonably be expected to have an impact on the operation of the Company Interconnection Facilities in a safe and efficient manner, as required by and in accordance with Good Utility Practice. The Producer shall Maintain all common-use roadways and plant accesses in or about the Station.

The Generation Station Owners shall pay the Switching Station Owners for the costs they incur to Maintain the Switching Station Facilities installed pursuant to Section 3.
Facility and Equipment Maintenance. 3.6.1. Customer shall Maintain the Plant to the extent required by and in accordance with Good Utility Practice. RGE shall Maintain the Transmission System to the extent required by and in accordance with Good Utility Practice and all applicable laws, regulations, and governmental orders. Customer shall Maintain all common-use roadways and accesses over Customer-owned lands to the Transmission System facilities to the extent Reasonably required or necessary to provide Interconnection Service to Customer under this Agreement.
