FAILURE TO COMPLY WITH TERMS AND CONDITIONS. Failure to comply with the terms and conditions of this Agreement including Agency Rules may restrict your transfer privileges and also be subject to specific stipulated contractual damage payments for violation of the OCRRA System Rules.
FAILURE TO COMPLY WITH TERMS AND CONDITIONS. Cozad Telephone may deny you access to all or part of the Service without notice if you engage in any conduct or activities that Cozad Telephone, in its sole discretion, believes violates any of the terms and conditions in this Agreement. If Cozad Telephone denies you access to the Service because of such a violation, you shall have no right (1) to access through Cozad Telephone any materials stored on the Internet, (2) to obtain any credit(s) otherwise due to you, and such credit(s) will be forfeited, (3) to access third party services, merchandise or information on the Internet through Cozad Telephone, and Cozad Telephone shall have no responsibility to notify any third-party providers of services, merchandise or information nor any responsibility for any consequences resulting from lack of notification. You agree to defend, indemnify and hold Cozad Telephone and each of its affiliates harmless from any and all liabilities, costs and expenses, including reasonable attorneys’ fees, related to any violation of this Agreement by you or authorized users of your account, or in connection with the use of the Service or the Internet or the placement or transmission of any message, information, software or other materials on the Internet by you or authorized users of your account.
FAILURE TO COMPLY WITH TERMS AND CONDITIONS. If the Occupier has failed to comply with any condition of this Agreement, the Corporation may serve upon the Occupier a Compliance Notice stating:
FAILURE TO COMPLY WITH TERMS AND CONDITIONS. Any breach of the terms and conditions of this Agreement, or failure on the part of the Agency to proceed with due diligence and in good faith in the construction and maintenance of the Improvements provided for herein, shall subject this Agreement to be terminated, and WSDOT, in its sole discretion, may require the Agency to remove all or part of the Improvements constructed hereunder at the Agency’s sole expense. If the Agency fails to effect such removal of its Improvements, the removal may be performed by WSDOT without prior approval of the Agency, and the Agency agrees to pay WSDOT’s reasonable cost and expense for performing the work. WSDOT shall provide to the Agency a detailed invoice for such removal work, and the Agency agrees to make payment within thirty (30) calendar days of the date of the invoice pursuant to Section 7.
