Fourth Expansion Premises. (a) In consideration of the rents, terms, provisions and covenants of this Amendment and the Lease, Landlord hereby leases unto Tenant and Tenant hereby rents and accepts from Landlord the “
Fourth Expansion Premises. Commencing on the Fourth Expansion Premises Rent Commencement Date, Base Rent for the Fourth Expansion Premises shall be equal to $3.20 per rentable square foot of the Fourth Expansion Premises per month. Base Rent payable with respect to the Fourth Expansion Premises shall be increased, commencing on the later of (i) the first anniversary of the Fourth Expansion Premises Rent Commencement Date, or (ii) May 1, 2017, and on each subsequent anniversary of such date during the Base Term each, a “Fourth Expansion Premises Adjustment Date”) by multiplying the Base Rent payable with respect to the Fourth Expansion Premises immediately before such Fourth Expansion Premises Adjustment Date by 3% and adding the resulting amount to the Base Rent payable with respect to the Fourth Expansion Premises immediately before such Fourth Expansion Premises Adjustment Date.
Fourth Expansion Premises. Tenant shall not be required to pay Base Rent with respect to the Second Expansion Premises (as defined in the Fifth Amendment), the Third Expansion Premises (as defined in the Sixth Amendment) and the Fourth Expansion Premises through the Termination Date. 6.

Notwithstanding the foregoing, if Landlord is prepared to deliver the Fourth Expansion Premises to Tenant prior to July 1, 2007, the Fourth Expansion Premises Commencement Date shall not occur until at least thirty (30) days after Landlord has delivered to Tenant written notice that Landlord is prepared to deliver the Fourth Expansion Premises. As of the Fourth Expansion Premises Commencement Date, all references to the Premises in the Lease shall be deemed to refer to the Existing Premises, the First Expansion Premises, the Second Expansion Premises, the Third Expansion Premises, and the Fourth Expansion Premises.
