Gas Specifications. Seller represents that all Gas delivered hereunder shall meet or exceed the specifications of Buyer's Transporter.
Gas Specifications. 9.1.1 The Operator shall ensure that Gas delivered to the Gas Delivery Point complies with the Gas Specifications, provided that the LNG delivered at the LNG Receipt Point complied with the LNG Specifications.
9.1.2 The Operator shall notify or cause the GPN Operator to notify the User promptly (but no later than twenty-four (24) hours) after it becomes (or they become) aware that Gas sent out to the Gas Delivery Point does not comply with the Gas Specifications (“Off- Specification Gas”), providing details of the quantity and quality of such Off- Specification Gas.
9.1.3 If the GPN Operator refuses to accept Off-Specification Gas, then the Operator shall cease delivery of such Off-Specification Gas (if delivery has commenced), in which case the Operator shall dispose of such Off-Specification Gas acting as a Reasonable and Prudent Operator. In such event, if the LNG delivered at the LNG Receipt Point complied with the LNG Specifications, then a Non-Permitted Service Reduction shall be deemed to have occurred.
9.1.4 The Operator shall indemnify, defend and hold harmless the User from and against any and all Costs and Losses (excluding, to the greatest extent permitted by Applicable Laws, Consequential Losses) suffered by the User acting at all times as a Reasonable and Prudent User, as a result of any actions taken by the Operator in relation to the Off- Specification Gas, provided the LNG delivered at the LNG Receipt Point complied with the LNG Specifications.

Gas Specifications. Buyer and Seller each agree that Gas delivered hereunder will be in a commingled stream and shall be at the pressure and meet or exceed the minimum quality specifications required by NOVA and Montana Power Company.
Gas Specifications. All Gas delivered by Customer under this Agreement shall meet the Gas Specifications.
Gas Specifications. (1) All Gas tendered by Buyer for delivery to the Gas Delivery Point shall meet the then current natural Gas quality specifications as set forth in the Gas Transporter’s tariffs as filed with the CPUC (“Gas Tariff), as such specifications may change from time to time.
(2) If Gas tendered for delivery under this Agreement at the Gas Delivery Point materially fails for any reason to conform to the applicable specification set forth in Section 11.3(1) (“Non-Conforming Gas”), Seller will consider whether it is able to accept such Non-Conforming Gas and may refuse to take possession of all or any part of such Gas, giving Buyer the reasons for such refusal as soon as practicable. If Seller chooses to accept the Non-Conforming Gas, it will advise Buyer of the same in writing, and each Party shall be responsible for the disposition of its own Gas, as applicable.
(3) If the Facility is damaged as a direct result of the delivery of Non-Conforming Gas that Seller has not approved for receipt and use at the Facility, Seller shall be entitled to the remedies available to it pursuant to its agreement with the Gas Transporter. Seller shall use commercially reasonable efforts to mitigate any damages resulting from the delivery of any Non-Conforming Gas at the Gas Delivery Point and the use of such Gas in a Unit.
(4) The unavailability of the Facility due to Buyer’s delivery of Non-Conforming Gas that was not approved by the Seller shall not be considered a Forced Outage, and the Facility shall be considered available for the purpose of calculating the Monthly Availability Payment.

Gas Specifications. The quality of Customer-owned gas delivered to Company on behalf of Customer shall meet or exceed the specifications contained in 83 Illinois Administrative Code Section 530.10 and Section 530.15 and the FERC-approved gas tariffs of APL, NBPL and NGPL. Customer-owned gas that does not meet such specifications may be refused by Company and Customer will indemnify Company against any loss or damage resulting from delivery of such gas, for the account of Customer, which does not meet such specifications.
