Gas Quality Specifications. Plant Supplier’s Gas delivered into Southern’s Line shall conform to the gas quality specifications (“Quality Specifications”) contained in the then-current FERC Gas Tariff applicable to Southern’s Lines, with the exception of any specification related to (i) liquefiable hydrocarbon content, (ii) BTU content, and (iii) hydrocarbon dew point. Plant Supplier’s Gas shall be natural gas that was produced only from a gas reservoir from a well. Any waiver of a Quality Specification by Processor must be in writing and no receipt of gas that does not conform to the Quality Specifications (“Off-Spec Gas”) by Processor shall act as a waiver of the applicable Quality Specifications with respect to any future deliveries of gas, other than the gas specified in Processor’s written waiver. Plant Supplier shall use commercially reasonable efforts to remedy the quality of such Off-Spec Gas in a timely manner and Plant Supplier shall inform Processor timely of the disposition of such Off-Spec Gas.
Gas Quality Specifications. For the Jemgum Storage Facility the quality parameters published by the Neighbouring Network Operators shall apply at the Delivery Points listed under Article 5 Section 2 and 3.
Gas Quality Specifications. All gas received and delivered under the terms of this Agreement must conform to the following specifications:
Gas Quality Specifications. As defined in Section 10.1. [Gathering Agreement. As defined in the recitals.] [Gathering Receipt Point. Each “Receipt Point” as defined in the Gathering Agreement.]
Gas Quality Specifications. (a) Producer’s Gas received and delivered at each Receipt Point will meet the following quality specifications:
(i) Hydrogen Sulfide - not to exceed 100 parts per million by volume;
(ii) Total Sulfur - including mercaptans and hydrogen sulfide, not to exceed one grain per one hundred Cubic Feet of Gas;
(iii) Carbon Dioxide - not to exceed 3% by volume;
(iv) Temperature - not less than forty degrees (40°) Fahrenheit and not more than one hundred twenty (120°) Fahrenheit;
(v) Nitrogen - not to exceed 1% by volume and total inert Gases not to exceed 3% by volume;
(vi) Other - not to contain any carbon monoxide, halogens or unsaturated hydrocarbons; and
(vii) Hazardous Waste - not to contain hazardous waste as defined in the Resource Conservation and Recovery Act of 1976. Gatherer hereby acknowledges and agrees that nothing herein shall be deemed to obligate Producer to separate Gas from Producer’s Products and other hydrocarbons (including all components contained therein and water therewith) that are received and delivered at each Receipt Point.
(b) If Producer delivers Gas not meeting the specifications set forth in Section 10.1(a), Gatherer shall accept such non-specification Gas, provided that Gatherer is only required to accept such non-specification Gas to the extent (i) after separation, processing and stabilization pursuant and subject to the terms of Section 10.3, such non-specification Gas will not be rejected by any Person receiving such Gas at the Delivery Point(s) or any point downstream thereof and (ii) Gatherer determines, in its sole reasonable discretion, that such nonspecification Gas will not cause damage to person or property. Subject to the foregoing and Section 10.3, to the extent that Gatherer incurs out-of-pocket costs in connection with delivering Producer’s Gas not meeting the specifications set forth in this Section 10.1 to the Delivery Point(s) or any point downstream thereof (including without limitation, any downstream intrastate or interstate pipeline), Producer shall reimburse Gatherer for such out-of-pocket costs.
Gas Quality Specifications. Customer Gas delivered hereunder shall meet each of the quality specifications set forth in Exhibit E attached hereto (collectively, the “Specifications”) at the Point of Delivery. If Customer Gas satisfies the Specifications at the Point of Delivery, Processor shall deliver (i) Customer Residue Gas that meets the quality specifications of the downstream pipelines and other facilities owned or operated by Processor or its Affiliate(s) and connected to the Point of Redelivery and (ii) Customer Plant Products that meet the quality specifications of the downstream pipelines and other facilities owned and operated by Processor or its Affiliate(s) and connected to the NGL Delivery Point.
