GRADING, DRAINAGE, AND EROSION CONTROL PLAN. The Developer shall prepare a grading, drainage erosion control plan for any site work that disturbs soil on the Subject Property, including, but not limited to, utility work, construction of a new house or installation of a new driveway. No site grading shall occur prior the Developer obtaining a Grading or Building Permit approved and issued by the City and prior to the installation of approved erosion control measures. The natural drainage pattern shall be retained. Said Plan shall be prepared by a Minnesota State Licensed Civil Engineer. To ensure erosion control during the development of the Subject Property, the Developer is required to execute the Erosion Control Agreement (Exhibit B) and submit a financial surety deposit, in a form approved by the Public Works Director. Said deposit shall be submitted prior to, or concurrently with, the issuance of a building permit.

GRADING, DRAINAGE, AND EROSION CONTROL PLAN. Prior to issuance by the City of any grading permit, Developer shall submit to the City Engineer and obtain the City Engineer's written approval of a final grading, drainage, storm water, and erosion control plan, which plan shall be consistent with the plan identified on Exhibit E of this Development Agreement, and in compliance with the City Engineer’s September 2, 2014 Plan Review Memorandum. With respect to all portions of the Property to be conveyed to Delano through public easement, right of way or fee title, Developer shall be responsible for constructing and maintaining all grading, storm water/drainage infrastructure, and erosion control in compliance with the approved plans and in compliance with the City Engineer’s requirements for additional improvements required to maintain adequate storm water/drainage, grading and erosion control on the Property. With respect to individual lots on the Property where residential construction is anticipated to occur, Developer shall improve and maintain the storm water/drainage improvements, grading and erosion control in compliance with the approved plans and such additional storm water/drainage improvements and grading required by the City Engineer, until such time as an individual building/grading plan for that specific lot is approved. In the event Developer does not comply with any of the terms and conditions of this paragraph, Delano’s remedies shall include, but not be limited to, a draw on the Security referred to in paragraph 13 herein.

Developer shall revise these plans in order to ensure that neighborhood drainage between buildings is contained in common lots or drainage and utility easements.

  • Erosion Control a. The Purchaser shall construct slash and debris erosion barriers, dips, water bars or ditches in skid trails and landings as directed by the Forest Officer.

  • Construction Plans Tenant shall prepare final plans and specifications for the Tenant Improvements that (a) are consistent with and are logical evolutions of the Approved Schematic Plans and (b) incorporate any other Tenant-requested (and Landlord-approved) Changes (as defined below). As soon as such final plans and specifications ("Construction Plans") are completed, Tenant shall deliver the same to Landlord for Landlord's approval, which approval shall not be unreasonably withheld, conditioned or delayed. All such Construction Plans shall be submitted by Tenant to Landlord in electronic .pdf, CADD and full-size hard copy formats, and shall be approved or disapproved by Landlord within ten (10) business days after delivery to Landlord. Landlord's failure to respond within such ten (10) business day period shall be deemed approval by Landlord. If the Construction Plans are disapproved by Landlord, then Landlord shall notify Tenant in writing of its objections to such Construction Plans, and the parties shall confer and negotiate in good faith to reach agreement on the Construction Plans. Promptly after the Construction Plans are approved by Landlord and Tenant, two (2) copies of such Construction Plans shall be initialed and dated by Landlord and Tenant, and Tenant shall promptly submit such Construction Plans to all appropriate Governmental Authorities for approval. The Construction Plans so approved, and all change orders approved (to the extent required) by Landlord, are referred to herein as the "Approved Plans."
