Tree Preservation Sample Clauses

Tree Preservation. Article 28.06, Landscaping and Tree Preservation, of the Applicable Rules shall apply to the Land.
Tree PreservationDeveloper shall replace any and all trees that are removed as part of the construction of the Project with the appropriate number of new trees pursuant to the City’s Tree Ordinance. Developer shall cause the Project to maintain said trees in an appropriate manner pursuant to the City’s Tree Ordinance. Developer shall not be required to mitigate for trees that need to be removed that are on City property.
Tree Preservation. A. Before construction, grading, or land clearing begins, the Developer shall visibly mark trees or tree areas that are to be preserved and install city-approved tree protection fencing or other method at the critical root zone of trees to be protected. The location of the fencing shall be in conformance with the approved tree preservation plan. B. The Developer shall pay a fee in lieu of the required replacement trees not installed on the site that shall equal the cost of materials and installation, plus ten percent. The required fee shall be paid prior to the issuance of development permits. C. If a tree that was required to be preserved is removed or damaged so that it is in a state of decline within two growing seasons from the date of the project closure, it must be mitigated at a rate of 2:1, or two caliper inches of trees replaced for every caliper inch of tree removed. The City may use the performance guarantee provided for the Landscape Plan to accomplish this.
Tree PreservationIt is the intention of xxxxxx llc. to make every effort to preserve all trees selected for preservation within the limits of clearing. However in the event any trees do die during or after construction, xxxxxx llc. is not responsible for their removal. Any trees which must be removed after clearing will be charged as an extra to the client. (Note: Tree near addition may be lost.)
Tree Preservation. Trees shall be preserved as possible, including those in the right of way. Protective tree fencing shall be installed in accordance with the City’s Vegetation and Woodlands Ordinance. A wood chip berm, a minimum of 2 feet wide and 18 inches deep, shall be installed inside of the tree protection fence. Tree PreservationSubject only to TXDOT or City or County requirements to the contrary, Developer agrees not to remove two trees identified on Exhibit D. The trees are located on the eastern fence line of the southeast corner of the fire department lot, one by Xxxxxx’x green gate and the other 30-50 yards north.
Tree Preservation. 1. The Owner shall: (a) preserve existing trees as indicated in the Tree Preservation Plan; (b) install tree protection barriers (the “Protective Fencing”) in accordance with the Park Standards along the perimeter of the tree protection zone prior to the start of any construction activity on the Lands, to the satisfaction of the Director of Parks; (c) retain a landscape architect to supervise and approve the installation of the Protective Fencing and ensure that it remains in place during the entire period of construction activity. The landscape architect shall certify to the Director that the Protective Fencing has been installed in accordance with the approved Tree Preservation Plan; (d) not remove any trees without prior written approval of the Director of Engineering, except such trees that are diseased or dead as determined by a certified arborist, or such trees that are identified as part of the Tree Preservation Plan; (e) undertake every precaution necessary to prevent damage to existing trees and vegetated areas, including the following: (i) areas within the Protective Fencing shall remain undisturbed and shall not be used for the storage of surplus soil, debris and building materials or equipment; (ii) no contaminants shall be dumped or flushed where feeder roots of vegetation exist; (iii) no vegetation or tree limbs shall be removed, pruned or otherwise damaged during the course of construction; and (iv) no rigging cables shall be wrapped around or installed in trees to be preserved; and (f) For every tree removed, the Owner shall plant three replacement trees. Any shortfalls that cannot be planted to meet the 3:1 compensation rate will require cash compensation in the amount indicated in Schedule “F1”. 2. The security provided for tree preservation in Schedule “F2” shall be based on compensation at a rate of 3:1 for tree replacements unless otherwise approved by the Director of Parks.

Tree Preservation. After any harvesting or clearing of pine crop areas which may be allowed under Xxxxx culture, the Owner/Developer will submit a survey or exhibit depicting all trees eight (8) inches diameter breast height (DBH) or greater within proposed development phase areas being submitted for development approval, and twenty-five (25) feet beyond. Hardwood trees in excess of eight (8) inches DBH will be described by their actual location. Individual trees over 24 inches DBH or specimen trees (live oak, magnolia, dogwood, sycamore, walnut, hickory, pecan, white oak, or southern red oak) over 12 inches DBH that are to be removed shall be replaced with trees having an individual caliper measurement in excess of 2.5 inches DBH. Replacement trees shall meet or exceed the total DBH caliper inches removed. Surveyed preserved trees in excess of 2.5 caliper inches may be counted as replacement or post development trees. Total post development tree coverage shall equal 3 hardwood trees per lot on average throughout the community or 12 hardwoods per acre in the case of non-residential development. Owner/Developer will use its best efforts to preserve specimen trees.
