HEALTH WARRANTY. Member and Buyer represent that Member is in good health and has no disability, impairment medical condition or illness preventing Member from engaging in exercise, use of Crunch facilities or that poses a health risk to other users of the Gym. Member and Buyer assume full responsibility for Member’s medical condition as it relates to his/her ability to engage in exercise. Member and Buyer agree that Member will not use any of Crunch facilities with open cuts, abrasions, sores, infections, contagious conditions or maladies which may impose a health risk to others in accord with state and local health requirements. Crunch Management reserves the right to prohibit or limit the use of its facilities to Members with such conditions in accord with state and local health requirements.

(7) The buyer agrees to notify the seller of the problem as well as furnish veterinary reports by two unassociated licensed veterinarians stating the affliction within two business days of the problem’s discovery.
HEALTH WARRANTY. If Buyer satisfies the conditions of this Section 5, for a period of thirty (30) months from the Puppy’s date of birth, Breeder warrants that the Puppy will not have any inherited genetic defects that would be life threatening or materially life altering. This genetically inherited health warranty includes all internal organs and issues that are not visible on a routine physical examination. If an inherited genetic defect is found and Xxxxx has complied with the conditions of this Contract and warranty, Xxxxx’s solace and exclusive remedy will be to receive, at Breeder’s sole option, either a replacement puppy of same sex and color in the next available litter or cash refund of the Purchase Price. Xxxxx must return the Puppy to Breeder prior to receiving replacement puppy or refund. Buyer is solely responsible for all shipping expenses related to return of the Puppy and receiving a replacement puppy. This warranty is non-transferable.
HEALTH WARRANTY. 5.1. The warranty period is one year, from date of purchase. This warranty covers against fatal and life altering congenital diseases. This includes severe hip dysplasia which hampers the dog's movement and kidney, heart, pancreas, spine and liver problems of a severe, life threatening or altering nature. If the dog dies within the warranty period, the buyer must pay to have the animal autopsied to determine the reason of the death. If the reason is found to be congenital, the seller will replace the puppy by other with similar characteristics but will not refund money. There is no cash refund of any kind, in full or partial. The replacement puppy will be of equal value.
5.2. The animal must exhibit the congenital defect under its warranty period and the seller must be notified of the problem within 3 business days by the licensed veterinarian determination and have two reports from 2 unassociated veterinarians stating the same problem. A puppy with a defect must be returned or euthanized with the prior permission of the seller to qualify for a replacement puppy.
5.3. A returned puppy must be returned to the seller in good condition, other than the specified problem. No replacement puppy will be given if the original puppy has been neglected or abused.
5.4. No replacement puppy will be given if the puppy has been bred or euthanized without the seller's permission.
5.5. The seller is responsible for transportation costs to the seller for original puppy. The seller is responsible for transportation costs to the buyer for replacement puppy.
5.6. This guarantee applies to the original buyer only and is nontransferable to anybody else other than the buyer signed on the bottom of this page.
5.7. This guarantee does not cover what is considered normal in the bulldog breeds: Cherry Eye, Entropion, “Loose” Hips, Skin Allergies, Elongated Soft Palate, Non-Descending Testicles and Collapsed Nostrils. Any kind of parasites, bacteria, or viruses and sicknesses caused by them will not be covered under this warranty. These are also certain disorders that may be caused by environmental factors, for example: Allergies, Dysfunction, Demodectic Mange, and other autoimmune disorders that are not covered by this guarantee.
5.8. This guarantee does not cover any type of breathing issues which is common on the breed. This includes, Hypoplastic Trachea as well.

HEALTH WARRANTY. Each member represents to Elysium Tennis that he/she is physically fit to perform all those activities which he/she undertakes at Elysium Tennis and that he/she understands all the health risk associated with such activities.
