HOSPITAL RESPONSIBILITIES. 1. HOSPITAL agrees to make the appropriate facilities available to UNIVERSITY in order to provide supervised clinical experience to students in the program. Such facilities shall include an environment conducive to the learning process of the students as intended by the terms of this Agreement and conforming to the customary HOSPITAL procedures. 2. HOSPITAL may cancel, by notice in writing to the UNIVERSITY, the clinical placement of any student whose performance is unsatisfactory, whose personal characteristics prevent desirable relationships within the HOSPITAL, or whose health status is a detriment to the student's or other students successful completion of the Clinical Education assignment. Prior to such cancellation, the HOSPITAL shall notify the UNIVERSITY and consult with it about the proposed action. 0. Xx any situation in which, in the sole opinion of the HOSPITAL, a patient's welfare or the best interests of the hospital may be adversely affected, the HOSPITAL may take immediate corrective actions which could include removal of the student from the facility. The UNIVERSITY will be immediately notified of the action taken. Discussion of the student’s continued involvement in the hospital program will ensue. The HOSPITAL understands that the UNIVERSITY, as a public agency, must provide procedural due process for its students. 4. While in the HOSPITAL, students will have the status of trainees and are not to replace HOSPITAL staff, and are not to render patient care and/or service except as identified for educational value and delineated in the jointly planned educational program. 5. Emergency outpatient treatment will be available to students while in the HOSPITAL for clinical training in case of accident or illness. However, any student utilizing this service will be responsible for payment of the services provided. 6. HOSPITAL shall designate and submit in writing to UNIVERSITY the name and professional and academic credentials of a person to be responsible for the Clinical Education Program. That person shall be called the Clinical Education Supervisor, and shall maintain contact with the UNIVERSITY designated liaison person to assure mutual participation in and surveillance of the Clinical Education Program. 7. HOSPITAL shall notify UNIVERSITY in writing of any change or proposed change of the Clinical Education Supervisor. 8. HOSPITAL shall provide a planned supervised program of clinical experience as specified in the most recent outline of its Clinical Education Program supplied in writing at regular intervals to the UNIVERSITY. 9. HOSPITAL shall, on reasonable request, permit the inspection of its clinical facilities, services available for clinical experiences, student records, and such other items pertaining to the Clinical Education Program by representatives of the UNIVERSITY or agencies, or both, charged with the responsibility for approval of the facilities or accreditation of the curriculum. 10. HOSPITAL shall, at the commencement of a student's placement, provide the student a thorough orientation of the HOSPITAL's administrative policies, standards, and practice relevant to the clinical placement. This will include education pertaining to the HOSPITAL policy relevant to patient confidentiality. 11. The HOSPITAL will provide the student with access to parking, availability to use the Medical Library, and the employee discount on food services.

HOSPITAL may cancel, by notice in writing to the UNIVERSITY, the clinical placement of any student whose performance is unsatisfactory, whose personal characteristics prevent desirable relationships within the HOSPITAL, or whose health status is a detriment balance billed to the student's or other students successful completion of . Xx any situation in which, in the sole opinion of the HOSPITAL, a patient's welfare or the best interests of the hospital may be adversely affected, the HOSPITAL may take immediate corrective actions which could include removal of the student from the facility. H. The Hospital shall provide the following, as available: 1. space or facilities for conference and classroom areas for the teaching of students; 2. audiovisual for clinical conferences; 3. lounge and locker space; 4. While in use of the HOSPITAL, students will have the status of trainees library and are not to replace HOSPITAL staff, and are not to render patient care and/or service except as identified for educational value and delineated in the jointly planned educational program.reference materials; 5. Emergency outpatient treatment orientation to the Hospital, including its policies, procedures, rules and regulations. I. The Hospital shall provide access at reasonable times and with reasonable advance notice to representatives of the School and to representatives of the School’s accrediting bodies. J. Hospital will not assign students in any way which would require the student to do work which would otherwise be performed by employees of the Hospital. K. Hospital understands and agrees that student educational records belong to School, that the confidentiality of all such records are protected by federal statute, and that no records will be released except in accordance with federal law. L. The Hospital shall insure itself and its employees through a fiscally sound program of self- insurance or commercial insurance or a combination thereof, for professional and general liability. M. Hospital understands and agrees that information embodied in education records is protected from disclosure pursuant to the Federal Family education and privacy Rights Act (FERPA), 20 U.S.C. Section 1232 (g) and agree to abide by its provisions. N. Hospital will protect student confidential information and education records from disclosure agrees to abide by all applicable law, including but not limited to, the Federal Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232 (g), and the Health Insurance Portability and Accountability Act (HIPAA), Codified at 42 U.S.C. § 300gg and 29 U.S.C § 1181 et seq. and 42 USC 1320d et seq. Agency further agrees to be liable for, and report any breach of such confidential student information or educational records to the College within five (5) days of determining such a breach. O. Hospital shall develop, implement, maintain and use appropriate administrative, technical and physical security measures to preserve the confidentiality, integrity and availability of all electronically maintained or transmitted student education records received from, or on behalf of School or its students. The procedures will be documented and available for School to students while review upon request. Upon termination, cancellation, expiration or other conclusion of the Agreement, Agency shall securely store or destroy student education records in the HOSPITAL for clinical training in case of accident or illness. That person shall be called the Clinical Education SupervisorHospital, and shall maintain contact inform the student of the requirement to provide the Hospital with the UNIVERSITY designated liaison person to assure mutual participation in individual's immunity history for varicella, pertussis, and surveillance of the Clinical Education Program. 7. HOSPITAL shall notify UNIVERSITY in writing of any change or proposed change of the Clinical Education Supervisor. 8. HOSPITAL shall provide a planned supervised program of clinical experience as specified hepatitis B. If previous rubella vaccine is not in the most recent outline of its Clinical Education Program supplied in writing at regular intervals to the UNIVERSITY. 9. HOSPITAL shall, on reasonable request, permit the inspection of its clinical facilities, services available for clinical experiences, student recordshistory, and such other items pertaining to the Clinical Education Program by representatives of the UNIVERSITY or agenciestiter is negative, or bothrubella vaccine is required, charged with the responsibility for approval of the facilities or accreditation of the curriculumexcept when medically contraindicated. 10. HOSPITAL shall, at the commencement of a student's placement, provide the student a thorough orientation of the HOSPITAL's administrative policies, standards, and practice relevant to the clinical placement. HOSPITAL RESPONSIBILITIES. A. HOSPITAL shall comply with all emergency medical services policies and procedures. Hospital will actively participate in the development of such policies and procedures through appropriate committee activities. B. HOSPITAL shall maintain a Continuous Quality/Performance Improvement plan with a pre-hospital emergency medical services component that will include but not be limited to: 1. Prospective activities related to education/orientation of hospital employees and ED physicians; authorization/licensing activities; methods for evaluation of performance, remediation or problem-solving activities; and participation in county-wide system activities. 2. Concurrent activities related to evaluation of patient care through observation, the provision of quality on-line medical direction/consultation, and inter- agency communication. 3. Retrospective activities related to analysis and improvement of patient care as appropriate. C. HOSPITAL shall submit Continuous Quality/Performance Improvement plan for approval to the EMS agency upon contract status in effect. Approval shall not be unreasonably withheld. Thereafter, any significant changes in the plan should be submitted and approved by the EMS agency. D. HOSPITAL shall assure that one HOSPITAL ED Physician determined to be qualified by HOSPITAL is available in HOSPITAL’S Emergency Department at all times for the purpose of providing on-line medical direction when requested to do so by prehospital emergency medical services personnel providing patient care according to Marin County EMS Policies and Procedures. HOSPITAL agrees to make assure that only personnel authorized to do so (*i.e. emergency department physician) shall provide medical consultation services to Paramedics. E. HOSPITAL shall assure that one HOSPITAL staff determined to be qualified by HOSPITAL is available in HOSPITAL’s ED at all times for the appropriate facilities available purpose of communicating with pre-hospital personnel. F. HOSPITAL shall designate a Pre-Hospital Physician Liaison who, in collaboration with the ED Manager, shall be HOSPITAL’s agent for operational issues related to UNIVERSITY this agreement. G. HOSPITAL shall identify a Pre-Hospital Liaison Nurse (PLN) to work in order to collaboration with the Pre-Hospital Physician Liaison. H. HOSPITAL will provide supervised clinical experience to students in the program. Such facilities shall include an environment conducive a designated space within or adjacent to the learning process emergency department for use by EMS personnel to complete required transport documentation. HOSPITAL will develop and maintain a patient's welfare or competency-based training program for the best interests orientation of the hospital may be adversely affected, the HOSPITAL may take immediate corrective actions which could include removal new ED personnel and require annual reassessment of the student from the facilityincumbent ED personnel. The UNIVERSITY will competency training program shall include but not be immediately notified of the action taken. The HOSPITAL understands that the UNIVERSITY, as a public agency, must provide procedural due process for its studentsuse of equipment used in communication with pre-hospital personnel; 2. Knowledge and understanding of COUNTY EMS protocols; and 3. Knowledge and understanding of COUNTY EMS documentation requirements. 4. While Knowledge and use of the Reddinet System to report and manage hospital, patient, and emergency event status. K. HOSPITAL shall submit such competency training program to the COUNTY EMS Program for approval; approval shall not be unreasonably withheld. Thereafter, significant program changes should be communicated. L. HOSPITAL shall provide for the collection of data and statistics specific to pre- hospital care, as prescribed by pertinent California Health and Safety Code, Title 22, and EMS agency policy. M. HOSPITAL shall provide representation to the COUNTY EMS Committees according to the Bylaws of those committees. N. HOSPITAL shall participate in Multicasualty Incident and Disaster Exercises/Drills, as well as actual incidents, according to policies and procedures established by the Marin County Office of Emergency Services. O. HOSPITAL shall maintain and keep in good repair a base station radio system and direct telephone line to COUNTY Communication Center and participate in regular tests of both. P. HOSPITAL shall maintain a dedicated unlisted telephone number answered only in the HOSPITAL, students will have the status of trainees and are not to replace HOSPITAL staff, and are not to render patient care and/or service except as identified for educational value and delineated in the jointly planned educational programEmergency Department. 5. Emergency outpatient treatment will be available Q. HOSPITAL shall promptly respond to students while in all pertinent status and/or bed polls as requested by the Medical Health Operational Area Coordinator (MHOAC). R.
