Improvement of Property. Developer shall promptly design and complete the Project. Substantial work on the Project shall commence no later than ninety (90) days after the last to occur of approval by the City and RDA of the Preliminary Concept Plan, approval by RDA of the Development Budget and Development Plans, and/or issuance of a building permit and all other permits or licenses required to commence construction, which shall be no later than April 1, 2022. Construction shall be completed no later than July 1, 2023. Developer shall file with the RDA copies of the detailed construction plans within ninety (90) days after completion of the Project.

Improvement of Property. Xxxxx has agreed to improve, develop and use the Property (the "Development Plan") as specified in a certain Property Purchase Application submitted by the Buyer to the Seller dated attached hereto and made a part hereof as Exhibit A (the "Application"). Seller's obligations under this Contract are subject to Buyer executing and delivering at Closing a Development Enforcement Mortgage in form acceptable to Seller, in its sole but reasonable discretion, to ensure Buyer fulfills the Development Plan. In addition to any Purchase Price financing contingency set forth above, Seller's obligations under this Contract are subject to Buyer providing Seller with reasonable satisfactory proof of Buyer’s financial ability to complete the Development Plan. Such reasonable satisfactory proof may be in the form of a construction mortgage loan commitment upon such terms and conditions as are acceptable to Buyer or such other written proof of financial ability to complete the Development Plan as Seller deems acceptable in its sole but reasonable discretion. Buyer shall provide such evidence of financial ability to complete the Development Plan within days of acceptance of this Contract by Seller or Seller may cancel this Contract at Seller's option by written notice as provided for herein at which time this Contract will be terminated and the Deposit shall be returned to Buyer.

Substantial work on the Project shall commence no later than ninety (90) days after the last to occur of (i) approval of the Preliminary Concept Plan by the City, (ii) approval of the Development Budget by the City, (iii) approval of Development Plans by the City, (iv) issuance of a building permit and all other permits or licenses required to commence construction, (v) the closing of the sale of the Property from the City to Developer, (vii) the City’s completion of all required items set forth in Recital K herein, which shall be no later than December 31, 2022. Construction shall be completed no later than December 31, 2024, as may be extended. Notwithstanding the foregoing, the foregoing date (December 31, 2024) may be adjusted, and shall be extended, if and to the extent that Developer’s substantial completion of the Private Improvements is delayed by the City, force majeure events, the unavailability to the project of construction materials and/or labor, or any other events(s) not reasonably within Developer’s direct control. Developer shall file with the City copies of the detailed construction plans within ninety (90) days after completion of the Project.
Improvement of Property. Developer shall promptly design and substantially complete Building One of the Project by December May December 31, 20232024, and thereafter design and complete Building Two by December May 31, 20252026. Substantial work on the Project shall commence no later than ninety (90) days after the last to occur of approval by the City and RDA of the Preliminary Concept Plan, approval by RDA of the Development Budget and Development Plans, transfer of the Property as described in Section IV.H. and/or issuance of a building permit and all other permits or licenses required to commence construction, provided the Public Improvements described in Section III.B.2. are substantially completed by the City by the dates set forth herein. Developer shall file with the RDA copies of the detailed construction plans within ninety (90) days after the Completion Date.

Improvement of Property. City agrees to reimburse the Board for the full cost of improving the JUA with a fully functioning multi-lane swimming pool suitable for public high school swim meets, as well as other appropriate supporting improvements (collectively, “Improved JUA”). The exact plans, dimensions, and other details of the pool and other improvements shall be agreed upon by the City’s Manager and the Board’s Superintendent, or their respective designees, no later than 150 calendar days after the Effective Date, unless extended by mutual agreement of the parties, and in no case shall exceed a total cost of $ .00. The City shall remit payment for invoices within forty-five (45) days of receipt unless the City’s Manager and the Board’s Superintendent, or their respective designees, agree to a separate payment schedule whereby the City will submit reimbursement to the Board over the course of time, not to exceed three (3) fiscal years, wherein the City shall remit the first one-third (1/3) of the total cost no later than September 30, 2017, the second one-third (1/3) of the total cost no later than September 30, 2018, and the final one-third (1/3) of the total cost no later than September 30, 2019. The improvements to the JUA shall be deemed completed upon the Board’s receipt of an unrestricted Certificate of Occupancy issued by the applicable authority.
