Investigation and Determination. The E/A will promptly investigate any alleged differing conditions as to the structure (but not as to the Site or subsurface conditions) and provide a written report of its findings to the OWNER. If the OWNER finds that the conditions of the structure differ materially and require a change in the Work and cause an increase or decrease in CONTRACTOR’s cost of, or time required for, performance of any part of the Work, the OWNER may make an adjustment in the amount payable to CONTRACTOR or the Contract Time, as applicable. If the OWNER determines that the conditions of the structure are not materially different or that no change in the terms of the Contract is justified, the OWNER will so notify CONTRACTOR in writing.

Investigation and Determination. If Contractor notifies Owner that it has reason to believe that it has encountered Asbestos or Asbestos containing material or lead paint, Owner will investigate the material and determine whether Asbestos or lead is present. Owner shall thereupon notify Contractor of its determination. If Asbestos or lead paint is not present, Contractor shall immediately resume any of its operations that have been stopped.
Investigation and Determination. Contractor will notify Company if Contractor has reason to believe that it has encountered Company’s Hazardous Substances, Company will investigate the material and determine whether Hazardous Substances requiring removal or abatement exist. If Company’s Hazardous Substances requiring removal or abatement are not present, Contractor shall immediately resume any of its operations that have been stopped.
Investigation and Determination. This is a formal process and an Accident and Incident Report form with any relevant attachments setting out the allegations must be completed. The request for investigation must be supported by a completed Accident and Incident Report form setting out the allegations with supporting documentation. A description of the alleged discrimination and whether it is based on race, sex, color, age, sexual orientation, national origin, disability, religion, or veteran status. Explanation of why the event(s) appear to be discriminatory. Specify The Regional Manager will review the allegations and supporting documentation and make a recommendation to proceed with an investigation if appropriate. The Manager will coordinate the investigation and will consult with all parties involved and advise of the process to be undertaken. A trained investigator will conduct the investigation. All allegations contained in the Accident and Incident Report form will be investigated. The person alleged to have committed the act of discrimination, will be given an opportunity to respond to the allegations. Participation in the investigation is strongly recommended for all parties. The investigation will determine if there is evidence of a breach of this policy The investigator will provide a confidential report to the Regional Manager. The Regional Manager will confirm the required actions to be undertaken to cease any further contravention of the EEO policy and report to the CEO when required. The outcomes of the investigation and required actions will be communicated in writing to all parties in a timely manner During all stages of these procedures, confidentiality will be maintained as far as possible, and all parties involved in the process will have access to support services.

  • Decisions and Determinations Any determination, decision or election that may be made by the Issuer pursuant to this Section 3.19(c) (or pursuant to any capitalized term used in this Section 3.19(c) or in any such capitalized term), including any determination with respect to a tenor, rate or adjustment or of the occurrence or non-occurrence of an event, circumstance or date and any decision to take or refrain from taking any action or any selection, will be conclusive and binding absent manifest error, may be made in the Issuer's sole discretion, and, notwithstanding anything to the contrary in the Transaction Documents, will become effective without consent from any other party. The Administrative Agent, each Issuing Bank and each Lender, as the case may be, agrees to furnish to the Borrower (and in the case of any Issuing Bank or a Lender to the Administrative Agent as well) a certificate setting forth the basis and amount of each request for compensation under this Section. Determinations by the Administrative Agent, such Issuing Bank or such Lender, as the case may be, of the effect of any Regulatory Change shall be conclusive and binding for all purposes, absent manifest error. The Borrower shall pay the Administrative Agent, any such Issuing Bank and or any such Lender, as the case may be, the amount shown as due on any such certificate within ten (10) days after receipt thereof.
