It is the intent of the Parties, however, that subject to the requirements of the department and when bargaining unit employees in the department capable of performing the work are available, such vacancies will be filled by means of internal promotion from within the department in accordance with Article 7.10(d). Selections made under this provision will only be grievable by other members of the department from which the selection was made.
(b) The job posting shall contain all pertinent details, such as job title, date of job description, rate of pay, (where not established will be subject to negotiations), replacement or addition to staff or new position, number of positions, duties, qualifications, headquarters, job location, special conditions, and the closing date of the competition.
(c) The Company will provide the Union with copies of all job postings, the list of all applicants and their seniority dates and a list of successful applicants, upon request to the Labour Relations Director or designate. The Company shall acknowledge receipt of each application for a posted job vacancy and the applicants in each competition shall be advised of the name of the applicant selected to fill the Company job vacancy under CUPE jurisdiction. A late applicant shall be considered for a posted job provided the employee was absent from work due to sickness or vacation or away from established headquarters on the Company's business at the time the job was posted, and provided the application is received before another person is selected to fill the vacant position. An employee who is absent due from work on an approved leave of absence, vacation/lieu time, sick leave or WorkSafeBC may, prior to sickness or illnessduring such absence, submit an application for consideration on a specific job posting(s). The Such applicant must be available for interview within seven (7) calendar days of the closing date of the posting and if successful must be available to assume the position within fourteen (14) calendar days of the offer. Applications submitted in the foregoing manner shall be considered as null and void when the employee returns to work.
(d) Job selections and promotions under the foregoing shall be on the basis of ability (to perform the vacant job) and seniority in that order. Ability shall mean that an applicant has the formal education, skill, special training and experience required in the applicable job description and posting prepared by the Company or the equivalent knowledge and skill, and shall also include consideration of the employee's performance on the present job. Where an employee who is absent due junior in seniority is selected, their ability to illness or disability willperform the vacant job must be significantly and demonstrably higher than candidates who have greater seniority. When assessing an employee's performance on their present job the Company will not consider any inadequacies that have not been brought to the employee's attention.
(e) Although selection of employees under the foregoing paragraphs shall rest with the Company such selection shall be subject to the grievance procedure.
(f) Where an employee has been selected to fill another position, upon recovery, be entitled to return to his prior position provided he is capable of performing the normal requirements supervisor concerned shall release the employee as expeditiously as possible after being notified of the transfer by the Labour Relations Director or designate. Notwithstanding the above, if after six (6) weeks from date of notification the employee has not moved to the new job because of a delay ascribable to the Company, the employee will be paid the rate of the new position. The It is understood that any delays will not disadvantage an employee who assumed the position pursuant with respect to the temporary posting shall also be returned to his former position. JOB POSTING. 4.1 When a job becomes vacant, it shall be posted for ten (10) working days. The Building Principal will arrange an interview each finalist and upon completion of the interview process, the Building Principal will recommend a finalist to the Business Administrator. The Business Administrator will make a recommendation to the Superintendent of Schools. In filling of vacancies and vacancies, the Committee shall consider the seniority of new positions for which the wage rate is above respective candidates.
4.2 In the Unit G category respecting regular jobs in event only one employee bids on a vacant position, he/she may be appointed to the bargaining unit, shall be governed by seniority subject to position only if he/she meets the requirements of competence and fitnessthe civil service specification for the vacant job title. The employee appointed to the vacant position shall be compensated at the assigned lateral rate of pay as provided (see Appendix A), and shall serve a probationary period of the efficient operation of the elevator. The Apprenticeship Training Program wage rate shall be deemed to be above the Unit G category. When vacancies and new positions occur, the Company will be required to post such vacancies and new positions immediately and designate the house to which it is anticipated that the employee will first report. The Company will post such vacancies and new positions for five thirty (530) working days on a bulletin board provided the new job, at the end of which time the Superintendent or his/her designee may cause the employee’s reassignment to his/her former job and pay rate if the Superintendent or his/her designee finds that his/her performance is unacceptable. The unsuccessful senior candidate will be notified in writing, on request, the elevator in which they occur reasons for his/her non-selection.
4.3 At any time during, or at the completion of, said probationary period the appointed employee may elect to return to his/her former job and in any other elevator operated by the Company. During the said five (5) days any employee of the Company may make application for the vacant position but his classification will not be altered unless he is appointed to a new classification by virtue of his application. Posting will designate the occupational classification and hourly rate of pay without prejudice or penalty subject to the approval of the vacancy Superintendent of Schools or new position, and in the case of the Unit F category, the specific classificationhis/her designee. JOB POSTING. JOB POSTING. All vacancies shall be posted as outlined below. Employees are not entitled to bid for openings within their own classification or lower classification; however, they may request, in writing, to be considered for transfer to such an opening within their job classification. Job classifications are indicated in Article XXVIII, SALARIES AND DIFFERENTIAL PAY, under WAGES. Transfers will be made upon recommendation of the appropriate Director and are subject to approval of the building Principal and the Superintendent of Schools. The filling following procedure shall pertain to promotional positions within each of vacancies the four groups (Cafeteria, Custodians, Head Custodians, and Skilled Craftsman): Whenever a vacancy in a promotional position in another job classification within one of new positions for the four groups covered by this agreement occurs, and it is determined that it shall be filled by appointment, the following procedures shall be followed:
1. Notice of such vacancy shall be provided by email to the Association President and all members within the applicable groups listing the job title, location, and closing date of the posting. The posting shall state the date by which the wage rate Committee expects to fill the position. A printed copy will also be provided to previously identified stewards of each bargaining unit. If the District decides not to fill the position (or shall delay posting a vacant position more than 14 days), the Association shall be notified as well.
2. This notice of vacancy shall remain posted for ten (10) working days.
3. Employees who are interested in a particular promotional vacancy will apply in writing and submit a new and complete application form for the position within the ten (10) day period.
4. Within a reasonable period of time to allow for reviewing of applications, the appropriate Director or the building Principal will notify the Superintendent's office which applicant is above being recommended for appointment. The appropriate Director or building Principal will consider, but not be limited to, the Unit G category respecting regular jobs following in determining the recommended applicant: seniority, attendance, prior disciplinary action within the previous two years, written performance evaluations of supervisors, prior experience, experience within the position sought, skill, ability, other qualifications and training, availability for an extended workday or work week in overtime, and if interviews are to be conducted then they shall be conducted for all candidates and conducted in the same format with the same basic questions (which process shall not prohibit spontaneous questions or dialogue) with same notice to content of interviews, and recommendations from immediate supervisor. 5. The successful applicant, if from within the bargaining unit, shall be governed by seniority subject to the requirements of competence and fitness, and of the efficient operation of the elevator. When vacancies and new positions occur, the Company will be required to post such vacancies and new positions immediately and designate the house to which it is anticipated that the employee will first report. JOB POSTING. JOB POSTING. 12.01 The filling Employer agrees that in the case of vacancies a vacancy occurring, a notice will be posted on the plant bulletin board describing the vacancy and the Employer will receive applications from employees on the seniority list for the position that is open, such notices to remain on the bulletin board for three (3) working days.
12.02 Within twenty-four (24) hours following the posting period, a selection shall be made with due notification to the Shop Chairman. Selection shall be made on the basis of new positions a combination of seniority and skill and ability. Where skill and ability are equal, seniority shall govern.
(a) When the applicant is accepted for which the permanent job opening, he will be given a period of not less than five (5) and not more than twenty (20) working days to demonstrate his ability to perform the normal requirements of the job in a competent manner with reasonable supervision and assistance. The Employer reserves the right to return the employee to his former job classification and wage rate at any time during this period, if the employee’s services are not satisfactory, without prejudice and without loss of seniority, and the employee has the right to return to his former job classification and wage rate during this period. Under such circumstances, the Employer will make another selection from the list of applicants in accordance with Article 12.
(b) The Employer shall post the successful applicant of each job posting.
12.04 It is above recognized that the Unit G category respecting Employer has the right to fill the position on a temporary basis until the vacancy is filled.
12.05 Any employee who has successfully bid under this Article shall not be entitled to bid on a posted job for six (6) months from the date of his successful bid, except with the Employer’s permission.
(a) An employee temporarily transferred, at the direction of the Company, to a classification other than his regular jobs in the bargaining unitclassification, shall be governed by seniority subject to paid his regular base hourly rate of pay or the requirements of competence and fitness, and rate of the efficient operation job to which he is transferred, whichever is higher.
(b) A transfer shall be considered temporary, provided it does not exceed sixty (60) working days. If such transfer exceeds this period, it will be declared as a temporary vacancy and posted for job bidding. This clause has no application to modified work situations.
(c) A vacancy created as a result of illness, injury or leave of absence, shall not be posted and may be filled at the discretion of the elevatorCompany, except if the Company has been formally advised that the employee will be absent for more than sixty (60) working days. The Apprenticeship Training Program wage rate shall be deemed to be above the Unit G category. When vacancies and new positions occurIn such case, the Company will be required post the position as a temporary vacancy and will use the same criteria to post such vacancies and new positions immediately and designate fill it under the house to which it is anticipated that job posting provisions of the employee will first reportcollective agreement. The Company will post such vacancies successful applicant shall not transfer his seniority to the new classification; and new positions for five (5) working days on a bulletin board provided in he shall be returned to his former classification upon the elevator in which they occur and in any other elevator operated by the Company. JOB POSTING. The filling An application for transfer system will be established by the Employer under which any employee be able to out an appropriate form indicating his interest in within the bargaining unit elsewhere in the Hospital and his shall be given consideration when a vacancy occurs. An employee who accepts a position the same classification within the bargaining unit shall be entitled to a trial period in the new position of (30) days and if at the expiration of that period he is capable of performing found by the normal requirements of Employer to be unsuitable or if the employee does not wish to continue in the new position. JOB POSTING. c) Testing will be reviewed and agreed by both the Company and the Union.
13.02 Probationary employees shall not be eligible to bid for jobs during their probationary period. However, this in no way restricts the Company from utilizing them on jobs to see where they can be fitted in as employees.
(a) A successful applicant will be given training for a period of up to twenty-five (25) continuous working days. This training period may be extended and or temporarily suspended with the mutual agreement of the parties. In addition, after the first five (5) days of training, if the Company feels the employee is qualified to perform the work, it shall notify the employee.
(b) It is understood that management may disqualify an employee during this training period if the ability and physical capabilities to perform the job have not been demonstrated. Management shall give reason or reasons for such disqualification in writing. An employee has the right to dispute this decision under the terms of this Collective Agreement. An employee transferred to the new job shall, with reasonable training, demonstrate their ability to perform satisfactorily in a new position for a period of up to ten (10) working days. The Company's obligation in this regard is limited performance review shall be conducted prior to granting the opportunity to demonstrate the ability end of job performance to one employee only for each job posting. In the event of more than one demand for an opportunity to demonstrate, only the demand made by the employee designated by the Union will be granted. No employee shall attempt to withdraw his application for the position after he has commenced the trial period. 13.04 Temporary work assignments of thirty-six (36) working days or less shall post be filled at the vacancy in all terminals Company’s discretion unless there is a designated back-up on that shift.
13.05 In the event a temporary basis. In these casesjob posting is cancelled, the Company company will inform the union, in writing, the reason for the cancellation.
13.06 Any employee who, performs his back-up classification for which the rate of pay is different from that in effect for such employee’s regular job shall state be paid for all hours worked as the back-up on that shift, as follows;
(a) If the rate of pay for the job posting that to which he is transferred is less than the position employee’s regular pay, he shall receive his own higher rate of pay.
(b) If the rate of pay for the job to which he is transferred is higher than the employee’s regular pay, he shall receive the higher rate of pay for the job to be filled on a temporary basis and that the posting will expire either upon the return to work or termination of employment of the which he is temporarily transferred.
13.07 Any employee who is absent due temporarily transferred to sickness or illness. 13.08 The classifications generally affected by temporary back-up transfer (non- production-indirect labour classifications) shall have employees on each shift available to replace any regular classified employee not available for work on any given shift. These relief employees shall be selected under the terms of the positionJob Posting article. An employee may hold a back-up position in one (1) classification only.
13.09 The Company will maintain and post a list of back-ups.
13.10 In the event an employee who assumed voluntarily wants to remove themselves from their classification they must give the position pursuant Company 2 weeks notice and stay in the classification until a suitable employee can be trained. This employee will go to the temporary posting shall also be returned to his former position. D. It is the work intention of the Union and the City of Livingston to clarify a training period for transfers/promotions which occur after the initial probationary period for employment has been satisfied.

If a full-time employee bids to a position within any department, he will serve a training period up to which he wishes to be transferred, for a maximum period of five (5) working days during which he will be given the information and supervision normally given an employee who is transferred to or hired for the job in question. An applicant who fails to qualify for the position after a trial must be given reason or reasons for such disqualification in writing. The Company's obligation in this regard is limited to granting the opportunity to demonstrate the ability of job performance to one employee only for each job posting. 3. If there is differential pay for the position, upon completion of the training period, the Company employee shall post receive the vacancy in all terminals on a temporary basisdifferential pay retroactive to the date of awarding the position.
4. In these casesIf an employee has satisfactorily filled the position according to paragraph two above, he shall receive the wage of whatever classification is being filled upon date of change.
5. If, during his training period, the Company "permanent" employee does not qualify for the position, he shall state on be able to then bump into his old position.
6. If an employee is transferred to a position which is the job posting that same wage or less, he/she shall retain his/her same salary. If he/she is transferred to another department, he/she shall receive the salary reflected by the position entered.

JOB POSTING. JOB POSTING. When vacancies and new positions occurbargaining unit, the Company will be required to post such vacancies and new positions immediately and designate the house to which it is anticipated that the employee will first report. The Company Employer will post such vacancies and new positions for five (5) working days on a bulletin board provided in the elevator in which they occur and in any other elevator operated by the Company. During the said five (5) days any employee of the Company may make application for the vacant position but his classification will not be altered unless he is appointed to a new classification by virtue of his application. Posting will designate the occupational classification and rate of pay notice of the vacancy for a period of five working days in all schools and maintenance shops covered by the Collective Agreement. The notice will specify the nature of the job, the shift, qualifications required and the rate of pay. An employee who wishes to be considered for the position so posted shall signify his/her desire by making formal application in accordance with the provisions of the posting. In filling any posted vacancy under this Article, the Employer will consider the requirements and efficiency of operations, the knowledge, training, skill and ability of the individual to perform the normal required work and, where these are relatively equal, seniority shall govern. If the job is not filled as a result of the posting, or new if no suitable applications are received, the Employer reserves the right to hire. Applications of bargaining unit employees will be processed before the vacancy is advertised externally. Where a trade certificate is required for the position the Employer may post and advertise the position simultaneously. Where the Employer is aware that the incumbent in a position requiring a trade certificate is retiring, the normal posting procedure shall be followed. JOB POSTING. Except in cases of emergency, the Town shall advertise any vacancy covered by the terms of this Agreement. Such notice will be posted next to department time clocks at the D.P.W. and on bulletin boards in the following areas: Town Hall, School department, Fire department and the Library for at least ten (l0) consecutive calendar days. The filling bulletin shall state: the title of the position, salary, location (department), special qualifications required, whether temporary or permanent, and the last date of application for the position. Qualified Town employees are encouraged to apply to the appropriate department to fill a job vacancy. Job vacancies and may also be advertised in newspapers or professional publications, or may be advertised using other methods to find appropriate applicants. Use of new positions for which a good outreach paper is required if the wage rate position is above advertised. Each external applicant must complete a job application. In cases where the event a transferred employee informs the Company within ten working days from the effective date of his appointment, that he wishes to return to his former job, he shall be returned to that job within two weeks of his request. JOB POSTING. (a) When a vacancy occurs in any job which is likely to remain open for over thirty (30) days (or such longer period as the parties may mutually agree) notice of such vacancy shall be posted within eighteen (18) working days of the vacancy arising and shall remain posted for eight (8) working days on the bulletin board or boards provided on the premises for that purpose. The filling Company shall provide the Union with a copy of each vacancy posted and the names of the applicants for such vacancy. JOB POSTING. The filling (a) A regular employee who is a member of vacancies the Union and already on the staff of new positions for a department in which a vacancy occurs may be promoted to such vacancy without that vacancy being posted on company bulletin boards.
(b) Subject to Article 7.12, if a promotion is not made within a department, then the wage rate is above the Unit G category respecting regular jobs in the bargaining unit, vacant position shall be governed posted on company bulletin boards for a minimum of 5 working days in order to give employees an opportunity to apply for it. The job posting shall contain all pertinent details such as job title, date of job description, salary range or rate of pay, job group, replacement or addition to staff or new position, duties, qualifications, headquarters, job location, special conditions, and the closing date of the competition. A job posting for a temporary job must also state the anticipated end date for the temporary job.
(c) The Employer shall acknowledge receipt of each application for a bulletined job vacancy and the applicants in each competition shall be advised of the name of the employee selected to fill the vacancy. A late applicant shall be considered for a bulletined job provided the employee was absent from work due to sickness or vacation or away from established headquarters on company business at the time the job was bulletined, and provided his/her application is received before another person is selected to fill the vacant position.
(d) Job selections and promotions under the foregoing shall be on the basis of ability (to perform the vacant job) and seniority, in that order. Where the employee who is junior is selected, his/her ability to perform the vacant job shall be significantly and demonstrably higher than candidates who have greater seniority.
(e) Ability shall include consideration of the employee's performance on the employee's present job.
(f) Confidential employees on the Employer's regular staff may also apply for jobs covered by seniority this Agreement but in such instance preference shall be given to members of Local 378 in accordance with this clause.
(g) Although selection of employees under the foregoing paragraphs shall rest with the Employer, such selection shall be subject to the requirements grievance procedure. The Employer shall ensure that in the exercise of competence and fitnessits job selection rights under this article that no discrimination or favoritism affects any particular applicant for a job posting. It is agreed that the selection criteria for each job with more than 20 incumbents shall be the same, and subject to specific emphasis of the efficient operation job duties of each position. JOB POSTING. (a) All job openings and vacancies shall be posted by the Company on the plant bulletin board for a period of two (2) regular working days. The filling senior qualified bidder shall fill the vacancy. Thereafter the opening or vacancy created by the successful bidder shall be posted on the plant bulletin board for a period of vacancies two (2) regular working days. The senior qualified bidder shall fill the vacancy.
(b) Thereafter the opening or vacancy which remains may be filled by any new hire by the Company and this completes the cycle of the job opening or vacancy.
(c) The Company’s selection of the successful bidder will be based upon experience and ability to do the work required and the employee having the highest seniority will fill the vacancy.
12.02 In determining the experience and ability of any employee selected to do the required work, the Company shall give such employee a reasonable opportunity of from one (1) working day to not more than ten (10) working days to prove that such employee can perform the required work in the manner prescribed by the Company quality and quantity considered. During such trial period, the employee shall be paid one-half (1/2) the difference between the job left and the new positions for which job. During such trial period, the successful bidder who bid down or laterally to fill a vacancy shall be paid the wage rate is above for the Unit G category respecting regular jobs in bidden job. During such trial period normal instructions on how to proceed with the bargaining unit, shall work to be governed by seniority subject performed will be given to the requirements of competence and fitness, and of the efficient operation of the elevator. During the said five (5) days The Company shall in no way be obligated to keep any employee on a job during such trial period whose work results in the scrappage of any substantial amount of material or damage to any machinery or equipment, or whose work adversely affects the Company’s production requirements. Should the employee be disqualified during such trial period, such employee will return to the job from which he were transferred with no impairment in their seniority. The vacancy will again be posted.
12.03 In the event that there are no bids for job openings from employees with seniority, then the Company may make application for either promote probationary employees or hire new ones.

In cases where absence due to sickness or injury might reasonably be anticipated to exceed six (6) months and the Company requires that the position be filled, the Company shall post the vacancy in all terminals on a temporary basis.
