Notices of any vacancy within the scope of the bargaining unit which the Employer determines will be filled with the position’s existing number of hours and shifts, and which is expected to exceed sixty (60) calendar days, will be posted. Such notice shall remain posted for seven (7) consecutive calendar days and shall indicate the type of position (full- time, part-time, permanent, temporary) an outline of the duties and responsibilities, the starting date (and ending date if applicable) and the qualifications required. b. Should there be, in the judgment of the Employer, which shall not be exercised unreasonably, no qualified applicants who have completed their probationary period, consideration may be given to probationary employees. Where there are no qualified probationary employees interested in the vacancy and able to perform the required work without training, the Employer shall hire from outside. e. In filling the vacancy, the Employer shall give preference to the applicant most suited in terms of skill, ability, and relevant qualifications. Where two (2) or more applicants are relatively equal in the opinion of the Employer, seniority shall be the determining factor. f. Employees must complete the temporary assignment or be in the temporary assignment for a period of six (6) months or more before accepting a different temporary assignment. g. Vacancies of less than sixty (60) days will be scheduled in accordance with the Collective Agreement. 7.02 Either party shall have the right to propose changes to this procedure through discussion at the Labour Management Committee. Where the parties agree to the changes in the procedure, the procedure shall be modified.

JOB POSTINGS AND VACANCIES. a. Notices 12.01 In all cases of any vacancies, whether new positions, transfers or promotions in the bargaining unit, the following factors shall be considered: (a) ability, experience and performance; (b) seniority Where the qualifications of factor (a) are relatively equal, in the opinion of the Corporation, factor (b) shall govern. Should a successful candidate to any posting vacate the position within eight (8) weeks of the end appointment date, the Corporation shall have the option of revisiting the posting file prior to reposting. (b) Copies of all postings shall be sent to the Association. If no qualified nurse applies, the Corporation may then hire a new nurse. (c) The name(s) of the posting period, unless successful applicant(s) shall be posted electronically by the Employer has given Corporation on a monthly basis capturing all successful applicants from within the Union notice that it intends to postpone filling or decides to not fill previous calendar month. The Association shall be informed in writing of the vacancysuccessful applicant(s). d. When filling (d) Successful candidates shall commence their duties within thirty (30) calendar days of the date of acceptance of the position. (e) Bargaining Unit Nurses shall be given first opportunity to fill temporary vacancies. Vacancies expected to last three or more months shall be posted in accordance with Article 12.03 (a). The Corporation will outline to the nurse selected to fill a posted temporary vacancy, the Employer shall give preference to applicants who have completed their probationary period conditions and whoduration of such vacancy. JOB POSTINGS AND VACANCIES. a. Notices 15.01 In the event that a new job is created or a vacancy occurs, the Employer will post all such original vacancies for a period of any vacancy within five (5) days, excluding Saturdays, Sundays and Paid Holidays, before a new employee is hired, to allow other employees to apply. The Employer will post temporary vacancies anticipated to exceed eight (8) weeks or longer. For information purposes only, the scope Employer will include the location, expected shifts to be worked, classification, department, starting date of position, status, qualifications required, and anticipated duration for a temporary position, in the original and the secondary posting, however, it is understood that this information is subject to change and provided for elsewhere in this Collective Agreement. In such a case the Employer shall fill the vacancy temporarily. 12.08 A vacancy created by a posting shall be subject to further postings until the vacant position is filled. 12.09 Until the vacancy is filled via the above manner, the Home may fill the position as it deems appropriate. 12.10 In the event the Employer requests an employee to be transferred to any of the below-mentioned positions, which are outside the bargaining unit, the employee shall have the right to propose changes to this procedure through discussion at refuse. The positions are: registered and graduate nurses, office and clerical staff, supervisors and persons above the Labour Management Committee. Where rank of supervisor, and the parties agree to the changes in the procedure, the procedure shall be modified“nursing home”.

In the event an employee returns, or is returned to her former position, the procedure employee will return without the loss of seniority or wages. 15.09 The Employer shall give notification to the employee and the Union within seven (7) calendar days of the date of appointment to a vacant position and the name of the successful applicant shall be modifiedposted on the bulletin board. Until a vacancy is filled by the above procedure the Employer may fill the vacancy as it deems appropriate from within the bargaining unit.

It is understood and agreed that the posting procedure applies only to the initial vacancy and the first subsequent vacancy, if any, arising from the initial posting. Any additional vacancies arising from the initial posting shall be offered to qualified employees on the basis of seniority. c. The Employer is free to temporary fill employee who successfully obtains a posted vacancy as the Employer sees fit and up to the time an appointment is made and the successful applicant occupies the position. The selection of the successful applicant, if any, shall be made within seven (7) calendar days of the end of the posting period, unless the Employer has given the Union notice that it intends to postpone filling or decides to not fill the vacancy. d. When filling a posted vacancy, the Employer shall give preference to applicants who have completed their probationary period and who, in the judgment of the Employer, which pos- ition shall not be exercised unreasonably, are qualified eligible to perform the required work without training. Should there be, in the judgment apply for another post- ing outside of the Employer, which shall not be exercised unreasonably, no qualified applicants who have completed their probationary period, consideration may be given to probationary employees. Where there are no qualified probationary employees interested in the vacancy and able to perform the required work without training, the Employer shall hire from outside. e. In filling the vacancy, the Employer shall give preference to the applicant most suited in terms of skill, ability, and relevant qualifications. Where two (2) or more applicants are relatively equal in the opinion of the Employer, seniority shall be the determining factor. f. Employees must complete the temporary assignment or be in the temporary assignment respective group for a period of six (6) months from the date he is awarded the new job. Employees who work in Milk Receiver, CIP and Process Blend positions eligibility to apply for a posted position outside of their respective group (Milk Receiver, CIP and Process Blend positions) shall be at twelve (12) months. The posting notice shall identify the department, job identification, shift, start time, classification, and will include start rate and end rate of the pos- ition. Anticipated weekly schedules will be includ- ed on the job posting with the understanding that schedules are subject to change due to needs of the business. The Company will fill the position, within four (4) weeks from the removal date specified on the in- itial posting. The Company will endeavor to post original vacancies as soon as possible, and no later than the following job posting cycle. Part time applicants will not be considered until after full time applicant the part time employee will be reclassified to full time. Lead Hands shall be selected or appointed at the Company’s sole dis- cretion but no employee shall be forced to accept a Lead Hand assignment. Skill, qualifications and experience of an em- ployee and their capacity to perform the required tasks of the job shall be the determining factor in selection of vacancies for the following classifica- tions in the Maintenance Mechanics, Electricians, Lab and Jockey or any other position where a Li- cense/Degree is required. Employees wishing to apply for a job posting must do so in writing on forms supplied by the Company and deposited in the secured job post- ing box. If an employee applies for more before accepting a different temporary assignmentthan one job at the same time, he must identify the order of preference. g. Vacancies 8.02 The first and second vacancy created by filling the original opening under the job posting pro- cedure shall be posted as soon as possible and no later than the following job posting cycle. Any subsequent vacancies in the chain caused by the filling of less than sixty the first three (603) days positions shall not be subject to the job posting procedure and may be filled at the Company’s discretion with a part time employee. It is understood the same posting pro- cedure set out in 8.01 and 8.02 will be scheduled followed for other permanent vacancies or new jobs in accordance with the Collective Agreementbargaining unit which the Company wishes to fill. 7.02 Either party shall have the right to propose changes to this procedure through discussion at the Labour Management Committee. Where the parties agree 8.03 A copy of each job posting and successful xxxxx- date will be provided to the changes Chairperson. 8.04 Where no candidate applies who meets the over- all criteria in 8.01, then the procedureCompany may fill the job by first recalling a laid-off employee who meets the overall criteria in 8.01, if one exists, or then hiring from outside. 8.05 In the event a grievance involving job posting succeeds, all employees who were involved as a result of the original posting and back up moves will revert to their jobs held immediately prior to the job posting in question. 8.06 An employee who is successful in obtaining a new job through the posting procedure shall be modified.trained for a reasonable time period and shall be on probation in the new job for a period of forty
