(ac) All vacanciesIn the event of long term vacancies in part-time positions, new positions the hours may be divided evenly amongst the classification and promotions either department or filled on a temporary basis. 15.02 When a vacancy occurs the Employer shall post a notice of such vacancy on the bulletin board, the posting will indicate full-time or part-time time, the classification and the required shift/shifts and the hourly rate of pay, as well as the minimum qualifications required. 15.03 When filling any vacancy, the Employer shall give preference to an applicant employee in the bargaining unit with the most seniority provided such employee has the ability and qualifications to perform the required work. a) A vacancy shall be posted by the Corporation electronically through the Corporation’s intranet and/or internet systems, for a period of seven (7) calendar days prior to making a permanent appointment to any such position in order that any interested nurse may apply. If such position (or positions are not to less by mutual agreement between the Employer and the Union and with written confirmation) and be posted by the Corporation, the Corporation will notify the Association in writing of this intent, including reasons for not posting, filled within fourteen seven (147) calendar days. Should Applicants shall notify the Association administrator or her designate in writing on forms supplied by the Employer within that time to be eligible. Except in cases when the normal operation of services might be affected, the successful applicant will be scheduled to the new position within seven (7) calendar days of the closing date of the posting. b) Notifications to the Union for extensions and/or early filling of job postings due to operational requirements will be communicated to the Union for agreement in these cases. a) The successful applicant shall be placed on trial in a new job classification for a period of one (1) month. Such job classification shall become permanent after the trial period unless the Employer feels that the employee is not suitable for the job classification and it is required that she return to her former job classification. If the employee involved feels that she is not suitable for the job classification, she may exercise her right to return to her former job classification within the one (1) month trial period. b) In the event an employee returns, or is returned, to her former position, the employee will return without any loss of seniority or salary. c) Upon completion of the trial period the position shall become permanent and the successful candidate shall lose all claim to her former position. d) The successful candidate shall be placed on the wage grid of the position she bid for in accordance with her seniority/hours of work. 15.06 Employees who are on vacation may indicate in advance their desire to apply for a posting if such a posting should occur during their vacation. In such a case the Employer shall fill the vacancy temporarily from within the bargaining unit. 15.07 Any vacancy created by a posting which is not filled from within the same classification will be posted. The vacancy created by a posting within the same classification will be available, on the request of an employee, within 14 calendar days of the vacancy, on the basis of seniority. 15.08 Until the vacancy is filled via the above manner, the Employer may fill the position as it deems appropriate from within the bargaining unit. In the event there are no successful applicants from within the bargaining unit, the Employer may hire from outside the facility. 15.09 No employee shall be transferred to meet a non-bargaining unit position without her consent. If any employee is transferred she shall retain her seniority and her right to discuss such notice, such meeting request return to the bargaining unit for a period of one month. If an employee return to the bargaining unit she shall be placed in a job comparable to her former position. Such return shall not result in the layoff or bumping of another employee. 15.10 If management exercises any rights referred to above in an inconsistent manner, recourse shall be unreasonably deniedhandled through the grievance procedure. 15.11 The Employer shall give notification to the employee and the Union within seven (7) calendar days of the date of appointment to a vacant position and the name of the successful applicant shall be posted on the bulletin board. If more than one qualified employee applies for such leave, seniority will prevail. It is understood that there will be no loss of seniority to any employee on a leave of absence for this purpose. 15.13 It shall be the duty of each employee to notify the Employer, the Pension Plan and the Union promptly of any change of address. Notice required by the Employer shall be deemed to be given, if forwarded to the employee at the last address of which the Employer had notice. 15.14 Employees’ work performance may be evaluated by the employee's supervisor or their designate. An employee will be given an opportunity to review the written evaluation and any other documentation pertaining to the evaluation and to correct any factual error(s). Prior to the evaluation document being filed, an employee may add their comments to the documents or on a separate page which will be considered part of the evaluation. The employee is to sign the evaluation document not for the purpose of indicating agreement, but for the purpose of indicating that she has read and understood the contents. Evaluation meetings will take place during the employees' working hours. 15.15 In the event that the Employer creates a new classification in the bargaining unit, the following factors parties shall be considered: (a) abilitynegotiate wage rates for such new classification(s). Save and except forced transfers, a nurse selected as the result of a posted temporary vacancy or a request to transfer which (s)he voluntarily accepted need not be considered for a further temporary vacancy during the term of the original temporary position. 12.02 A Nurse may advise the applicable Talent Acquisition Advisor in writing/email of her/his employment interest in a particular bargaining unit any vacant position should such a position become vacant during the Nurse’s vacation or approved leave period. Her/his letter of interest will be retained for the length of her/his vacation or leave period and considered by the Corporation in accordance with 12.01 should the bargaining unit position so referenced be posted during the same period. (a) All vacancies, new positions and promotions either full-time or part-time shall be posted by no later than five (5) calendar days from the Corporation electronically through date the Corporation’s intranet and/or internet systems, position becomes vacant for a period of seven (7) calendar days prior days, subject to making the Employer’s right to eliminate or modify the position. The information which shall appear on the posting is: o The job classification o A brief description of the job o The hours scheduled o The wage scale Copies of the posting and the results shall be maintained and will be available to the Business Representative and/or Xxxxxxx upon request. 12.02 Employees wishing to apply for a permanent appointment to any such posted position in order that any interested nurse may apply. If such position or positions are not to be posted must do so within the five (5) day posting period, using the form provided by the CorporationEmployer. The Employer shall determine the skills, abilities and qualifications required for the position. The Employer shall award the position on the basis of skill, ability and qualifications. In the event of relative equality, the Corporation senior applicant will notify be awarded the Association position. Only the full-time and part-time employees of the bargaining unit may apply to a posted vacancy. This shall be inclusive of employees on vacation, lay-off status or absent due to illness or injury. In order to ensure the continued smooth operation of the Employer’s business, employees wishing to apply for a posted position will only be considered if they have completed a minimum of three (3) months of continuous service in writing their current position. (c) The name(s) of the successful applicant(s) shall be posted by the Corporation, Corporation within two (2) weeks following the last interview of the competition for the posting and the Association shall be informed in writing of the successful applicant(s). The Corporation will notify the Association in writing of this intent, including reasons for not posting, the date of the last interview. (d) Successful candidates shall commence their duties within fourteen thirty (1430) calendar days.
