Jury & Witness Duty. (a) If a full-time or regular part-time nurse is required to serve as a juror in any court of law, or is required to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law in connection with a case arising from the nurse's duties at the hospital, or is required to attend a coroner’s inquest in connection with a case arising from the nurse’s duties at the hospital, the nurse shall not lose service/seniority or regular pay because of such attendance and shall not be required to work the night shift prior to, or on the day of such duty provided that the nurse: i) notifies the Hospital immediately on the nurse's notification that she or he will be required to attend court; ii) presents proof of service requiring the nurse's attendance; iii) deposits with the Hospital the full amount of compensation received excluding mileage, travelling and meal allowances and an official receipt where available. In addition, where a full-time nurse or regular part-time nurse is selected for jury duty for a period in excess of one (1) week, she or he shall be paid for all hours scheduled and not be expected to attend at work. Upon completion of the process the nurse shall be returned to that point on her or his former schedule that is considered appropriate by the Hospital. It is understood and agreed that the local parties may agree to different scheduling arrangements for the first week of jury and witness duty. (b) Where the Hospital requires a nurse to attend any meetings in preparation for a case or legal proceedings which either arises from a nurse’s employment with the Hospital or otherwise involves the Hospital, the Hospital will make every reasonable effort to schedule such meetings at the Hospital during the nurse’s regularly scheduled hours of work. If the nurse is required to attend such meetings outside of her or his regularly scheduled hours, the nurse shall be paid for all hours spent in such meetings at her or his regular straight time hourly rate of pay. Part-time nurses will be credited with seniority and service for all such hours paid as provided above while in attendance at such meetings.

Where the Hospital requires employee's attendance is required during a nurse different shift than he is scheduled to attend any meetings in preparation for a case or legal proceedings which either arises from a nurse’s employment with the Hospital or otherwise involves the Hospitalwork that day, the Hospital Health Centre will make every reasonable effort attempt to schedule reschedule the shift to include the time spent at such meetings at hearing. It is understood that any rescheduling shall not result in the Hospital during payment of any premium pay. Where the nurse’s regularly scheduled hours of work. Where the Hospital requires employee's attendance is required during a nurse different shift than he is scheduled to attend any meetings in preparation for a case or legal proceedings which either arises from a nurse’s employment with the Hospital or otherwise involves the Hospitalwork that day, the Hospital Employer will make every reasonable effort attempt to schedule reschedule the shift to include the time spent at such meetings at hearing. It is understood that any rescheduling shall not result in the Hospital during payment of any premium pay. Where the nurse’s regularly scheduled hours of work. If Employer is unable to reschedule the nurse employee and, as a result, he is required to attend such meetings outside of her or during other than his regularly scheduled paid hours, the nurse he shall be paid for all hours actually spent in at such meetings hearing at her or his regular straight time hourly rate of pay. In additionaddition to the foregoing, where a full-time nurse or regular part-time nurse is selected for jury duty for employee required by subpoena to attend a period court of law or coroner's inquest in excess of one (1) weekconnection with a case arising from the employee's duties at the Hospital on his regularly scheduled day off, she or he shall be paid for all hours scheduled and not be expected to attend actually spent at work. Upon completion of the process the nurse shall be returned to that point on her or his former schedule that is considered appropriate by the Hospital. It is understood and agreed that the local parties may agree to different scheduling arrangements for the first week of jury and witness duty. (b) Where the Hospital requires a nurse to attend any meetings in preparation for a case or legal proceedings which either arises from a nurse’s employment with the Hospital or otherwise involves the Hospital, the Hospital will make every reasonable effort to schedule such meetings hearings at the Hospital during the nurse’s regularly scheduled hours of work. If the nurse is required to attend such meetings outside of her or his regularly scheduled hours, the nurse shall be paid for all hours spent in such meetings at her or his regular straight time hourly rate subject to (a), and above. (The Maternity Leave clause is applicable to full-time employees only) Maternity leave will be granted in accordance with the provision of the Employment Standards Act except where amended in this provision. The service requirement for eligibility for maternity leave shall be months of continuous service. The employee shall give written notification one month prior to the commencement of the leave of her request for leave together with her expected date of return. At such time she shall also furnish the Hospital with her Doctor's certificate as to pregnancy and expected date of delivery. An employee on maternity leave as provided under this agreement who is in receipt of Unemployment Insurance pregnancy benefits pursuant to Section of the Unemployment Insurance Act, shall be paid a supplemental unemployment benefit. That benefit will be equivalent to the difference between per cent (75%) of her regular weekly earnings and the sum of her weekly Unemployment Insurance benefits and any other earnings. Such payment shall commence following completion of the two week unemployment insurance waiting period, and receipt by the Hospital of the employee's Unemployment Insurance cheque stub as proof that she is in receipt of Unemployment Insurance pregnancy benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of fifteen (15) weeks. The employee's regular weekly earnings shall be determined by multiplying her regular hourly rate on her last day worked prior to the commencement of the leave times her normal weekly hours. The employee has the right to extend the maternity leave to six (6) months in total. Written notice by the employee to extend the maternity leave will be given at least two (2) weeks prior to the termination of the initially approved leave. This notice requirement will be shortened circumstances where medical complications occur in the two (2) weeks prior to the termination of the initially approved leave. It is understood that during a maternity leave exceeding thirty (30) continuous calendar days, credit service for purposes of salary increment, vacation, sick leave, or any other benefits under any provisions of the collective agreement or elsewhere shall be suspended, the benefits concerned appropriately reduced on a pro rata basis and the employee's anniversary date adjusted by the entire period the absence. In addition, the employee will become responsible for full payment of subsidized employee benefits in which she is participating for the period of the absence. Effective October credits for service shall accumulate for the initial seventeen (17) weeks from the commencement of the leave while an employee on maternity leave. However, credit for seniority shall not be suspended but shall accumulate during such leave. Effective October the Hospital will continue to pay its share of the premiums of the subsidized employee benefits which the employee is participating for the initial seventeen (17) weeks from the of the leave while the employee is on maternity leave. After seventeen (17) weeks and subject to the provision of the master policies governing such plans, employees desiring to maintain such protection through the Employer shall be entitled to remit to the Employer such f u l l premiums as fall due during the leave so as to ensure continued coverage. The employee shall reconfirm her intention to return to work on the date originally provided to the Hospital by written notification to be received by the Hospital at least two weeks advance thereof. Subject to any changes to the employee's status which would have occurred had she not been on maternity leave, the employee shall be reinstated to her former duties, on the same shift the same department, and at the same rate of pay. The employee must make written application to the Hospital at least six months prior to the intended commencement date of the program (i.e. the salary deferral portion), stating the intended purpose of the leave. If the Hospital is unable to find a suitable replacement, it may postpone the leave. The Hospital will give the employee as much notice as is reasonably possible. The employee will have the option of remaining in the Plan and rearranging the leave at a mutually agreeable time-or of withdrawing from the Plan and having the deferred salary, plus accrued interest,. if any, paid out to the employee within a reasonable period of time. The employee will be reinstated to his or her former position unless the position has been discontinued, in which case the employee shall be paid given a comparable job. PartIn order to be entitled to such pay from the Employer, an employee must give notice of selection for jury duty. Each employee who is required to appear in Court during his regular working hours or during his scheduled time off as a result of a service-related incident which occurred during the course of his work or at a Coroner’s Inquest, shall: (i) notify the Employer on the day the subpoena is received and (ii) shall receive his regular hourly rate of pay for his scheduled shift or pay at time nurses and one –half the employee’s regular rate of pay for each hour in court, with a minimum of three (3) hours at one and one-half times, whichever is applicable. (b) An employee who is required by law to attend court as a juror or witness, in a matter in which he does not have an interest, will receive the difference between attendance fees (not including travel and meal allowances) and his normal earnings during such time as he is required to be credited absent from employment, by virtue of such attendance. The employee shall provide the Employer with seniority a copy upon receipt of such notice. (c) An employee who attends court in matters in which such employee has an interest shall, on giving reasonable notice under the circumstances, be granted leave for such attendance. Such leave shall be without pay, but without loss of benefits or seniority. (d) An Employee who is jailed pending a court appearance shall be entitled to a leave of absence, without pay, during such period unless discharged by the Employer. (e) Employees who, while on annual vacation, are required by law to attend court as a result of services performed in the execution of their duties on behalf of the Employer shall receive the difference between monies receivable from the witness fees (which fees shall not include travel and service meal allowances) and their normal earnings for all such hours paid vacation time, as provided above while in attendance at is required by virtue of such meetingsattendance. In lieu of such payment, the employee shall be granted time off, with pay, equal to the vacation time for the court attendance. (a) If a full-time or regular part-time nurse is required to serve as a juror in any court of law, or is required to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law in connection with a case arising from the nurse's ’s duties at the hospital, or is required to attend a coroner’s inquest in connection with a case arising from the nurse’s duties at the hospital, the nurse shall not lose service/seniority or regular pay because of such attendance and shall not be required to work the night shift prior to, or on the day of such duty provided that the nurse: i) : Hospital Central Agreement March notifies the Hospital immediately on the nurse's ’s notification that she or he will be required to attend court; ii) ; presents proof of service requiring the nurse's ’s attendance; iii) ; deposits with the Hospital the full amount of compensation received excluding mileage, travelling and meal allowances and an official receipt where available. The employee shall provide the Employer with seniority a copy upon receipt of such notice. (c) An employee who attends court in matters in which such employee has an interest shall, on giving reasonable notice under the circumstances, be granted leave for such attendance. Such leave shall be without pay, but without loss of benefits or seniority. (d) An Employee who is jailed pending a court appearance shall be entitled to a leave of absence, without pay, during such period unless discharged by the Employer. Such leave shall be without loss of benefits to the end of the third month following the first day of absence. (e) Employees who, while on annual vacation, are required by law to attend court as a result of services performed in the execution of their duties on behalf of the Employer shall receive the difference between monies receivable from the witness fees (which fees shall not include travel and service meal allowances) and their normal earnings for all such hours paid vacation time, as provided above while in attendance at is required by virtue of such meetingsattendance. In lieu of such payment, the employee shall be granted time off, with pay, equal to the vacation time for the court attendance. Jury & Witness Duty. (a) If The City shall grant leave of absence without loss of seniority to an employee who serves as a full-time juror or regular part-time nurse Crown Witness. For jury or Crown witness duty unrelated to the City’s business, the City shall pay such employee the difference between their normal earnings and the payment they receive for jury service excluding payment for traveling, meals or other expenses. The employee will present proof of service and the amount of pay received. When an employee is required to serve act as a juror Crown Witness on matters relating to the Employer’s business, the City shall pay such employee the difference between their regular earnings and the payment they receive for such witness duty. Reimbursement for travel, accommodation and meals (subject to clause 18:01 Meal Allowance) to perform such witness duty shall be in accordance with City policy minus any court payments received for such expenses from the Crown. The employee will present proof of lawservice, or is required to attend as a witness in a court proceeding in which the Crown is a party, or amount of pay and reimbursement received. Jury & Witness Duty. (a) If a full-time or regular part-time nurse is required to serve as a juror in any court of law, or is required to attend as a witness in a court proceeding in which the Crown is a party, or is required by subpoena to attend a court of law in connection with a case arising from the nurse's duties at the hospital, or is required to attend a coroner’s inquest in connection with a case arising from the nurse’s duties at the hospital, the nurse shall not lose service/seniority or regular pay because of such attendance and shall not be required to work the night shift prior to, or on the day of such duty provided that the nurse: i) : notifies the Hospital immediately on the nurse's notification that she or he will be required to attend court; ii) ; presents proof of service requiring the nurse's attendance; iii) ; deposits with the Hospital the full amount of compensation received excluding mileage, travelling and meal allowances and an official receipt where available. In addition, where a full-time nurse or regular part-time nurse is selected for jury duty for a period in excess of one (1) week, she or he shall be paid for all hours scheduled and not be expected to attend at work. Upon completion of the process the nurse shall be returned to that point on her or his former schedule that is considered appropriate consideredappropriate by the Hospital. It is understood and agreed that the local parties may agree to different scheduling arrangements for the first week of jury and witness duty. (b) . Where the Hospital requires Hospitalrequires a nurse to attend any meetings with a Hospital's counsel in preparation for a case or legal proceedings which either arises from a nurse’s 's employment with the Hospital or otherwise involves the Hospital, the Hospital will make every reasonable effort reasonableeffort to schedule such meetings at the Hospital during the nurse’s 's regularly scheduled hours of work. If the nurse is required to attend such meetings outside of her or his regularly scheduled regularlyscheduled hours, the nurse shall be paid for all hours spent in such meetings at her or his regular straight time hourly rate of pay. Part-time nurses will be credited with seniority and service for all such hours paid as provided above while in attendance at such meetings.
