Lease PriceThe Developer will have the right to decide the Lease price of residential Units, regard being had to then prevailing market rates of comparable units in Raipur / Naya Raipur. The Developer shall be free to announce schemes for Lease of various Residential Units in different lots, commensurating with the phasing of development, with prior approval of NRDA. The different lots shall primarily be for Lease to members of the general public. The Developer will have the right to decide the amount, to be paid by the owners of residential Units as one time during the handing over of flats for social, recreational common infrastructure, regard being had to then prevailing market rates of comparable units in Raipur / Naya Raipur. Lease PriceThe lease price for the Additional Replacement shall be thirty two thousand one hundred ninety three dollars ($32,193.00) (“Additional Rental”). This amount represents the price of three thousand five hundred seventy seven dollars ($3,577.00) per acre-foot for Replacement Credit of Tier 1 water for a total of nine (9) acre-feet. The Additional Rental is due upon execution of this Amended Agreement.
Lease PriceThe lease price for the Replacement Water shall be $35,770 (“Rental”). This amount represents the price of $3,577.00 per acre-foot for Replacement Credit for Tier 1 water for a total of ten (10) acre-feet.
Lease Price. Commencing on the Rent Commencement Date (as defined below) and continuing during the Primary Term of this Lease, the LESSEE shall pay to the LESSOR rent for the use and occupancy of the Premises in accordance with the attached Exhibit “C” (hereafter the “Base Rent). Commencing with the eleventh (11th) Lease Year, the Base Rent shall increase by an amount equal to the Base Rent for the tenth (10th) Lease Year multiplied by the percentage increase in the CPI (as defined below) over the preceding five year period, with such five year period commencing with the month which is three months prior to the end of the fifth (5th) Lease Year and ending with the month which is three months prior to the end of the tenth (10th) Lease Year; provided, however any such increase shall not exceed ten percent (10%). Commencing with the sixteenth (16th) Lease Year, the Base Rent shall increase by an amount equal to the Base Rent for the fifteenth (15th) Lease Year multiplied by the percentage increase in the CPI over the preceding five year period, with such five year period commencing with the month which is three months prior to the end of the tenth (10th) Lease Year and ending with the month which is three months prior to the end of the fifteenth (15th) Lease Year; provided, however any such increase shall not exceed ten percent (10%).
