Leave Bank. 1. A sick leave bank shall be maintained within the District. The purpose of the Leave Bank is to provide a bank of sick leave days from which staff may draw in cases of extended absences due to illness or injury which renders the staff member incapable of working. 2. The bank was funded initially by a mandatory contribution from each employee of one (1) day from that employee’s individual sick leave account, as well as a 100-day contribution from the school district. 3. The sick leave bank shall be administered by the Superintendent and the Association President(s). 4. Leave Bank. 1The parties acknowledge that it is in the best interest of both the District and the employees to limit payments from the Sick Leave Bank to those situations in which no alternative funding is available. To facilitate reaching this goal, all members of the Sick Leave Bank shall be required to attend a presentation on the benefit of acquiring disability insurance. The Union will encourage employees to obtain disability insurance. Should an employee be eligible for coverage by both the Sick Leave Bank and an insurer, the Sick Leave Bank will become the secondary income provider. A sick leave bank Sick Leave Bank shall be maintained within whereby an employee who suffers a long-term illness or disability which requires extended hospitalization or home confinement and for which no worker’s compensation benefits are available shall be eligible to apply for paid sick leave after the employee exhausts all accumulated sick leave. The Sick Leave Bank shall be composed of three (3) employees appointed by the Federation and three (3) employees appointed by the District. Previously donated days shall not be refunded to an employee upon termination of membership. An employee who has applied to the Bank for sick days may attend the meeting at which the Committee will review the application. The employee may be accompanied at the meeting by a representative or the representative may attend alone on behalf of the employee. The Committee shall have the sole authority to either approve or disapprove applications for Bank benefits. The decision of the Committee shall be final. All applications for days shall be considered accepted unless voted against by a majority of the Committee. Decisions of the committee shall not be subject to district grievance procedures. Failure of the committee to follow procedures set down in this article shall be grievable.

Leave Bank. Licensed employees may participate in a Leave Bank provided they meet the following guidelines.

However, all days contributed to the Leave Bank shall remain in the Leave Bank and will not be restored to any employee.
4. The open enrollment periods shall be from August 1 through August 31, and from January 1 through January 31, of every year, or within the first thirty (30) days following the one-year employment date.
5. Additional days may be required to be donated by all Leave Bank members in order to maintain the number of days in the Leave Bank at a number equal to or greater than 1/3 of the number of staff participating in the Leave Bank. All such additional required donations shall be determined and requested by the Leave Bank Committee. Employees who are current members of the Leave Bank and have no sick leave remaining at the time of the request for additional days shall donate the requested number of days at such time as they are granted additional sick leave days through application of this agreement.
6. First year employees may request up to ten (10) days from the Leave Bank any time prior to but within thirty (30) calendar days after the individual returns to work. Applications submitted at a time outside these limits will not be considered by the Superintendent and Association President(s)without donating days. B. The employee will be eligible for the following benefits:
a. If a maximum of (300) calendar zero to (1) one day of an Employee’s Leave Bank is used during the year, she/he will receive twenty percent (20%) pay of the remaining accumulated Leave Bank days after for the individual returns year (this is either (12) twelve or(11) eleven days).
b. If a maximum of (2) two to work. Applications submitted at a time outside these limits (3) three days of an employee’s Leave Bank is used during the year, she/he will not be considered by receive ten percent (10%) pay of the Superintendent and Association President(sremaining accumulated Leave Bank days for the year (this is either (10) ten or (9) nine days). Leave Bank. 1(a) Lambda Legal shall establish a leave bank where employees may contribute unused accrued sick leave for use by a leave bank member who is experiencing (or whose family member is experiencing) a “medical emergency” and has exhausted their available paid sick or family leave. A sick leave bank “medical emergency,” as used in this Article, shall be maintained within defined as a major illness or medical condition of an employee or their family member that requires an extended absence. Leave Bank. 1. The parties acknowledge that it is in the best interest of both the District and the employees to limit payments from the Sick Leave Bank to those situations in which no alternative funding is available. To facilitate reaching this goal, all members of the Sick Leave Bank shall be required to attend a presentation on the benefit of acquiring disability insurance. The Union will encourage employees to obtain disability insurance. Should an employee be eligible for coverage by both the Sick Leave Bank and an insurer, the Sick Leave Bank will become the secondary income provider.

5. Persons who have used all of their leave entitlement shall be eligible to draw from the leave bank under the following condition:
a. Only when under a doctor’s care.
b. For each first day granted from the leave bank per occurrence the employee shall be docked the current substitute pay.
c. For a recurring illness or a medical condition that requires periodic and consistent medical treatment of a severe disablement, Sick Leave Bank Days (in increments of half days) may be granted for all absences resulting from these conditions
d. Any individual who is absent as a result of a medically diagnosed catastrophic illness or injury may access the bank for up to and including sixty (60) additional days. Utilization of these days shall require the submission of a new Leave Bank Application to the bank.
6. An individual who meets the requirements stated above can use a total of no more than thirty (30) days per school year from the leave bank.
7. An individual may request days from the Leave Bank any time accepted prior to but October 1 of each year or within thirty (30) calendar days after an employee is hired, whichever is later.
1.4 An employee shall be eligible to withdraw from the individual returns to work. Applications submitted Bank provided the employee has contributed at a time outside these limits will not be considered by the Superintendent and Association President(s). The request must be submitted least one (1) day to the Superintendent office using Bank.
1.5 An employee who exhausted all accumulated leave shall be eligible to apply for sick leave from the Leave Bank. If the employee’s application for days is accepted, the committee will reserve the right to determine the number of days awarded.
1.6 Maximum withdrawal from the Bank Applicationshall be forty (40) days. The Additional days may be requested by submitting a new application can be located in the appendix of this agreement. Upon receipt of the application the Superintendent shall forward the request to the Association President(s). The Superintendent and Association President(s) shall meet, within ten (10) days to consider such request. Within five (5) days following said meeting, the applicant shall be notified, in writing, of the status of the requestCommittee.
8. Any individual who has accessed the leave bank and resigns their position in the same contract year will be docked their daily rate of pay for each day used from the bank.
9. Elective treatment or surgery is defined as a condition diagnosed by a Doctor that admission sometime in the future is acceptable for a condition causing minimal or no pain, dysfunction or disability and can be safely postponed until non-contract time. Such conditions shall not qualify for Leave Bank Days.
10. The District is liable only for 1.7 If the total number of days in the leave bankBank is reduced to one hundred eighty (180) days, the Committee will require members to donate an additional day to the Bank. All members will be provided written notice of the need for additional donations. Membership will be continued provided the member contributes the additional day. Previously donated days shall not be refunded to an employee upon termination of membership.
1.8 An employee who has applied to the Bank for sick days may attend the meeting at which the Committee will review the application. The employee may be accompanied at the meeting by a representative or the representative may attend alone on behalf of the employee. The Committee shall have the sole authority to either approve or disapprove applications for Bank benefits. The decision of the Committee shall be final.
1.9 All applications for days shall be considered accepted unless voted against by a majority of the Committee. Decisions of the committee shall not be subject to district grievance procedures. Failure of the committee to follow procedures set down in this article shall be grievable.
