WAIVER IN CASE OF EMERGENCY Section 35.1. In cases of emergency declared by the President of the United States the Governor of the State of Ohio, the Sheriff or Federal or State Legislature or the President of the University, such as acts of God or civil disorder, the following conditions of this Agreement may be temporarily suspended by the Employer:

Appearance in Court When an employee is required by the Employer to appear in court, or before any attorney-at-law for the purpose of testifying, because of an accident he/she may have been involved in during working hours, the employee shall be reimbursed in full by the Employer for all time required to be spent, computed at his/her hourly rate of pay or the daily minimum, whichever is greater, because of his/her appearance. The employee shall reimburse the Employer for any duplicate payments.
PURPOSE/JUSTIFICATION OF RECOMMENDED ACTION The purpose of the Agreement is to provide the City with the services of one senior criminalist from the Department to perform DNA testing, analysis, and forensic-related consulting as requested by the City, effective upon execution by the Board through June 30, 2015. This Agreement will result in the creation of an additional senior criminalist position. The senior criminalist will be assigned solely to the Santa Xxxxxx Police Department (SMPD).
Court Appearance Leave Without Pay An employee may request and shall be granted leave without pay for the time required to make an appearance as a plaintiff or defendant in a civil or criminal court proceeding that is not connected with the employee's officially assigned duties. However, reduction in salary will not be made for an FLSA-exempt employee to testify in court or at a deposition except for full workweek increments where such testimony causes an absence of one (1) or more full workweeks.
LAW APPLICABLE AND COMPETENT COURT 6.1 The Agreement is governed by [insert the national law of the NA].
Notice of Successful Applicant The Employer shall, within three (3) calendar days, inform all applicants of the name of the successful applicant either in writing to each applicant or posting the name of the successful applicant in the same manner in which the vacancy or new job was posted.
Competent Court The Court of Milan shall have jurisdiction over any dispute arising out of this offer to purchase.
