Legal Enforcement. In case the rental and other charges are not paid by due date, the Customer accepts a demand for the return of all machines and equipment according to the Legal Enforcement Act Art. 13-2, second subsection letter a). The notification shall, according to Art. 4-18, provide information that enforcement can be avoided if the rental, non-judicial debt collection costs, administration costs and due rental cost up until the time of payment will be paid, inclusive of interest, before enforcement is executed. The Customer also accepts, according to the Legal Enforcement Act Art. 13-2 second subsection letter b) that a return can be demanded once the rental period has come to an end, if a rental has been agreed for a specific time period.
Legal Enforcement. 13.1. This MOU is not legally enforceable. It describes the understanding between both parties for the use of funding specified in Clause 3 of this agreement.

The Association recognizes and acknowledges the District's right to enforce this provision by any available legal means including, but not limited to, application to the State Superior Court for injunctive relief and/or the filing of a complaint for damages based upon a breach of this Agreement.

If a party initiates any legal action or other proceeding for the enforcement or interpretation of the Agreement, or because of a dispute or an alleged default, breach or misrepresentation in connection with the Agreement or the rights or obligations of the parties hereunder, the parties consent to the exclusive personal jurisdiction of the appropriate state or federal court located in San Francisco, California, U.S.A., in such action or other proceeding.
Legal Enforcement. If necessary, SAHC will enforce the conservation easement in a court of law. These responsibilities will be SAHC’s forever. In order for us to accept a new conservation easement, we must have adequate funds on hand to cover these long-term costs, separate from our general operating budget. Accordingly, we ask the landowner to make a stewardship contribution to SAHC to help cover these costs. This contribution is tax deductible, and if necessary can be staged over several years. In cases where the grantor is unable to make a donation, we may turn to the community to raise necessary funds, perhaps with help from the landowner. Neighboring property owners, local supporters, or government entities may be potential sources of stewardship funds.
Legal Enforcement. In the event either party takes legal action to enforce any terms of the MOU, each party is responsible for its own legal fees.
