Levels of Accomplishments. In addition to the normal administrative services required as part of this Agreement, the SPONSOR agrees, and will cause the OWNER OF LEASEHOLD INTEREST to agree, to provide the following levels of program services: Rental Units Bedrooms for Rent 120 1 bedroom --------D. Performance Monitoring: The PJ will monitor the performance of the SPONSOR and the OWNER OF LEASEHOLD INTEREST against goal and performance standards required herein. Substandard performances as determined by the PJ will constitute non-compliance with this Agreement. If action to correct such substandard performance is not taken by the SPONSOR and/or the OWNER OF LEASEHOLD INTEREST within thirty (30) days after being notified by the PJ, or if the default is of the nature that can not reasonably be cured within said thirty (30) days, unless the SPONSOR and/or the OWNER OF LEASEHOLD INTEREST shall commence diligently and continue without interruption to cure said default within said thirty day (30) period, the PJ shall have the right to terminate this Agreement and recover the HOME funds by foreclosing the mortgage as such terms are defined hereinafter.

  • Objectives of Agreement The objectives of this Agreement are to:

  • Performances All services provided by the Vendor pursuant to this Agreement shall be performed to the satisfaction of VDSS and the local department of social services, and in accordance with the applicable federal, state, and local laws, ordinances, rules and regulations. Vendor shall not receive payment for work found by VDSS and/or the local department of social services to be unsatisfactory, or performed in violation of federal, state or local laws, ordinances, rules or regulations.

  • Other Activities/Renovations A. The Contractor acknowledges its responsibility to assure the Judicial Council’s quiet enjoyment of the Program and to provide the full service level of the Property for the Program, free from outside distractions, disturbances, and/or interruptions. The Contractor shall avoid assigning any rooms to the Judicial Council or the Attendees during the Program which are adjacent to or across from any group or activity that may generate noise or other distractions, such as construction or other conduct, sufficient to detract from quiet enjoyment of the Program on the Property.

  • Performance Expectations The Charter School’s performance in relation to the indicators, measures, metrics and targets set forth in the CPF shall provide the basis upon which the SCSC will decide whether to renew the Charter School’s Charter Contract at the end of the charter term.   • PROGRESS AND COMPLETION 8.2.1 All time limits stated in the Contract Documents are material terms and time is the essence of the Contract. A failure by Contractor to do what is required by the time specified in the Contract Documents is a breach of the contract.

  • Payments and Completion Payments may be withheld because of (1) defective work not remedied; (2) failure of contractor to make proper payments to subcontractors, workers, or suppliers; (3) persistent failure to carry out work in acceptance with this Agreement or these general conditions, or (4) legal claims. Final payment will be due after complete release of any and all liens arising out of the contract or submission of receipts or other evidence of payment covering all subcontractors or suppliers who could file such a lien. The contractor agrees to indemnify the Owner against such liens and will refund all monies including costs and reasonable attorney’s fees paid by the owner in discharging the liens. A 10 percent holdback is required by the lender to assure the work has been properly completed and there are no liens against the property.   • COORDINATION WITH OTHER CONTRACTORS Contractor expressly acknowledges and agrees that other contractors may be performing work on other projects at the Site, while the Work is taking place, in which event Contractor shall fully cooperate with District and other contractors while performing the Work, at no additional cost to District.

  • Expectations Faculty members participating in the annuitant employment program are expected to perform the full range of faculty duties, on a pro rata basis. They are subject to the professional development plans required under Article 22.
