Liability for Failure to Make a Transaction. If the Credit Union does not complete a transaction to or from your account on time or in the correct amount according to our agreement with you, the Credit Union may be liable for your actual losses or damages. However, there are some exceptions to this, which include the following: • You do not have enough money in your account to make the transaction through no fault of ours. • The transaction goes over the credit limit on your overdraft line. • The terminal where you were making the transaction does not have enough cash. • The terminal or other system was not working properly, and you knew about the problem when you started the transaction. • Circumstances beyond our control (such as fire, flood or electrical failure) prevent the transaction, despite reasonable precautions that we have taken. • You have not properly followed instructions for operation of the ATM or system. • The funds in your account are subject to legal process or another similar encumbrance. • The transaction would exceed one of the established limits contained in this Agreement or by other Credit Union agreements. • Access to your account has been blocked after you have reported your access device lost or stolen, or you use a damaged or expired access device. • The Credit Union has a reasonable basis to believe an access device has been compromised; or that other actions/circumstances cause us to believe there is a possibility of unauthorized activity or other risk involving an access device we have issued.

Credit Union and the xxxx xxxxx service provider will carry out your instructions in a reasonable manner. This is in addition to any other provisions in this agreement that address the Credit Union’s liability. The Credit Union has no liability to you whatsoever for any transaction using an access device we: (1) have not issued; or (2) issued by another party with whom we have no written agreement. ONLINE BANKING ACCOUNT POLICY. Beginning April 1, 2014, Bill Pay on any account with no activity for 90 days will be considered inactive and subject to closure without prior notice. For online banking, if you would like your account to remain active, log into your account at least once every 90 days.

The Credit Union has no liability for its failure to complete a transaction if: • You do not have available funds in your account to perform the transfer or transaction. • The transaction exceeds the credit limit on your Overdraft Protection Loan or Overdraft Privilege limit, if applicable. • The system is not functioning as intended or is not available. • Circumstances beyond our control (such as fire, flood or electrical failure) prevent the transaction, despite reasonable precautions that we have taken. • You have not properly followed instructions within the Service. • The funds in your account are subject to legal process or another similar encumbrance. • The transaction would exceed one of the established limits contained in this Agreement or by other Credit Union agreements. • Access to your account has been blocked after you have reported potential or actual unauthorized access. • We have a reasonable basis to believe there is a possibility of unauthorized activity or other risk involving your account. BUSINESS DAY DISCLOSURE: Our business days are Monday through Friday. Holidays are not included. Online and Mobile Banking service will be available twenty-four (24) hours a day, seven (7) days a week, except when down for conditions indicated in the section of this Agreement titled “System Unavailability.” INFORMATION ABOUT YOUR ACCOUNT(S) AND ABOUT YOU: Generally, we will not disclose information to third parties about your account(s) or about you without your permission; however, we may disclose information in the following scenarios: • when it is necessary to complete transfers or transactions, or to send notice of dishonor or non-payment; • to our accountants and auditors; • to state or federal government regulators; • to exchange, in the regular course of business, credit information with other banks, financial institutions, or commercial enterprises, directly or through cre...
