LIABILITY FOR UNAUTHORIZED CARD TRANSACTIONS. If your monthly account statement shows transfers that you did not make or authorize, including those made by your card, PIN, or other means, tell us AT ONCE by calling customer service at 0-000-000-0000. If you do not notify us within 60 days after your monthly statement was made available to you, you will be liable for any additional unauthorized transactions that occurred after the 60-day period and before you provided notice to us (if we can prove we could have stopped those transactions had you promptly notified us). You will have no liability for any Card transactions that you did not make or authorize, so long as those transactions occurred before the end of the 60-day period described above. You agree to cooperate with our investigation of the loss, theft, or unauthorized use of the Card (including unauthorized use of the Card number or any other Card-identifying information), including providing us and law enforcement authorities with information we or they may require (including, for example, an affidavit), as described in the "Security Procedures" subsection of the Agreement. The 14-day notification period described in the "Statements" section of the Agreement is replaced with the 60-day notification period described in this "Liability for Unauthorized Card Transactions" section solely for Card transactions (and no other Account transactions). All other provisions in the "Statements" section of the Agreement apply to Card transactions involving your Account.

LIABILITY FOR UNAUTHORIZED CARD TRANSACTIONS. Except to the extent mandated by Consumer Financial Protection Bureau Regulation Z and/or MasterCard operating rules, you are responsible for all transactions initiated using your Account, whether or not authorized by you or a Cardholder. If we issue 10 or fewer Cards on your Account and MasterCard operating rules do not otherwise limit your liability for unauthorized use, your liability for unauthorized Card use is generally limited to $50. Cardholders are generally not liable for unauthorized Account activity, unless the Cardholder is a sole proprietor or Personal Guarantor of the Account. All transactions initiated by a Cardholder or by any person to whom a Cardholder has given permission to use their Card or the Account are considered authorized, regardless of whether the user stayed within the limits of permission given. We are not responsible for agreements you or your Cardholders make with third parties limiting their use of Cards or the Account. You are responsible for instructing your Cardholders to keep their Cards, Account numbers, and any computers or other devices linked to the Account secure. You agree to notify us immediately if you become aware of any actual or potential unauthorized access to your Card, Account information or a device on which your Account information is stored or through which your Account information may be accessed. You agree to notify us immediately if you wish to restrict or terminate a Cardholder’s ability to make Account transactions, whether via Card, computer, mobile device, or otherwise. Your failure to do so may result in unauthorized transactions for which you will be responsible.

  • Liability for all card transactions Subject to clause 9.3, you are liable for all card transactions effected by the use of the card at an ATM whether with or without your knowledge or authority, save in the case of our or our employees’ fraud, gross negligence or wilful default.

  • Your Liability for Unauthorized Transfers Immediately following your discovery of an unauthorized Payment Instruction, you shall communicate with customer care for the Service in the manner set forth in Section 6 of the General Terms above. You acknowledge and agree that time is of the essence in such situations. If you tell us within two (2) Business Days after you discover your password or other means to access your account through which you access the Service has been lost or stolen, your liability is no more than $50.00 should someone access your account without your permission. If you do not tell us within two (2) Business Days after you learn of such loss or theft, and we can prove that we could have prevented the unauthorized use of your password or other means to access your account if you had told us, you could be liable for as much as $500.00. If your monthly financial institution statement contains payments that you did not authorize, you must tell us at once. If you do not tell us within sixty (60) days after the statement was sent to you, you may lose any amount transferred without your authorization after the sixty (60) days if we can prove that we could have stopped someone from taking the money had you told us in time. If a good reason (such as a long trip or a hospital stay) prevented you from telling us, we will extend the time periods specified above to a reasonable period.

  • Liability for Unauthorized Use If any Card is lost or stolen or otherwise may be used without your permission (express or implied), you must immediately notify us orally or in writing at the following phone number or address: 0-000-000-0000 or at TIB, National Association, P.O Box 569120, Dallas, Texas 75356-9120. If unauthorized use of a Card occurs before you notify us of the loss, theft or unauthorized use, you may be liable up to a maximum amount of $50. If unauthorized use of a Credit Device occurs, you may be liable for all of the unauthorized use.

  • Unauthorized Transactions You are not responsible for unauthorized Transactions. A Transaction is considered an “unauthorized Transaction” if we complete an investigation and determine that: • The Account was used by someone other than you; • You did not receive any benefit from the Transaction; • You co-operated fully with us in our investigation; and • You followed your responsibilities under this Agreement, including in these sections: i. “Unauthorized Transactions” , ii. “Using the Account”

  • Liability for Failure to Stop Payment of Preauthorized Transfers If you order us to stop payment of a preauthorized transfer three (3) business days or more before the transfer is scheduled and we do not do so, we will be liable for your losses or damages.

  • Liability for Subcustodians (a) Subject to the exculpation from consequential damages set forth in Section 7.1(b), Bank shall be liable for direct Liabilities incurred by Customer that result from: (i) the acts or omissions of any Subcustodian selected by Bank, whether domestic or foreign, to the same extent as if such act or omission was performed by Bank itself, taking into account the standards and market practice prevailing in the relevant market; or (ii) the insolvency of any Affiliated Subcustodian. Subject to the terms and conditions of this Agreement, including the exculpation from consequential damages set forth in Section 7.1(b), Bank shall take full responsibility for any Liabilities that result from or that are caused by the fraud, willful misconduct, or negligence of its Subcustodians or the insolvency of an Affiliated Subcustodian. In the event of any Liabilities suffered or incurred by Customer caused by or resulting from the acts or omissions of any Subcustodian for which Bank would otherwise be liable, Bank shall promptly reimburse Customer in the amount of any such Liabilities. (b) Subject to Section 7.1(a) and Bank's duty to use reasonable care, prudence and diligence in the monitoring of a Subcustodian's financial condition as reflected in its published financial statements and other publicly available financial information concerning it, Bank shall not be responsible for the insolvency of any Subcustodian which is not a branch or an Affiliated Subcustodian. (c) Bank reserves the right to add, replace or remove Subcustodians. Bank shall give Customer prompt notice of any such action, which shall be advance notice if practicable. Upon request by Customer, Bank shall identify the name, address and principal place of business of any Subcustodian and the name and address of the governmental agency or other regulatory authority that supervises or regulates such Subcustodian.

  • Monopolies and Exclusive Service Suppliers 1. Each Party shall ensure that any monopoly supplier of a service in its territory does not, in the supply of the monopoly service in the relevant market, act in a manner inconsistent with that Party's Schedule of specific commitments. 2. Where a Party's monopoly supplier competes, either directly or through an affiliated company, in the supply of a service outside the scope of its monopoly rights and which is subject to that Party's Schedule of specific commitments, the Party shall ensure that such a supplier does not abuse its monopoly position to act in its territory in a manner inconsistent with such commitments. 3. If a Party has reason to believe that a monopoly supplier of a service of the other Party is acting in a manner inconsistent with paragraphs 1 or 2 above, it may request that Party establishing, maintaining or authorising such supplier to provide specific information concerning the relevant operations. 4. The provisions of this Article shall also apply to cases of exclusive service suppliers, where a Party, formally or in effect: (a) authorises or establishes a small number of service suppliers; and (b) substantially prevents competition among those suppliers in its territory.
