LIMITATIONS ON USE OF NON-REGULAR POSITIONS. ‌ 9.3.1 Creating ongoing faculty appointments in a sustainable way provides the best conditions for ensuring program viability, student success, and employee satisfaction. Therefore, where ongoing workload is sufficient, the University shall recruit and appoint regular, rather than non-regular faculty members. 9.3.2 Where ongoing full-time work is created (e.g. through the addition of new programs) which can be filled by a single faculty member, a regular position will be created.

In the event another party, including law enforcement or a government entity, contacts the Provider with a request or subpoena for Student Data in the possession of the Provider, the Provider shall redirect the other party to seek the data directly from the LEA. In the event the Provider is compelled to produce Student Data to another party in compliance with a court order, Provider shall notify the LEA at least five (5) school days in advance of the court ordered disclosure and, upon request, provide the LEA with a copy of the court order requiring such disclosure.
