Long-term parental leave. A. Leave without pay for a period of two complete school years shall be granted teachers requesting long-term parental leave. If the teacher requests an extension of such leave for an additional one or two year period, said request shall be granted. Requests for such leave shall be filed with the Human Resources Office at least fifteen (15) school days (three weeks during the summer months) prior to the beginning of the requested leave where the birth of the child or the event causing the need for the leave occurs. Any parental leave requests that reflect the continuation of a leave already in progress shall be filed with Human Resources Office on or before July 1st. All leaves shall be subject to the following conditions: 1. Upon return from such leave, only actual teaching experience will be used in establishing seniority to comply with reduction in force procedure. 2. Hiring date will be considered only in cases where two or more teachers have equal experience. 3. During the term of the leave, no employee shall be gainfully employed on a full-time basis during the regular teacher time schedule as established by the Parma City School District. Full time employment shall be interpreted as a 40 hour work week. However, such teacher may substitute or work as a home tutor less than 120 days in the Parma City School District or another school district. 4. A parental leave will not be granted to any employee once the child has entered the first grade. B. Teachers on parental leave shall be entitled to return from such leave at the beginning of one of the two succeeding school years, unless the teacher requests an additional one or two year extension of his/her parental leave, in which case, he/she shall be entitled to return from such leave at the beginning of the third or fourth succeeding school year. Teachers whose parental leave begins on or after March 15 of any school year shall, at the time of requesting such leave, notify the Human Resources Office of his/her decision to return or not return the first day of the following school year. The decision not to return the first day of the following school year is irrevocable. C. Requests for reinstatement from long-term parental leave shall be directed to the Human Resources Office no later than March 15 of the calendar year in which the teacher is requested to return. The teacher may return at other than the beginning of a new school year only at the discretion of the administration. D. Individuals on long-term parental leave may continue any or all group insurance coverage available through the Board of Education by reimbursing the Board for premium costs until termination of leave. Failure of the individual to forward premium payments to the Chief Financial Officer’s office at the stipulated times will terminate this option. E. The Board will make every effort to return the teacher to a comparable assignment to that held before going on long-term parental leave. Any teacher returning from parental leave shall not be entitled to advancement on the salary schedule for the period of absence nor shall any sick leave accrue during that time. F. Once a teacher’s parental leave has taken effect and he/she has utilized all rights granted him/her under 25.02 (B), he/she may not request a further contiguous extension of such leave beyond the provisions granted under 25.02 (B). Such teacher may request and shall be granted additional parental leave(s) if he/she returns to full-time employment for at least one school year between such leaves.

Long-term parental leave. A. Leave After two (2) years of full-time teaching in the District, a teacher shall be eligible for a long-term unpaid parental leave of absence (i.e., extending beyond FMLA leave time) following the birth or adoption of a child, subject to the terms and conditions set forth in this Section 9.6. Said teacher may, in writing, request a leave of absence without pay for the balance of that school year and for not more than one school year thereafter. A parental leave of absence may begin when the teacher so desires, but no later than xxxxxx (90) calendar days following the birth or adoption of the child; however, requests for such leave must be made before the teacher leaves his/her teaching responsibilities because he/she is unable to perform her duties satisfactorily or when the birth of his/her child is imminent as certified by the teacher’s doctor or a period doctor of two complete school years shall be granted teachers requesting the Board's choice if the Board so desires. A teacher granted a parental leave of absence must teach at least 100 days of a school yearsyear to accrue seniority credit and advance on the salary schedule.
E. A teacher on parental leave of absence, unless if he/she so desires, shall have priority on substitute assignments, and if a vacancy occurs while he/she is on leave, he/she will be offered, upon request, an opportunity to fill said vacancy, provided that (1) it is an elementary teacher filling an elementary position, a junior high teacher filling a junior high vacancy, a special teacher filling a vacancy in a specialty, a senior high school teacher filling a high school vacancy in a subject he/she is qualified to teach, or (2) if the teacher requests an additional one Superintendent approves and further provided if it were applicable, the Board finds he or two year extension she were capable of his/her teaching the subject matter involved, provided that the Board shall not be arbitrary or capricious in such finding.
F. At the end of a teacher's parental leave, the teacher shall have a right to return to employment in which casethe District, provided he/she notifies the Superintendent in writing before March 1 of the year the parental leave of absence shall end. If the position he/she left is open, he/she may return to that position. If the position he/she left is filled or discontinued, he/she shall be entitled placed in a position for which he/she is qualified. Nothing herein shall guarantee that a teacher will be returned to return from such leave at the beginning of the third same grade level, school, or fourth succeeding school year. Teachers whose parental leave begins on or after March 15 of any school year shallposition, at the time of requesting such leave, notify the Human Resources Office of which he/she held prior to his/her decision leave.
G. A teacher adopting a child of preschool age shall be entitled upon request to return or not return leave under this Section 9.6 during the first day of year after receiving such custody if this is necessary to fulfill the following school year. The decision requirements for adoption, provided the teacher notifies his/her principal with a copy to the Superintendent not less than sixty (60) days prior to return the first day of the following school year is irrevocablerequested leave.

Once a teacher’s parental leave has taken effect and time he/she has utilized all rights granted himis physically incapable of performing his/her under 25.02 (B), duties had he/she not taken such leave. A statement from the teacher's doctor, or a doctor of the Board's choice, may not request a further contiguous extension of such be required by the Administration to establish eligibility for sick leave. FMLA leave beyond time shall also run concurrently with the provisions granted under 25.02 (B). Such teacher may request and shall be granted additional parental leave(s) if he/she returns to full-time employment for at least one school year between such leavesleave.
