These and any future Loop qualification tools CenturyLink develops will provide CLEC access to Loop qualification information in a nondiscriminatory manner and will provide CLEC the same Loop qualification information available to CenturyLink. CLEC may request an audit of CenturyLink's company records, back office systems and databases pertaining to Loop information pursuant to Section 18 of this Agreement.

These and any future Loop qualification tools Qwest develops will provide CLEC access to Loop qualification information in a nondiscriminatory manner and will provide CLEC the same Loop qualification information available to Qwest. If the Loop make-up information for a particular facility is not contained in the Loop qualification tools or if the Loop qualification tools return unclear or incomplete information, then CLEC may request that Qwest perform a manual search of the company's records, back office systems and databases where Loop information resides. Qwest will provide CLEC, via email, the Loop information identified during the manual search within forty-eight (48) hours of Qwest’s receipt of CLEC’s request for manual search. The email will contain the following Loop makeup information: composition of the Loop material; location and type of pair gain devices, terminals, Bridged Tap, and load coils; Loop length, and wire gauge. After completion of the investigation, Qwest will load the information into the LFACS database, which will populate the fields in the Loop qualification tools.
Loop Qualification Tools. CenturyLink offers Loop Qualification Tools as described in the Loop Qualification Job Aid. These and any future Loop qualification tools CenturyLink develops will provide Customer access to Loop qualification information in a nondiscriminatory manner and will provide Customer the same Loop qualification information available to CenturyLink. 2.0.4.1 If the Loop make-up information for a particular facility is not contained in the Loop qualification tools, if the Loop qualification tools return unclear or incomplete information, or if Customer identifies any inaccuracy in the information returned from the Loop qualification tools, and provides CenturyLink with the basis for Customer's belief that the information is inaccurate, then Customer may request, and CenturyLink will perform a manual search of the company's records, back office systems and databases where Loop information resides. CenturyLink will provide Customer, via email, the Loop information identified during the manual search within 48 hours of CenturyLink's receipt of Customer's request for manual search. The email will contain the following Loop makeup information: composition of the Loop material; location and type of pair gain devices, the existence of any terminals, such as Remote Terminals or digital loop terminals, Bridged Tap, and load coils; Loop length, and wire gauge. In the case of Loops served by digital loop carrier, the email will provide the availability of spare feeder and distribution facilities that could be used to provision service to the End User, including any spare facilities not connected to the Switch and Loop makeup for such spare facilities. After completion of the investigation, CenturyLink will load the information into the Loop Facilities Assignment and Control System database, which will populate this Loop information into the fields in the Loop qualification tools. 2.0.4.2 Upon Customer request, CenturyLink will provide Customer with the results that exist in the trouble ticket database of any mechanized loop test CenturyLink may have previously conducted in the provisioning of the WAL. If the requested information exists, CenturyLink will provide this information to Customer via email within 48 hours of CenturyLink's receipt of Customer's request for this information.

SBCT may use the ADSL Loop Qualification tool to pre-qualify the requested circuit utilizing the existing telephone number or address to determine whether it meets ADSL specifications. The qualification process screens the circuit for compliance with the design requirements specified in Technical Publication 77384. 9.2.2.8.2 Raw Loop Data Tools. Qwest offers two (2) types of Raw Loop Data Tool. If SBCT has a digital certificate, SBCT may access the Wire Center Raw Loop Data Tool via xxx.xxxx.xxxxx.xxx. The Wire Center Raw Loop Data Tool provides SBCT the following information: Wire Center CLLI code, cable name, pair name, terminal address, MLT distance, segment (F1, F2), sub-segment (e.g., 1 of F1), segment length, segment gauge, bridged taps length by segment, bridged taps offset distance, load coil type, and pair gain type. SBCT may also access the IMA Raw Loop Data Tool for Loop specific information. The IMA Raw Loop Data Tool may be accessed through IMA-GUI or IMA-EDI. This tool provides SBCT the following information: Wire Center CLLI code, cable name, pair name, terminal address, MLT distance, segment (F1, F2), sub-segment (e.g., 1 of F1), segment length, segment gauge, bridges taps length by segment, bridged taps offset distance, load coil type, number of loads, and pair gain type. 9.2.2.8.3 POTS Conversion to Unbundled Loop Tool. The POTS Conversion to Unbundled Loop Tool is available to SBCT through IMA-GUI or IMA-EDI. This tool informs SBCT whether the facility is copper or pair gain and whether there are loads on the Loop. 9.2.2.8.4 MegaBit Qualification Tool. The MegaBit Qualification Tool is available to SBCT through IMA-GUI or IMA-EDI. This tool provides a "yes/no" answer regarding the Loop's ability to support Qwest DSL (formerly MegaBit) service. If the MegaBit Qualification Tool returns a "no" answer, it provides a brief explanation.

CONTRACTOR shall ensure that all staff are appropriately credentialed to provide instruction and services to students with the disabling conditions placed in their program/school through documentation provided to the CDE (5 CCR 3064 (a)).

  • Tax-Free Qualification (a) Each of Trident, Parent and Merger Subs shall use its respective reasonable best efforts to, and cause each of their respective Subsidiaries to, (i) cause the Mergers, taken together, to be treated as an “exchange” described in Section 351(a) of the Code, (ii) cause the Trident Merger to qualify as a “reorganization” within the meaning of Section 368(a) of the Code and (iii) to obtain the opinion of counsel referred to in Exhibit C (including by taking the actions described in Exhibit C). Each of Trident, Parent and Merger Subs shall use its respective reasonable best efforts not to, and shall use its reasonable best efforts not to permit any of its respective Subsidiaries to, take any action (including any action otherwise permitted by this Section 6.16) that would prevent or impede (A) the Mergers, taken together from being treated as an “exchange” described in Section 351(a) of the Code and (B) the Trident Merger from qualifying as a “reorganization” within the meaning of Section 368(a) of the Code. (b) Sun shall use its reasonable best efforts to, and cause each of its Subsidiaries to, (i) cause the Mergers, taken together, to be treated as an “exchange” described in Section 351(a) of the Code and (ii) to obtain the opinion of counsel referred to in Exhibit C (including by taking the actions described in Exhibit C). Sun shall use its reasonable best efforts not to, and shall use its reasonable best efforts not to permit any of its Subsidiaries to, take any action (including any action otherwise permitted by this Section 6.16) that would prevent or impede the Mergers, taken together, from qualifying as an “exchange” described in Section 351(a) of the Code.
