The chart below lists the facilities surveyed by the Department, the access issues identified during the survey, and the actions required to correct the access issues. Required actions are listed using an alphanumeric code. The key to the alphanumeric codes is provided in Attachment B to this Agreement. In order to ensure that the programs, services, and activities housed in the Rushmore Plaza Civic Center are accessible to persons with disabilities, when viewed in their entirety, the City will take the actions referenced by the alphanumeric code and described in detail in Attachment B to this Settlement Agreement within the time period specified below, which time period begins to run on the effective date of the Agreement.

Main Entrance. Access to or egress from the complex can only be gained by remote control to open the electronically operated security gate. Each unit will be issued with one remote controls which are for the exclusive use of the residents. Loss and or damage of controls will be for the Owners account. The main entrance must be kept closed at all times. The owner/occupants will be obliged to return remote controls or forward to new occupants, failing that to bear the cost for replacement and resetting of codes. In the event of power supply failure, the entrance gate can be operated by a device that is in storage at the Guard House and which can be obtained from the Caretaker or a Trustee.
