The BLM acknowledges that the Cooperator’s handling of these materials may be impacted by Colorado Open Records Act. The Parties agree that the BLM at its discretion may withhold from the cooperator those documents that would otherwise be available for public release under Colorado Open Records Act.

Management of Information. The Cooperator acknowledges that all supporting materials and draft documents may become part of the administrative record and may be subject to the requirements of the Freedom of Information Act (5 U.S.C 552) and other Federal statutes. The BLM acknowledges that the Cooperator’s handling of these materials may be impacted by the Washington Public Records Act, RCW 42.56. The Parties agree that the BLM, at its discretion, may withhold from the Cooperator those documents that would otherwise be available for public release under the Washington Public Records Act. The Parties also agree that the San Xxxx Island National Historical Park, at its discretion, may withhold from the BLM those documents that would otherwise be available for public release under the Freedom of Information Act and other Federal statutes. Information withheld or otherwise not submitted cannot be considered in the San Xxxx Islands National Monument RMP/EIS process.
Management of Information. EASR requires SEPA to maintain a publicly available register of information relating to the regulation of radioactive substances. SEPA will hold information like that required by EASR for civilian sites for MOD sites regulated under this MOU subject to its security classification. The information will be held on a register similar to the civilian equivalent. MOD material classified Official-Sensitive and above will not routinely be released by SEPA or placed on a publicly available register but, where relevant, be held on a register similar to the civilian equivalent and managed in accordance with Her Majesty’s Government Security Policy Framework and MOD’s Defence Manual of Security (Joint Service Publication 440). 7 This does not imply a requirement for defined periodic review or formal communication with SEPA that such measures have been applied. This is intended to be a declaration by MOD that such measures will be applied to any design changes or new designs. 8 MOD POC is via email to xxx-xxx@xxx.xxx.xx; SEPA POC is via email to xxx@xxxx.xxx.xx . SEPA will be provided, where practical, with access to security classified information on a MOD site rather than retain the information at SEPA or other premises.
Management of Information. The NPS acknowledges that all data and information provided will become part of the NRC’s official record. NRC will respond to any Freedom of Information Act (FOIA) requests regarding this action in consultation with NPS. NRC will keep confidential, to the extent permitted under FOIA and other applicable laws, all pre-decisional or other privileged documents shared with NRC by the NPS. The NPS agrees that working draft documents for the development of the Turkey Point SEIS will not be made available for review by individuals or entities other than the Parties to this MOU. The NPS agrees to consult with NRC’s FOIA officer in response to any FOIA requests regarding this action and refer to NRC portions of any FOIA request that pertain to records provided by NRC.
