Marine. For receipts and deliveries to or from marine vessel at Vancouver, custody shall pass at the flange where TLO’s facility interconnects with the hoses connected to the marine vessel; for receipts and deliveries to or from marine vessel at Anchorage, custody shall pass at the flange where TLO’s facility interconnects with the Port of Anchorage Valve Yard.
Marine. For Marine Vessel movements by the following (in order of preference), subject to Operator’s reasonable discretion to choose an alternative method: (i) by meters; (ii) by static shore tank gauges of the tank; otherwise (iii) by a mutually agreeable method. The custody transfer quantity shall not be determined by vessel gauges or bills of lading unless otherwise mutually agreed to in writing by Customer and Operator. Customer shall provide Operator with all reasonable documentation with respect to the volumes throughput across the Berths, including but not limited to, inspection reports, meter tickets or other similar documentation within three (3) Business Days of completion of Marine Vessel discharge.
Marine. For marine movements by the following (in order of preference), subject to Operator’s reasonable discretion to choose an alternative method: (i) by meters; (ii) by shore tank gauges of the tank; otherwise (iii) by a mutually agreeable method. The custody transfer quantity shall not be determined by vessel gauges or bills of lading unless otherwise mutually agreed to in writing by Customer and Operator.
Marine. Transportation by sea of property funded under the Grant Agreement shall be on U.S. carriers in accordance with U.S. cargo preference law.
Marine. The Company shall not indemnify the Insured
(a) against any loss in respect of Property Insured that is insured by, or would, but for the existence of this Policy, be insured by any marine policy/ies, except in respect of any excess beyond the amount which would have been payable under the marine policy/ies had this insurance not been effected;
(b) under Section 3 in respect of any loss arising under any marine, aviation, transit policy or any motor certificate or policy.
Marine. (a) AMI CONVEYED CONTRACT. Purchaser acknowledges that certain ARCO Marine employees are currently responsible for the management and oversight of the AMI Conveyed Contract and the construction program implemented pursuant thereto. Purchaser agrees that during the period beginning on the ARCO Marine Transfer Date and ending on the Second Closing Date, Purchaser shall, and shall cause ARCO Marine (i) to continue to manage and maintain oversight of the AMI Conveyed Contract and the construction program implemented pursuant thereto in a manner consistent with the practices of ARCO Marine prior to such delivery of the ARCO Marine Shares and (ii) not to amend the engineering design, construction process or any terms of the AMI Conveyed Contract without the prior written consent of AMI.
Marine. 22.3.1 The parties agree that the status quo for the MV Gallantry will remain for the life of the Agreement.

Marine. Xxxxx ETB is in the process of developing a new Marine Engineering Traineeship and a Marine Centre
Marine. (a) Notices--Notice of estimated time of arrival (ETA) and name of vessel or barge tow shall be given to receiving or loading party a reasonable time before arrival at port. Any change in ETA shall be reported promptly. If a berth is not available for the latest ETA, a berth will be scheduled for the next earliest time a berth is open on the dock's schedule. Upon arrival in port, notice of readiness to load or discharge shall be given, with allowed free time being three hours for barge tows and six hours for vessels. Laytime shall commence at the earlier of becoming all fast at berth or at expiration of the three or six hour period, as appropriate.
(b) Berth--Barge tow or vessel shall not exceed the maximum draft or length allowed by dock operator. Receiving or loading party shall provide a berth that tow or vessel may safely proceed to, lie at always afloat, and safely depart from. Receiving or loading shall be done within the time, or at the rate, agreed to by the parties. Seller shall pay wharfage fee, if any. Buyer shall pay all fees or charges assessed against a vessel or barge.
(c) Demurrage--Seller shall be liable for demurrage directly caused by Seller's sole fault. Buyer shall be liable for all other demurrage.
