Mechanical Failure. Whenever, as a result of the unavailability of appropriate District vehicles due to mechanical or other malfunctions, a bus driver regularly scheduled to work is unable to work, the driver shall receive pay at the rate the driver would have received for working that day, or be assigned alternate tasks.

AAF shall reimburse FECR (within 30 days of receipt of an invoice therefor) for the cost of rendering such assistance in connection with a train operating in Passenger Service. If it becomes necessary for FECR to make repairs to disabled or defective AAF locomotives or cars in order to move them off the Shared Infrastructure, FECR shall arrange for such work to be done, and AAF shall reimburse FECR for the cost thereof. AAF trains assisted or moved by FECR pursuant to this Section 3.10 shall at all times remain AAF trains for purposes of Section 7 of this Agreement.

Mechanical Failure. The cost of mechanical or other physical damage repair is deemed to be included within the cost of the "wet rate" paid for apparatus. There is no reimbursement for these costs. Examples: • Mechanical breakdowns, including major items (e.g., motor, transmission, differential). • Body damage, minor (e.g., scratched paint from brush and trees, or damage sustained running through fences) or major (e.g., body and fender damage). • Cost incurred due to incidental loss or damage to apparatus, equipment, or personal property are not reimbursable. • Cost of temporary replacement for lost or damaged apparatus, equipment, or personal property (e.g., rental expense) while permanent repairs or replacement are being pursued is not reimbursable.
Mechanical Failure. If the vehicle suffers a mechanical failure,that is the fault of the renter, during the rental time period, the renter will be fully responsible for the costs associated with retrieval and repair of the vehicle. Additionally, the renter will pay the full rental rate covering the lost revenue due to the vehicle being out of service during its repair period. Ridge Mountain Rentals llc will not be liable for missed appointments, changed plans, vacation interruptions, or any other expenses caused by a mechanical failure. Examples of renter fault: wrecking of the vehicle, putting in the wrong gas that would cause engine issues, etc. The renter will not be responsible for mechanical failure that is the fault of the owner, Ridge Mountain Rentals, llc.
Mechanical Failure. Equipment made inoperative by breakdowns or failures caused by everyday use. Maintenance, cleaning and cosmetic appearance are not mechanical failures (e.g., cleaning an air conditioning coil is considered maintenance).
