Method of Making Appointments. (a) In filling vacancies, appointment shall be made of the applicant with the greatest seniority from among those meeting the required qualifications to perform the duties of the position. Both parties recognize the principle of promotion within the service of the Employer and that job opportunity should increase in proportion to length of service. When the successful applicant is an internal applicant, the appointment shall be made within thirty (30) days of the closing of the posting. Where the Employer finds that it is not possible to make the appointment within thirty (30) days, they will consult with the Union. (b) The National Officers shall select the successful applicant and shall inform the unsuccessful applicant(s) in writing, setting out the basis for being denied the position. The successful applicant shall be provided with necessary training that will better himself/herself in the discharge of the position's duties. (c) At the time a permanent position is posted, temporary employees shall be credited with seniority pursuant to Article 10.02 (b) for the purpose of appointment or promotion to that position. Further if no longer in the employ of CUPE they may use their accumulated seniority to bid for a posted vacancy for a period of up to eighteen (18) months following the termination of their last appointment. (d) The senior qualified applicant will be appointed to the position provided they agree to take up/assume the position within 3 months from date of notification that they are the successful applicant, pending CUPE’s operational requirements. (e) A temporary employee, upon appointment to a permanent position within the CSU bargaining unit must remain in that position for one (1) calendar year. This does not prevent such employee from being considered the successful applicant for any other position within the CSU bargaining unit, prior to the completion of the calendar year. If successful, the employee will not move to the position until the completion of the year.

If successful, Grievances resulting from the employee will not move application of this clause shall be filed in writing to the position until the completion Em- ployer within fifteen (15) working days of the yearnotification of the Employer's decision.

The successful applicant shall be placed on probation for a period of 1 month. Conditional on satisfactory service, such trial promotion shall become permanent after the period of 1 month. In the event the successful applicant proves unsatisfactory in the position during the aforementioned trial period, he/she shall be returned to his/her former position without loss of seniority or salary, and any other employee promoted or transferred because of the rearrangement of positions shall also be returned to his/her former position without loss of seniority or salary. b) Should an employee be absent from the work place, on an approved leave of absence, when a temporary job opportunity of 2 months or greater duration is posted, and an employee has advised her/his supervisor, in writing, prior to going on leave, that he/she intends to apply for said posting, the employee’s application will be deemed to have been received by the Employer. If the employee is the successful applicant, he/she must return from leave of absence to commence work in the position within thirty (30) 10 days of the closing of the posting. Where the Employer finds that it is not possible to make the appointment within thirty (30) days, they will consult with the Unionposing. Where an existing employee is promoted into a new position provided they agree and where the Employer require his/her former position to take up/assume the position within 3 months from date of notification that they are the successful applicant, pending CUPE’s operational requirements. (e) A temporary employee, upon appointment to a permanent position within the CSU bargaining unit must remain in that position for one (1) calendar year. This does not prevent such employee from being considered the successful applicant for any other position within the CSU bargaining unit, prior to the completion of the calendar year. If successfulbe filled, the employee will not move shall remain in his/her former position until a successful applicant is appointed to fill the former position. The Employer must post the former position immediately upon appointing the former incumbent to his/her new position. Upon appointment of his/her successor to the position until former position, in accordance with the completion terms of Article 9, the former incumbent shall immediately be appointed to his/her new position. d) The time limits indicated in 9.03 (a), (b) and (c) can be extended by mutual agreement of the yearparties.
