Minimum Proficiency Levels. ACS Key Personnel, and all other personnel assigned by ACS or its Subcontractors to perform ACS’ obligations under this Agreement, shall have experience, training and expertise sufficient to perform ACS’ obligations under this Agreement including, without limitation, ACS’ obligations with respect to the SLRs. Whenever ACS and/or an ACS Subcontractor indicates that a Person has a specific level of experience or expertise, such Person shall in fact possess such experience and expertise. Symetra shall not be required to pay for Services provided by any Person who does not possess the promised levels of experience and expertise.

Minimum Proficiency Levels. Provider's Key Personnel, and all other personnel assigned by Provider or its Subcontractors to perform Provider's obligations under this Agreement, shall have experience, training, and expertise at least equal to the highest commercial standards applicable to such personnel for their responsibilities in the business of providing telecommunications services. Such personnel shall also have sufficient knowledge of the relevant aspects of the Services and of the State's practices and areas of expertise to enable them to properly perform the duties and responsibilities assigned to them in connection with this Agreement. In addition, the Services shall conform to the highest commercial standards applicable to such Services in the telecommunications services marketplace.

In addition, the Services shall conform to reasonable commercial standards applicable to such Services in the business in which Client is engaged.
Minimum Proficiency Levels. Vendor Personnel, including Key Personnel, shall have experience, training, and expertise at least equal to prevalent industry standards applicable to such personnel for their responsibilities in the business in which Vendor is engaged and shall have sufficient knowledge of the relevant aspects of the Services and Garland ISD’s practices and areas of expertise to enable them to properly perform the duties and responsibilities assigned to them in connection with the Agreement. In the event of a breach by Vendor of its obligations in respect of the minimum proficiency levels of Vendor Personnel, Vendor shall promptly take one or the other (as reasonably directed by Garland ISD) of the following actions: (i) remove and replace any Vendor Personnel after receipt of notice from Garland ISD that such Vendor Personnel does not meet the required minimum proficiency levels; or (ii) take appropriate action in respect of any such Vendor Personnel, including, but not limited to, training to bring such Vendor Personnel’s proficiency levels in line with such required minimums.
Minimum Proficiency Levels. Both Provider Employees and all other employees of the Subcontractors shall have experience, training, certifications and expertise sufficient to perform the Provider's obligations under this Agreement and shall in any event possess such levels of experience, training, certifications and expertise which is equal to or greater than the average levels of experience, training, certifications and expertise of other outsourcing service providers or of Provider or Provider Affiliate Employees holding corresponding positions. On request, Provider shall provide to Service Recipient proof of any Employee or Subcontractor's employee training, experience, certification or expertise. Service Recipient shall not be required to pay for Services provided by any Employee who does not possess the promised or specified levels of experience, training, certification and/or expertise.

Minimum Proficiency Levels. Torch's personnel and the personnel of subcontractors shall have knowledge, experience, training, and expertise at least equal to good commercial standards applicable to such personnel for persons of their responsibilities to enable them to properly perform the duties and responsibilities assigned to them in connection with the Service Agreements. In addition, the Services shall conform to industry standards applicable to such Services. All personnel for a Party shall abide by the workplace rules and regulations of another Party while at another Party's facility.

In addition, the Services shall conform to good commercial standards applicable to such Services in the business in which Supplier, or its subcontractors, as the case may be, are engaged.
