Minimum Scope. At all times during the Term, you shall be obligated to pay for not less than the Record Count, Authorized Users and scope listed in the Order Form. We will bill you, and you shall promptly pay, for any additional Record Count, Authorized Users and scope. No adjustment in fees shall be made for any decrease in number of Record Count, Authorized Users, or scope. As used in this Section 16, “Authorized User” or “User” means the individuals concurrently logged in or the named users, as applicable, with User IDs who are employed or contracted by you and authorized to access and use the Products and Services, subject to and in accordance with this Agreement.
Minimum Scope. Coverage shall be provided on a builder's risk insurance policy on an "all risk" basis. Such coverage may be provided under a master builder’s risk program or may be provided under a project-specific policy, whichever provides the broadest coverage. Such insurance shall be on a replacement cost basis using a completed value form reasonably acceptable to the Authority to ensure adequacy of terms and sublimits. The policy shall cover all property, roads, buildings, bridge structures, other structures, fixtures, materials, supplies, foundations, pilings, machinery and equipment that are part of or related to the portions or elements of the Project, and the works of improvement, including permanent and temporary works and materials, and including goods intended for incorporation into the works located at the Project Right of Way, in storage or in the course of transit to the Project Right of Way and all improvements that are within the Project Right of Way. The policy shall not cover tools or equipment used by any contractor to perform their work. Such tools and equipment are the sole responsibility of the contractor who owns or uses such tools. The builder’s risk policy must include coverage for:  Any ensuing loss from faulty workmanship or nonconforming work;  Machinery accidents and operational testing, if applicable;  Removal of debris, with a sub-limit of 25 percent of the loss or a sublimit of no less than $20,000,000, and insuring the buildings, structures, machinery, equipment, materials, facilities, fixtures and all other properties constituting a part of the Project;  Transit, including ocean marine coverage (unless insured by the Supplier or through a separate marine cargo policy), with sub-limits sufficient to insure the full replacement value of any key equipment item;  Sub-limits sufficient to insure the full replacement value of any property or equipment stored either on or off the Site;  Collapse;  Terrorism;  Earthquake;  Flood;  Plans, blueprints and specifications; and  Demolition and increased cost of construction as required by law or ordinance with a sub- limit of no less than $20,000,000 There shall be no coinsurance penalty provision in any such policy.   • Minimum scope of coverage Commercial general coverage shall be at least as broad as Insurance Services Office Commercial General Liability occurrence form CG 0001 (ed. 11/88) or Insurance Services Office form number GL 0002 (ed. 1/73) covering comprehensive General Liability and Insurance Services Office form number GL 0404 covering Broad Form Comprehensive General Liability. Automobile coverage shall be at least as broad as Insurance Services Office Automobile Liability form CA 0001 (ed. 12/90) Code 1 (“any auto”). No endorsement shall be attached limiting the coverage.

  • Minimum Staffing The Employer agrees to employ sufficient registered staff and health care aides/ Personal Support Workers to meet the staffing needs that may be set from time to time by statute and/or regulation. In the event that there is insufficient staffing to meet this undertaking, the Employer will post vacancies so that any unmet care undertaking will be satisfied. (a) The Employer will assign at least the same number of total bargaining unit RN hours that are equal to those hours that were scheduled in the last week ending prior to June 30, 2009. (b) In the event the Employer cannot meet their ongoing obligation for scheduled RN hours in part (a) above, it shall so notify the Union and fully disclose the reasons thereof. (c) If the failure to staff is a legitimate recruitment issue, there shall be no violation of this Agreement. The Employer will make reasonable efforts to recruit a replacement and will provide the Union with an outline of recruitment activities. (d) Further, if there is a reduction in beds, occupancy levels or CMI or its equivalent below the levels in effect as of June 30, 2009, a reduction in the complement shall not constitute a breach of this Agreement, as long as the reduction is proportionate. (e) If there is any other reason for the failure to staff in accordance with this article, the Union and Employer will attempt to find a resolution and if unable to do so, the matter may be referred to Arbitration. (f) The Arbitrator/Arbitration Board will have authority to determine whether the reduction in staffing was appropriate and shall have jurisdiction to award an appropriate remedy.

  • Minimum Shipping Requirements for TIPS Sales Vendor shall ship, deliver, or provide ordered goods and services within a commercially reasonable time after acceptance of the order. If a delay in delivery is anticipated, Vendor shall notify the TIPS Member as to why delivery is delayed and provide an updated estimated time for completion. The TIPS Member may cancel the order if the delay is not commercially acceptable or not consistent with the Supplemental Agreement applicable to the order.

  • MINIMUM ORDER QUANTITY The State makes no commitment to purchase any minimum or maximum quantity, or dollar volume of products from the selected suppliers. Utilization of this agreement will be on an as needed basis by State Agencies and/or Cooperative Participants, Cities, Counties, Schools K-12, Colleges and Universities.   • Minimum Standards (a) It is intended that the provisions contained in the Employment Standards Act and Regulations (Act), presently in effect and from time to time amended, are minimum requirements only.
