Miscellaneous Uses. The BBC will have the right without further payment to make and use (and authorise the making and use of) copies of scripts or Programmes based on the Format for: 1 the private purposes of the BBC (including staff training) or for purposes necessary to give effect to this Agreement but without prejudice to the payment provisions hereof; 2 televising by the BBC of brief excerpts from the scripts in programmes relating specifically to the history of the BBC; 3 deposit, if the recording is considered of permanent interest, with the National Film Archive (being part of the British Film Institute) and with similar archive-holding bodies for preservation purposes and for private study by bona fide students; 4 showing at television and film festivals and award ceremonies and in accordance with the Agreement from time to time between the Performers’ Alliance and the British Film Institute; 5 publicity and promotional purposes in all media now known or hereafter devised or discovered and for the purpose of technical trials; 6 making dubbings of the recordings into foreign languages and/or to add foreign language sub-titles for the purposes of effecting sales; 7 making and broadcasting adaptations in the form of English language teletext subtitles or sign language (by any means whether now known or hereafter invented) for the purpose of assisting those viewers with hearing disabilities; 8 making broadcasting and exploiting programmes incorporating the script which contain descriptions of a performance of the script on a separate audio channel (by any means whether now known or hereafter invented) in the form of an audio description of the visual elements of the programmes incorporating the Script for the purpose of assisting those who are visually impaired;

For clarity the BBC will also have the right without further payment to translate record abridge and adapt the Work for all purposes under this Agreement and to make all uses of the Work permitted under the Act.

Miscellaneous Uses o Wildlife Habitat o Harvesting o Commerce/Navigation o Boating o Aesthetics Temperature Criteria Temperature levels fluctuate over the day and night in response to changes in climatic conditions and river flows. Since the health of aquatic species is tied predominantly to the pattern of maximum temperatures, these criteria are generally expressed as the highest 7-day average of the daily maximum temperatures (7-DADMax) occurring in a waterbody. In the Washington State water quality standards, aquatic life use categories are described using key species (e.g., salmon, warm-water species) and life-stage conditions (e.g., spawning, rearing, migration) [WAC 173-201A-200]. WAC 173-201A-602 (Ecology 2012) notes the following special criteria for the Yakima River from mouth to Cle Elum River (river mile 186). Temperature shall not exceed a 1-DMax of 21.0°C due to human activities. When natural conditions exceed a 1-DMax of 21.0°C, no temperature increase will be allowed which will raise the receiving temperature by greater than 0.3°C; nor shall such temperatures, at any time, exceed t = 34/(T+9). Washington State uses the criteria described above to ensure that where a waterbody is naturally capable of providing full support for its designated aquatic life uses, that condition will be maintained. The standards recognize, however, that not all waters are naturally capable of staying below the fully protective temperature criteria. When a waterbody is naturally warmer than the above described criteria, the standards provide an allowance for additional warming due to human activities. In this case, the combined effects of all human activities must also not cause more than a 0.3°C (0.54°F) increase above the naturally higher (inferior) temperature condition.

If any provision of this Agreement shall be determined to be invalid or unenforceable under any rule, law, or regulation of any governmental agency, local, state, or federal, the validity or enforceability of any other provision of this Agreement shall not be affected. This Agreement will be governed by the law of the State of Delaware except to the extent governed by federal law.
