MISUSE OF SICK LEAVE BENEFITS. In order that maximum benefits may be provided to all employees in time of valid need, it is imperative that controls be exercised to avoid the misuse of sick leave. An employee who attempts to take unfair advantage of sick leave benefits shall be subject to dismissal or other disciplinary action. In a situation where an employee’s absence extends for a period of three (3) consecutive workdays or longer, certification of the medical condition causing the absence and the employee’s ability to return to work, as provided under FMLA, may be required in order to approve a request for use of sick leave and subsequent return to work.
