Common use of Modified Workweek Clause in Contracts

Modified Workweek. Where there is mutual agreement between the Union's designate and the Commission’s designate at the local level for a modified workweek, work schedules may be arranged on one of the following basis and do not apply to employees on flextime pursuant to Clause 15.7: (a) All schedules assume that Statutory Paid Holidays as per pursuant to Article Clause 17.1 are not worked. (3) It is understood that the implementation of modified workweek work schedules is dependent on receiving confirmation from the Commission prior to implementation. (4) There shall be equitable rotation of the earned days off as mutually agreed at the local level. (5) Pursuant to Clause 15.3(b) of the agreement, for vacation purposes employees shall remain on the agreed work schedules and vacation entitlement shall be converted to hours. The scheduled daily hours shall be deducted from the vacation entitlement for each day of vacation taken. (6) Pursuant to Clause 15.3(c) of the agreement, any shortfall arising from designated paid holidays falling within the schedule shall be scheduled by mutual agreement when the schedule is drawn up. If an employee chooses not to work the scheduled shortfall, the hours can be transferred from vacation entitlements when the schedule is drawn up. (1) The earned surplus day off, pursuant to "i" above, is scheduled by mutual agreement at the local level on Monday to Friday; or (2) Is scheduled by mutual agreement within the applicable cycle in(c) (1) above. (1) Where as a result of Article Clauses 15.11(a)(i) and 15.11(a)(iv) surplus days off are to be scheduled in when the schedule is drawn up, subject to operational requirements and to any vacation entitlements arising from preferences gained by seniority. (2) Notwithstanding (1) above, up to seven surplus days may be taken with the employee’s first vacation entitlement at the employee’s option, subject only to vacation entitlements arising from preferences gained by seniority. All remaining surplus days shall be scheduled in when the schedule is drawn up. (e) Employees may exchange days off with the Employer’s approval providing there is no increased cost to the Employer. (f) If at the end of each annual schedule, or upon termination, an employee has taken more surplus days off than earned, the Commission will recover the additional monies paid as a result. (g) Effective January 1/21, Modified Workweek banks will be included on employee self-service entitlement lists. (h) Employees working in a position with a flextime schedule, pursuant to Clause 15.7, who accept a temporary assignment that qualifies for a modified workweek schedule, pursuant to Clause 15.11, will switch to the new schedule for the length of the temporary assignment.

(5) 16 day cycle - the workday shall be seven hours and 30 minutes. (i) This schedule requires an employee to work 15 days then take their modified day off on the 16th day. The earned day off is scheduled on a different successive day each time through the rotation. For example, on the first rotation the modified day off is Monday, then the next rotation it is Tuesday, etc. (ii) This results in working an extra 8.5 hours per pursuant year, less 6 hours required to Article Clause 17.1 are not worked. If an employee chooses not to following methods: (i) Employees may work additional time each day as part of their work schedule; (ii) Full-time employees may work the scheduled difference in hours anytime during the pay period in which the statutory holiday falls; (iii) An employee may work the entire shortfall for the year at the beginning of the calendar year; (iv) An employee may use any banked ETO, CTO, vacation or other banked time to cover the shortfall, the hours can be transferred from vacation entitlements when the schedule is drawn up. (1) The earned surplus day off, pursuant to "i" above, off is scheduled by mutual agreement at the local level on Monday to or Friday; or (2) Is is scheduled by mutual agreement within the applicable cycle in(c) in (1a) above.
