NES. Paid family and domestic violence leave is as provided for in the NES except where this Agreement provides ancillary or supplementary terms.
NES. Parental leave is as provided for by the NES except where this Agreement provides ancillary or supplementary terms.
NES. Prior to Closing, Seller shall cause NOARK to divest or otherwise transfer all of its equity interests in NES to either Seller or one of Seller’s Affiliates (other than any member of the NOARK Group) without any indemnification or other residual liability on the part of any of the NOARK Group. For the avoidance of doubt, neither NES nor the equity interests in NES shall be considered part of the NOARK Group or the Business at any time.
NES. The divestment of NES contemplated by Section 5.20 shall be complete.
NES. Should any term of this Agreement be less favourable to the Employees than the NES, the NES will prevail over the term of this Agreement to the extent that the term of this Agreement is less favourable.
NES. This clause provides for enterprise specific detail and supplements the NES that deals with annual leave.

NES. (a) Redundancy pay is provided for in the NES. This clause provides enterprise-specific details and supplements the NES.
(b) The following redundancy pay scale will apply instead of the provisions provided in the NES: Less than 1 year Nil 1 year and less than 2 years 4 weeks 2 years and less than 3 years 6 weeks 3 years and less than 4 years 7 weeks 4 years and less than 5 years 8 weeks 5 years and less than 6 years 10 weeks 6 years and less than 7 years 12 weeks 7 years and less than 8 years 14 weeks 8 years and less than 9 years 16 weeks 9 years and less than 10 years 18 weeks 10 years and over 20 weeks
NES. (a) The NES apply to Employees as a minimum standard.
(b) This Agreement shall be read and interpreted in conjunction with the NES provided that where there is any inconsistency between this Agreement and the NES, the more beneficial provision to an Employee will take precedence.
(c) In summary, the NES covers the following entitlements:
(i) maximum weekly hours;
(ii) requests for flexible working arrangements;
(iii) offers and requests to convert from casual to permanent employment;
(iv) parental leave and related entitlements;
(v) annual leave;
(vi) personal/xxxxx’s leave, compassionate leave and family and domestic violence leave;
(vii) community service leave;
(viii) long service leave;
(ix) public holidays;
(x) superannuation;
(xi) notice of termination and redundancy pay; and (xii) provision of Information Statements.
