Common use of Night Duty Clause in Contracts

Night Duty. Employees shall be paid a premium of 10% of the straight time hourly base rate of pay for each hour regularly assigned between 5:00 P.M. and 7:00 A.M., if the employee works at least one (1) hour of the employee’s regularly scheduled shift between 5:00 P.M. and 7:00 A.M., excepting those employees participating in an authorized flex-time program and who voluntarily work between the hours of 5:00 P.M. and 7:00 A.M. Shift pay of 10% shall be paid for the entire shift, provided at least five (5) hours of the employee's shift falls between 5:00 P.M. and 7:00 A.M.

Shift pay The above night shift compensation shall only apply when employees are required, as part of 10% shall be paid for the entire their regularly scheduled work shift, provided to work at least five one (51) hour of their shift between the hours of the employee's shift falls between 5:00 P.M. and 7:00 A.M.
