NOTIFICATION TO CLASS MEMBERS. A. Unless otherwise specified, Defendant will pay all costs related to the following notice program (subject to the Court approving the same, notice dissemination will be commenced within ninety (90) days after entry of the Preliminary Approval Order):
1. Defendant will retain a third party to obtain mailing addresses from the applicable state motor vehicle agencies’ registration databases to identify the last known addresses of all Settlement Class Members and provide the mailing addresses to the Claims Administrator.
2. The Claims Administrator or the DMV records provider will use current U.S. Postal Service software and the National Change of Address database to update the address records so that Settlement Class Members’ most recent addresses will be used to provide a Settlement Class Notice to those Settlement Class Members by a direct first-class mailing. If a Settlement Class Notice is returned to the Claims Administrator by the U.S. Postal Service because the address of the recipient is no longer valid, and the envelope contains a forwarding address, the Claims Administrator will re-send the Settlement Class Notice to the forwarding address within seven (7) days of receiving the returned Settlement Class Notice.
B. Within seventy-five (75) days after entry of the Preliminary Approval Order, the Claims Administrator will be responsible for, without limitation: (a) establishing, maintaining, and administering a toll-free telephone number dedicated to the Settlement which will provide information about the Settlement and (b) establishing and maintaining a website dedicated to the Settlement which (i) will provide information about the Settlement and all relevant documents, including the Claim Form available for download; (ii) an email address for Class Members to ask the Claims Administrator questions; and (iii) will provide an online claims submission portal and instructions on how Settlement Class Members may submit their claims by U.S. Mail or via an online submission portal. The website and toll-free telephone number will remain available until all claims decisions by the Claims Administrator and payment to claimants have been made.
C. Within ninety (90) days of the Preliminary Approval Order, or such longer period as may be required due to a delay in securing registration data from one or more state motor vehicle agencies, the Claims Administrator will disseminate Settlement Class Notice to the Settlement Class as specified in the Preliminary App...
NOTIFICATION TO CLASS MEMBERS. 1. The Parties shall appoint Atticus Administration, LLC, 0000 Xxxxxxxxx Xxxxx, Xxxxx 000, Xxxxxxx Xxxxxxx, Xxxxxxxxx 00000, to serve as the Settlement Administrator who will fulfill various duties described more in detail below including implementing the terms set out in this Settlement Agreement and the Notice Program.
NOTIFICATION TO CLASS MEMBERS. The Settlement Administrator shall notify each person who submitted a claim form but is not determined to be an authorized claimant of the basis for that determination. Once the settlement checks have been provided to all Authorized Claimants, the Settlement Administrator shall post a notice on the settlement website stating that all consideration due under the settlement has been paid.

NOTIFICATION TO CLASS MEMBERS. 20. Unless otherwise specified, Defendants will pay all costs related to the notice program. Subject to the Court’s approval of the notice program, notice dissemination will be commenced within sixty (60) days after entry of the Preliminary Approval Order.
A. Details of the notice program are set forth in the Declaration of Xxxxxx Xxxxxxxx, Esq. of Angeion Group, LLC, which will be attached to the Memorandum in Support of Preliminary Approval. Generally speaking, the notice program will consist of direct email notice to purchasers of All-Clad Cookware and a digital (online) notice program, targeted to potential members of the class, and designed to reach or exceed 70% of the target audience. Direct email notice will be accomplished using email addresses contained in All-Clad’s registration records and email addresses provided to the Claims Administrator by All-Clad’s authorized retailers, as well as email notice from several of All-Clad’s All-Clad’s authorized retailers directly to their customers. All-Clad’s authorized retailers participating in the notice program include Amazon; Bed Bath & Beyond; Macy’s; Bloomingdale’s; Crate & Xxxxxx; and Xxxxxxxx-Sonoma.
B. Contents of the Settlement Class Notice: The Settlement Class Notice, in a form substantially similar to the one attached to the Settlement Agreement as Exhibit “A,” will advise Class Members of the following:

1. The Settlement Administrator shall implement and administer the Notice. The Settlement Administrator shall be responsible for, without limitation: (i) mailing the Class Notices; (ii) responding to requests for a copy of the Class Notice; (iii) otherwise administering the Notice Program, (iv) distributing payments to the Settlement Class Members including any associated tax reporting, return and filing requirements, (v) and performing such additional duties as the Parties may mutually direct. The Notice Program shall comply with all requirements of applicable law. The Settlement Administrator will maintain an appropriate insurance policy to protect against any violation of its fiduciary duty to the Court, the Settlement Class, Defendant or Class Counsel.
2. The Settlement Website will provide information about the Settlement to the Settlement Class, including notice and claims documents, court documents, and a copy of the Settlement Agreement.

The Settlement Administrator shall be responsible for, without limitation, (i) arranging for notice through publication, television, radio, and billboard; (ii) responding to inquiries in response to the notice; (iii) distributing payments to Class Members; and (iv) otherwise administering the Notice Program. The Notice Program shall comply with all requirements of applicable law. The Settlement Administrator shall maintain an appropriate insurance policy to protect against any violation of its fiduciary duty to the Court, Class Members, and Class Counsel. All costs associated with providing notice and the administration of the Settlement shall be deducted directly from the settlement amount before determining the distribution to the Class. The Settlement Administrator shall maintain separate accounting for funding by the City and its insurer, PE Partners, based on the insured and uninsured time periods; Defendant’s Counsel will inform the Settlement Administrator of these time periods.

1. The Settlement Administrator shall implement and administer the Notice Program.
2. The Settlement Administrator shall be responsible for, without limitation:
(i) mailing the Class Notices; (ii) arranging for the publication of the Summary Notice; (iii) responding to requests for a copy of the Class Notice; (iv) administering the Settlement Website;

1. A list of the VIN numbers of the Class Vehicles, as well as warranty claims for Class Vehicles will be provided to HMA Consumer Affairs Division. A third-party will be retained to search the applicable registration databases to identify the last known addresses of all Class Members.
2. Notice will be provided to those Class Members by one (1) direct first- class mailing and by publication on the Settlement Website established and maintained by the Claims Administrator. The Claims Administrator will re-send returned notices if an address correction or forwarding address appears on the returned envelope.
3. Class Members will be able to submit their claims for reimbursement by U.S. Mail or online, through the Settlement Website.
B. Within sixty (60) days after entry of the Preliminary Approval Order, or such reasonable additional time as the Parties may agree due to unforeseen circumstances, the Claims Administrator will disseminate Class Notice to the Class as specified in the Preliminary Approval Order and herein. The Claims Administrator will also provide, or make available for download through the Settlement Website, a copy of the Notice and Claim Form to any Settlement Class Member who requests the Notice and Claim Form. The Claims Administrator will be responsible for, without limitation:
1. transmitting notice of the Settlement and claims forms to Class Members;
