Nuisance Abatement. The Contractor shall develop a mutually agreed upon documented program with the District to xxxxx and minimize noise, dust, and disruption to normal activities at the existing facilities on the Site, including procedures to control on site noise, dust, and pollution during construction.
Nuisance Abatement. 1. Accepted smoke, emission, and odor abatement practice shall be followed to eliminate all smoke and objectionable odors as required by Article II, Section 2(b).
2. Noise suppression devices shall be used where unusual operating noise can be heard as specified herein more than 150 feet beyond the property line of any parcel as required by Article II, Section 2(a).
Nuisance Abatement. 18.1 The Leasehold shall be used pursuant to all law, and the Lessee shall not cause nuisances prohibited by any law or regulation.
18.2 In any event of a claim against the Lessor due to the breach of the provisions of Section 18.1 above, in addition to any other right of the Lessor pursuant to provision of law, the Lessor shall be entitled to conduct any examination and/or measurement and/or repair and/or any other action it sees fit in order to return things to their previous condition and/or remove the nuisance. Any related expenses incurred by the Lessor shall apply to and be paid by the Lessee. The Lessee hereby undertakes to reimburse any amounts spent by the Lessor as set forth above, plus linkage and interests as set forth in Section 29 below, as of the date the sums are spent and until they have been repaid by the Lessee.
Nuisance Abatement. If the City requests Removal Agency to go on private property to xxxxx a nuisance by removing a vehicle or vehicles, the City accepts full responsibility for entry on the real property, under authority granted by the state, to include any liability for property damages that are not reasonably avoidable by Removal Agency. The City further accepts responsibility for any vehicles so removed, except for any damage caused by the Removal Agency, which is not the direct result of the City requesting the tow.
