Construction Scope of Work. Funds awarded under this agreement will be used for the installation of sedimentation and erosion control measures and site activities to include but not limited to mass grading of the 11.66 acre site, site preparation and installation of new streets and infrastructure necessary to serve the Phase 2 development which consists of approximately seven acres to include sidewalk, storm drainage, water distribution and sanitary sewer collection, street trees, as well as coordination with private utilities for street lights and future utility services. It also includes like improvements to serve the future development on the remaining site. The “Construction Scope of Work” is described more particularly in the construction documents attached to or referenced in the form of construction contract between Site Developer and X.X. Xxxxxxx Infrastructure, LLC (the “Contractor”) attached as Attachment D (the “Construction Contract”). The City has approved the form and content of the Construction Contract, including the contract amount of $3,500,000.00 and has approved the identity of the Contractor, which was selected as the lowest responsible bidder pursuant to a process previously approved by the City. Construction is scheduled to begin by April 15, 2016 with a 180 day overall completion schedule, subject to extension by Site Developer in accordance with the terms of the Construction Contract or otherwise with the prior written approval of the City. The Site Developer will be responsible for managing the day to day activities of the Construction Scope of Work and for overseeing 3rd party professional service providers which will provide specific construction management services and will earn a management fee in the amount of 9% of construction costs. The management fee will be paid pro rata to construction and 3rd party costs approved and submitted with each monthly draw.

Construction Scope of Work. Funds awarded under this agreement will be used for the installation of sedimentation and erosion control measures, demolition and removal of the existing streets and infrastructure, site activities to include but not limited to mass grading of the 19.83 acres site, site preparation and installation of new streets and infrastructure necessary to serve the Phase 1 development which consists of approximately seven acres to include sidewalk, storm drainage, water distribution and sanitary sewer collection, street trees, as well as coordination with private utilities for street lights and future utility services and the removal of contaminated debris as recommended in the Environmental Specifications and Report. The “Construction Scope of Work” is described more particularly in the construction documents attached to or referenced in the form of construction contract between Developer and [ ] (the “Contractor”) attached as [Attachment D] (the “Construction Contract”). The City has approved the form and content of the Construction Contract, including the [contract amount] of [$ ], and has approved the identity of the Contractor, which was selected as the lowest responsible bidder pursuant to a process previously approved by the City. Construction is scheduled to begin June 1, 2012 with a 210 day completion schedule, subject to extension by Developer in accordance with the terms of the Construction Contract or otherwise with the prior written approval of the City. The Developer will be responsible for managing the day to day activities of the Construction Scope of Work and will earn a management fee in the amount of $400,000 The management fee will be paid as follows: 40% of the management fee will be paid upon completion of the site preparation and environmental remediation work on the Phase 1 portion of the site (approximately seven acres at the north end of the site) as detailed in the attached construction schedule (Attachment E); 20% of the management fee will be paid at the 60% completion; 20% will be paid at 80% completion with the remaining 20% paid at substantial completion and approval of as-builts by the City of Durham.
Construction Scope of Work. The construction scope of work shall include the following:  Formation of foundations for Equipment, structures, pipe-racks and pipe tracks, and buildings, including piling and/or soils mixing where required;  Installation of underground piping and drainage systems;  Finished area grading and paving;  Installation of structural components of the Project;  Installation of the vessels, tanks, buildings, and other Equipment;  Installation of the rotating equipment, motors, turbines, compressors, pumps and blowers;  Installation of piping components and systems;  Installation of electrical substations and installation of power distribution Equipment;  Installation of the fire water system extension for Train 3;  Installation of the power and control cabling systems;  Installation of the instrument and control devices and systems;  Installation of telecommunication & security equipment and systems;  Installation of the instrument, control devices and systems and telecommunication & security systems cabling systems;  Installation of Electrical, ICSS, Instrument, Telecom & Security Fiber Optic cabling systems;  Application of paint, insulation, and fireproofing systems;  Installation of permanent plant buildings, roads, security fences;  Installation, maintenance and removal of temporary facilities;  Provision of temporary facilities for the supply of electricity, water, and telephone / communication systems for construction of the works;  Provision of temporary facilities for the disposal of sewage from the construction worksite up to that time that connection to the new sanitary effluent return line to local sewage treatment plant is available; and  Contractor shall ensure temporary strainers or other methods of protecting Equipment are included for all Equipment that is susceptible to damage from construction debris. Contractor shall follow suppliers’ recommendations as to which Equipment this applies as a minimum requirement.  Installation of any piping, structural, civil, mechanical, electrical, instrumentation, control, or telecommunications tie-ins between Train 3 and Trains 1 and 2 or the Common Systems. Upon completion of the construction scope of work, Contractor shall remove from Site all above ground temporary facilities, except for those agreed with Owner to be retained for future stages of Facility development for which Contractor shall be suitably compensated. For underground temporary utilities see section 15.15.3.

D. Contractor shall establish procedures for the protection of all existing structures, equipment, utilities, and other existing improvements, both on-site and off-site. Contractor assumes all risk of loss of vandalism, theft of property or other property damage (“Vandalism”) which occurs at a site at which Contractor is undertaking construction of the Project. Contractor assumes all risk of loss which occurs where Contractor is undertaking construction of the Project from causes due to negligence or misconduct by Contractor, its officers, employees, subcontractors, licensees and invitees. Contractor shall replace District property damaged by such Vandalism or theft or compensate the District for such loss, including payment of out of pocket expenses such as insurance deductibles the District might incur under such circumstances. E. Contractor shall develop a mutually agreed upon program with the District to xxxxx and minimize noise, dust, and disruption to normal activities at the existing facilities at the School Facility, including procedures to control on-site noise, dust, and pollution during construction. F. The District shall cause the appropriate professionals to stamp and sign, as required, the original Construction Documents or parts thereof and coordinate the Project’s design with all utilities.   • OF WORK The normal hours of work for an employee are not a guarantee of work per day or per week, or a guarantee of days of work per week. The normal hours of work shall be seven and one-half (7%) hours per day, and seventy-five (75) hours in any period. The normal daily tour shall consist of seven and one-half hours, exclusive of a one-half hour unpaid meal period. Employees shall be entitled to a fifteen (15) minute paid break during each half of the normal daily tour, at a time designated by the Employer. Employees required for reporting purposes shall remain at work for a period of up to fifteen (15) minutes which shall be unpaid. Should the reporting time extend beyond fifteen ( I 5) minutes however, the entire period shall be considered for the purposes of payment. Requests for change in posted work schedules must be submitted in writing and by the employee willing to exchange days off or shifts and are subject to the discretion of the Administrator or her designate. In any event, it is understood that such a change initiated by the employee and approved by the Employer shall not result in overtime compensation or payment or any other claims on the Employer by an employee under the terms of this t Where there is a change to Daylight Savings from Standard Time or vice-versa, an employee who is scheduled and works a full shift shall be paid for a seven and one-half (7.5) hour tour rather than the actual hours worked. The Employer will endeavour to accommodate requests by employees for specific days off and also requests for changes in posted time schedules once the schedule has been posted. Shift schedules shall be posted two (2) weeks in advance and shall cover a minimum of a four (4) week period. The following shall apply to full-time employees: During each pay period, two (2) consecutive days off will be scheduled. Schedules may provide for more than (5) consecutive days of work, but not more than seven (7) consecutive days of work without days off, as long as four (4) days off are scheduled in each fourteen (14) day period. Except as outlined below, meal time of one-half hour shall be scheduled away from the floor during the employee's shift whether day, evening or night. Where there is only one registered employee on duty, it is recognized that this is not possible. Should an employee be recalled to duty during meal time, additional time shall be provided later in the shift.

  • Project Schedule Construction must begin within 30 days of the date set forth in Appendix A, Page 2, for the start of construction, or this Agreement may become null and void, at the sole discretion of the Director. However, the Recipient may apply to the Director in writing for an extension of the date to initiate construction. The Recipient shall specify the reasons for the delay in the start of construction and provide the Director with a new start of construction date. The Director will review such requests for extensions and may extend the start date, providing that the Project can be completed within a reasonable time frame.
