OBSERVANCE OF CONDITIONS. A. You agree and acknowledge that the due performance and observance of each term and condition contained herein or in the Proposal or Declaration including payment of due premium in advance (upfront and thereafter, as applicable) and other charges, shall be a condition precedent to any of our liability hereunder and to the enforcement thereof by you. B. Any failure or negligence on your part to comply with any of the said terms and conditions may discharge us from our obligation to indemnify you and we shall have the right to repudiate all liability for payment under the Policy.

OBSERVANCE OF CONDITIONS. Observe and perform all conditions attached to any planning permission and keep the Landlord fully and effectually indemnified against all actions proceedings damages penalties costs charges claims and demands whatsoever in respect of the costs of the said application and works and things done in pursuance of the said planning permission and in respect of all breaches (if any) of the said conditions and every part thereof respectively and (without limiting the foregoing) unless the Landlord otherwise directs carry out during the Term all works required to be carried out by a date after its termination as a condition of any planning consent granted during the Term for development commenced during the Term
OBSERVANCE OF CONDITIONS. The due observance and fulfillment of the terms, conditions and endorsements of this Policy by the Insured in so far as they relate to anything to be done or complied with by them shall be conditions precedent to any liability of the Insurers to make payment under this Policy.
OBSERVANCE OF CONDITIONS. The RENTER agrees to examine the premises upon arrival and report any issues and problems as they arise or as they are noticed. The RENTER should also observe the following conditions through the stay: ◦ No parties, weddings or gatherings are allowed without prior written permission from the OWNER. Additional fees will apply. ◦ The RENTER will not allow any waste, misuse or neglect to property of The Villa Mariana from any guests. ◦ The RENTER will not allow glassware around or in the pools and is aware that plasticware is available to guests for use around the pools. • Check-in is after 4:00pm. Check-out is no later than 10:00am. The Villa Mariana is typically rented back-to-back weeks, so the check-in day is typically the same day that another group is checking out, and vice versa. • Early check-ins and late check-outs may be arranged depending upon availability. To ensure the property is properly cleaned and meets quality standards, the OWNER suggests that the RENTER and their guests have alternate plans before 4:00pm on the check-in day. • If another group is checking in at 4:00pm on the same check-out day as the RENTER, a late check-out cannot be granted. If personal belongings are not removed from the home by the check-out time, the refundable security deposit will reflect the following charges: ◦ Up to 12:00pm: $200 ◦ Up to 2:00pm: $400 ◦ Up to 4:00pm: $600 ◦ Later than 4:00pm: $1,000 (no refund) • All charges accrued during the stay must be paid prior to departure. The RENTER agrees to contact the concierge if monies are owed. • The RENTER agrees that all keys and remote controls will be returned to the concierge. For security reasons, lost keys require changed locks throughout the property. The RENTER understands that there will be a $50 non-negotiable fee for each remote control that is not properly returned upon departure and/or a $500 re-keying charge for lost keys. For further instruction, the RENTER agrees to contact the concierge prior to departure.

  • Observance (a) When a holiday specified in Section 1 of this Article falls on a Saturday, the preceding Friday shall be recognized as the holiday. (b) When a holiday specified in Section 1 of this Article falls on a regularly scheduled day off, the employee shall have the choice of receiving an alternate eight (8) hours of compensatory straight time or straight-time pay. Part-time, seasonal, and job share employees will receive a prorated amount of compensatory time or straight-time pay based on the calculation in Section 3(b). (c) However, the Parties recognize that some positions must be staffed on holidays, and that employees in these positions cannot be released from duty on those holidays. Part (a) of this Section shall not apply to employees in these positions and the holiday shall be observed on the actual day specified in Section 1. Employees filling such positions will be notified in writing prior to hiring or when their work assignment is changed that they may have to work on certain holidays.

  • Observance of Law Tenant shall not use the Premises or permit anything to be done in or about the Premises which will in any way conflict with any law, statute, ordinance or governmental rule or regulation now in force or which may hereafter be enacted or promulgated. Tenant shall, at its sole cost and expense, promptly comply with all laws, statutes, ordinances and governmental rules, regulations or requirements now in force or which may hereafter be in force, and with the requirements of any board of fire insurance underwriters or other similar bodies now or hereafter constituted, relating to, or affecting the condition, use or occupancy of the Premises, excluding structural changes not related to or affected by Tenant's improvements or acts. The judgment of any court of competent jurisdiction or the admission of Tenant in any action against Tenant, whether Landlord is a party thereto or not, that Tenant has violated any law, ordinance or governmental rule, regulation or requirement, shall be conclusive of that fact as between Landlord and Tenant.

  • Observance of Laws Observe all laws, rules and/or regulations and further ensure that under no circumstances, the Promoter are held responsible or liable for any liability, whatsoever, for the same.

  • Observance of Holidays The Board of Trustees may establish calendars that observe holidays on dates other than those listed above, or as modified by current institutional practices.

  • Evidence of Compliance with Conditions Precedent The Guarantor shall provide to the Guarantee Trustee such evidence of compliance with such conditions precedent, if any, provided for in this Guarantee Agreement that relate to any of the matters set forth in Section 314(c) of the Trust Indenture Act. Any certificate or opinion required to be given by an officer pursuant to Section 314(c)(1) may be given in the form of an Officers' Certificate.
