Common use of Occupational Illness or Injury Clause in Contracts

Occupational Illness or Injury. ‌ In the event of a leave of absence due to an illness or injury covered by Workers' Compensation, the following shall apply: (A) Employees with less than six (6) months of service who sustain an injury or illness compensable by Workers' Compensation and who are unable to perform their assigned duties will be paid the difference between their regular salary and compensation benefits for lost time at the rate of one day per month of employment. (B) Employees with more than six (6) months of service who sustain an injury or illness compensable by Workers' Compensation and who are unable to perform their assigned duties will be paid the difference between their regular salary and compensation benefits for lost time for the first ninety (90) calendar days of the employee's on the job illness or injury. Such time shall not be charged against any earned leave balance. (C) Employees under this Section shall have the option of giving their full Workers' Compensation check to the COUNTY and receiving their regular salary.
