Operator Qualifications. The Parties agree to permit Equipment to be used only by properly trained, properly licensed and supervised operators. All drivers shall be licensed and shall have a satisfactory driving record. All equipment operators shall be properly trained and qualified to operate the Equipment shared under this Agreement. Borrower shall make available to Provider upon request proof of training, licensing, and qualifications of operator(s).

Operator Qualifications. 12 The driver(s), provided by CONTRACTOR to drive a County Vehicle in the performance of the 13 Agreement, shall possess the following minimum qualifications: 14 A. Regularly employed by CONTRACTOR, at least twenty (20) hours per week and possessing 15 either: 16 1. A valid Class B California Driver's License in order to transport more than ten (10) 17 passengers, including the driver, in a County Vehicle as designed, used or maintained; or 18 2. A valid Class C California Driver's License in order to transport no more than ten (10) 19 passengers, including the driver, in a County Vehicle as designed, used or maintained. 20 B. A good driving record, as defined in writing by CONTRACTOR. Such definition shall exclude 21 any history of driving while under the influence of alcohol or other drugs, and shall include, but not be 22 limited to, the acceptable frequency and number of moving violations, and his/her ability to document 23 use of a County Vehicle by maintaining the Log described in paragraph IV. below. 24 C. Preferably, experience working with recovering substance abusers. 25 D. Any person(s) regularly assigned to operate a County Vehicle shall possess: 26 1. knowledge of basic vehicle maintenance; 27 2. knowledge of Orange County streets and freeways. 28
Operator Qualifications. All personnel or employees of the HSP operating water taxis shall have all certifications required and issued by the law of the country in which the port is located for the operation of the type, class, or size of water taxi being operated by such personnel. In addition, all such personnel shall have requisite experience, skill, knowledge, and familiarity with the water area in which the water taxis are to be operated to ensure the water taxis are operated in a safe and seaworthy manner. Operator Qualifications. Equipment shall only be operated by a qualified Operator provided by the Provider. At Borrower’s request, Provider shall provide proof of licensing and qualifications of the Provider’s operator, even during an emergency Share Period, prior to the commencement of the sharing period. If a Provider is unable to provide operator qualifications during an emergency Share Period, the Borrower’s recourse is limited to cancellation of the Equipment Sharing at the Borrower’s sole discretion.
