Overpayment of Salary and Allowance. (a) Where an error has resulted in an overpayment in an employee's basic salary, premium rates or allowances it may be rectified in total and retroactively for a period not to exceed one (1) year from the date on which the error was discovered.

The employee shall be provided with one (1) month notice of the City’s intent to recover any excess payment. The notice shall specify the amount, period and reason for the overpayment and the options available for repayment. The overpayment is repayable in full by personal cheque(s) or the employee may authorize a bi-weekly payroll deduction. The repayment period shall not exceed twelve (12) months. Where the employee involved has indicated hardship, the City and Union will meet to agree upon the repayment schedule. If the employee terminates employment prior to repayment in full, the City will have the right to recover the outstanding balance. In cases where the error is a substantive amount that should be apparent to the employee and there was no attempt to have the error corrected, the City may go as far back as the first time the mistake was made regardless of the time frame involved.
