Common use of Overtime/Compensatory Time Off Clause in Contracts

Overtime/Compensatory Time Off. An employee who has worked overtime may at the discretion of the Division/Department Head elect to receive time off in lieu of pay at the appropriate overtime rate, provided that the employee does not accumulate compensatory time in excess of Fair Labor Standards Act limitations. The application hereof shall be applied uniformly and shall not be arbitrarily or capriciously withheld. They shall receive this time off with pay in such a way as not to impair the operations of the work unit. In the absence of such election, the employee shall receive pay as provided herein.
