P articipation. Use of specific NASPO ValuePoint cooperative contracts by state agencies, political subdivisions and other entities (including cooperatives) authorized by an individual state’s statutes to use state contracts are subject to the approval of the respective state Chief Procurement Officer. Issues of interpretation and eligibility for participation are solely within the authority of the State Chief Procurement Officer. Pursuant to Section 00-00-000 of the South Carolina Code of Laws, ITMO is authorized to act as the statutory procurement agent for every state governmental body (as defined by S.C. Code Xxx. § 11-35-310(18), as amended). Consistent with its statutory authority, ITMO is acting solely in a representative capacity and on behalf of such state governmental bodies. Participation by local public procurement units (as defined by S.C. Code Xxx. § 11-35-4610(3), as amended) in the Master Agreement is optional. By submitting an order and receiving delivery of an item pursuant to the Master Agreement, a local public procurement unit manifests its intent to be and is bound by the Master Agreement, including this addendum, unless the local public procurement unit has entered into a separate Participating Addendum.

Pursuant to this Participating Addendum, the Master Agreement may be utilized by the following (“Purchasing Entities” or “Purchasers”):
P articipation. ACO Participant agrees to participate in and comply with the requirements of the Next Generation ACO Model, and shall provide health care services to Medicare beneficiaries assigned to TMIP’s ACO during the term of this Agreement. In the provision of such services, ACO Participant agrees to collaborate with TMIP and the other ACO Participants to be accountable for the quality, cost and overall care of the Medicare fee-for-service beneficiaries assigned to the ACO. In furtherance of the above, ACO Participant agrees to comply with and implement the ACO’s care management processes and patient-centeredness criteria, as periodically requested in writing by TMIP, and as may be amended from time to time. Further, ACO Participant agrees to comply with and to assist TMIP in complying with TMIP’s ACO Agreement and related documentation from CMS, including any agreement to share relevant patient data with CMS and/or TMIP. ACO Participant acknowledges and agrees that at no time shall ACO Participant be required to refer Medicare beneficiaries to ACO participants or ACO Participant/suppliers or to any other ACO Participant or supplier, except as permitted by law. ACO Participant further acknowledges and agrees that, in accordance with the terms of this Agreement, (i) ACO Participant shall have the right and obligation to participate in TMIP’s ACO; (ii) ACO participants as a group, which group includes ACO Participant, shall be represented on the governing body of TMIP’s ACO; (iii) ACO Participant’s opportunity to share in savings and/or TMIP_ParticipationAgreement 2020
P articipation. This NASPO ValuePoint Master Agreement may be used by all state agencies, universities, political subdivisions and other entities authorized to use statewide contracts in the State of Missouri. Issues of interpretation and eligibility for participation are solely within the authority of the State Chief Procurement Official. State agencies governed by Chapter 34 RSMo are specifically prohibited from acquiring printers (Group D) and scanners (Group F) through this agreement unless specifically authorized by the Director of the Division of Purchasing. Political subdivisions and universities of the State of Missouri may acquire printers (Group D) or scanners (Group F) through this agreement.
P articipation. In order to participate in the Program an applicant must submit a Program Participation Form, which may be rejected by the Company at its sole discretion. The Company shall evaluate each Program Participation Form and shall inform each applicant whether the Company approves such Program Participation Form, pursuant to which the applicant will become an Affiliate.

  • Public Participation 79. This Consent Decree shall be lodged with the Court for a period of not less than 30 Days for public notice and comment in accordance with 28 C.F.R. ' 50.7. The United States reserves the right to withdraw or withhold its consent if the comments regarding the Consent Decree disclose facts or considerations indicating that the Consent Decree is inappro- priate, improper, or inadequate. Defendant consents to entry of this Consent Decree without further notice and agrees not to withdraw from or oppose entry of this Consent Decree by the Court or to challenge any provision of the Decree, unless the United States has notified Defendant in writing that it no longer supports entry of the Decree.

  • Program Participation By participating in the CRF Program, Grantee agrees to:

  • Community Participation Goods, works, and services required for Part B.2 of the Project may be procured on the basis of community participation in accordance with rules and procedures acceptable to the Association, as set forth in the PIP.

  • Employee Participation The Employer will assist employees' participation in health promotion and health education programs. Health promotion and health education programs that have been endorsed by the Employer (Minnesota Management & Budget) will be considered to be non-assigned job-related training pursuant to Administrative Procedure 21. Approval for this training is at the discretion of the Appointing Authority and is contingent upon meeting staffing needs in the employee's absence and the availability of funds. Employees are eligible for release time, tuition reimbursement, or a pro rata combination of both. Employees may be reimbursed for up to one hundred (100) percent of tuition or registration costs upon successful completion of the program. Employees may be granted release time, including the travel time, in lieu of reimbursement.

  • Union Participation The Employer agrees not to interfere with the rights of the employees to become members of the Union and there shall be no discrimination, interference, restraint, or coercion by the Employer or any Employer representative against any employee because of Union membership or because of any employee activity officially sanctioned by this contract on behalf of the Union.

  • Mandatory Participation Participation in the Special Pay Plan is mandatory for all 24 eligible teachers.

  • Participation Contributor will participate in any Work Groups (defined in the Policy) identified above, and any other Work Groups that it actually participates in or notifies ODIF that it wants to participate in, according to the rules and procedures in the then-current OpenID Process Document (“Process Document”), which is fully incorporated into this Agreement by this reference, and subject to the Policy.

  • Participations By the issuance of a Letter of Credit (or an amendment to a Letter of Credit increasing the amount thereof) and without any further action on the part of the Issuing Bank or the Lenders, the Issuing Bank hereby grants to each Lender, and each Lender hereby acquires from the Issuing Bank, a participation in such Letter of Credit equal to such Lender’s Applicable Percentage of the aggregate amount available to be drawn under such Letter of Credit. In consideration and in furtherance of the foregoing, each Lender hereby absolutely and unconditionally agrees to pay to the Administrative Agent, for the account of the Issuing Bank, such Lender’s Applicable Percentage of each LC Disbursement made by the Issuing Bank and not reimbursed by the Borrower on the date due as provided in paragraph (e) of this Section, or of any reimbursement payment required to be refunded to the Borrower for any reason. Each Lender acknowledges and agrees that its obligation to acquire participations pursuant to this paragraph in respect of Letters of Credit is absolute and unconditional and shall not be affected by any circumstance whatsoever, including any amendment, renewal or extension of any Letter of Credit or the occurrence and continuance of a Default or reduction or termination of the Commitments, and that each such payment shall be made without any offset, abatement, withholding or reduction whatsoever.

  • DETERMINATION OF HUB PARTICIPATION A firm must be an eligible HUB and perform a professional or technical function relating to the project. Proof of payment, such as copies of canceled checks, properly identifying the Department’s contract number or project number may be required to substantiate the payment, as deemed necessary by the Department. All subcontracts shall include the provisions required in the subcontract and shall be approved as to form, in writing, by the Department prior to work being performed under the subcontract. A HUB performs a commercially useful function when it is responsible for a distinct element of the work of a contract; and actually manages, supervises, and controls the materials, equipment, employees, and all other business obligations attendant to the satisfactory completion of contracted work. If the subcontractor uses an employee leasing firm for the purpose of providing salary and benefit administration, the employees must in all other respects be supervised and perform on the job as if they were employees of the subcontractor.
