P ricing. Pepsi will provide Customer/Outlets a complete supply of Products during the Term of this Agreement and shall deliver such Products in a timely manner (based on mutually agreed upon delivery schedules) and in good and sanitary condition. The Products and Ancillary Products shall be purchased by the Customer from Pepsi at prices established by Pepsi. The current pricing schedule for Products is set forth on attached Exhibit B. Thereafter, the prices may be changed from time to time at Pepsi’s discretion, except that Pepsi shall provide thirty (30) days’ notice of any price increases during the Term. Any annual price increase is to be capped at 4%.
P ricing. The prices stated on the Purchase Order are not subject to increase, and, if no price appears thereon, shall not be higher than the last price quoted by Seller for similar Goods. Unless otherwise specified on the Purchase Order, prices include all charges for packaging, storage, and transportation to the point of delivery, and all taxes, duties, or other similar costs. No additional charges of any kind will be allowed.

For each Product ordered by Reseller, Reseller shall pay Xima the Reseller’s then-current Reseller Subscription Price, as established by Xima in Reseller’s then-current Product and Pricing List, (the “Subscription Reseller Price”) for the ordered Product, on a monthly basis throughout the entire Reseller Subscription Term, and continuing thereafter for so long as the Product is being made available to the applicable End-User. Reseller may charge and invoice the End-User its own price, including any xxxx-up, applicable taxes, etc.
P ricing. All fees paid to Licensor for the Services are non-refundable, unless an account is terminated by you under section 4 or by Licensor for a reason other than cause. Payment for Services must be made by a valid credit card accepted by Licensor, unless other payment arrangements have been made between you and an authorized Licensor representative. You hereby authorize Licensor to charge your credit card whenever you use the Services to send a campaign to more than 5 recipients, or on a monthly basis if you select monthly pricing. You agree to replace the information for any credit card that expires with information for a different valid credit card. Anyone using a credit card represents and warrants that he or she is authorized to use that credit card, and that any and all charges may be billed to that credit card and won’t be rejected. If Licensor is for any reason unable to effect automatic payment via your credit card, you will be notified via email and we may suspend your account until your payment can be processed.
